In these Terms and Conditions, Local Call refers to calls made to local numbers from fixed lines and mobile; Domestic Long-Distance Call ); Domestic Roaming includes direct calls made to domestic

Domestic call includes local calls, domestic long-distance calls (excluding 17909, and Family Long-Distance Calls) and calls made to domestic numbers from mobile on domestic roaming. Local call charges are not applicable to calls made to Voice information Service. Local refers to Shanghai Municipality. 2. The free domestic incoming calls, local-to-domestic long distance calls, domestic calls while on domestic roaming, domestic WiFi and domestic mobile internet in these Terms and Conditions do not cover Taiwan, Hong Kong and Macau. Mobile Add-on Package: Basic Monthly Fee (CNY/number) Free Calls Voice Call Charges (CNY/minute) Free Service Local 15 Domestic 15 Free local calls between mobile and fixed line numbers; Free domestic incoming calls for mobile; Share inclusive airtime in package.. Local: Domestic long-distance:0.20. Domestic while on roaming: 0.30 Domestic voice call: 0.15 Caller Display Colorful Ringback Tone The Customer can choose a suitable add-on package for a maximum of three cell phones. Mobile add-on packages must belong to the same type as the basic package, for example, users subscribing to the 56 Package can only enjoy the local add-on package, whereas users subscribing to the 66 Package can only enjoy the domestic add-on package Package Description: Basic Package: The offer is limited to one cell phone and one fixed line number (no monthly rental fee) subscribing to the basic package. The cell phone and fixed line must be held under the same account name and billing address Package Basic Monthly Fee: Upon activation of the package, the Customer is obliged to pay the monthly fee for the basic package selected. No separate monthly fee will be charged for the fixed line, mobile and corresponding functions in the selected package. The offers and charges of the basic package apply This promotion offer stipulates a monthly package. The inclusive allowances can only be used in the current month The inclusive local airtime of the 56 Package covers voice calls made to local numbers from fixed line and mobile. After the inclusive airtime is used up, voice call charges are calculated at: CNY 0.10/minute for local-to-local calls, CNY 0.20/minute for local-to-domestic long-distance calls and CNY 0.30/minute for domestic calls while on roaming.

3 The inclusive domestic airtime of the 66 Package covers local-to-local voice calls and local-to-domestic voice calls made from fixed line and mobile, in addition to domestic calls while on roaming. After the inclusive airtime is used up, voice call charges are calculated at CNY 0.15/minute If call forwarding is set up on the fixed line and mobile, the voice call minutes incurred by call forwarding are not covered by the inclusive airtime of the basic package. The standard rates apply for charges incurred by call forwarding The package includes ringback tone for fixed line and mobile, but does not cover the charges for setting new ringback tones The ringback tone package for mobile includes a number of tunes, which will automatically be played in rotating order for each incoming call WiFi Allowance refers to customers creating a wireless connection (WLAN) with the mobile number registered under the basic package through a China Telecom hotspot portal. Connecting to China Telecom s wireless broadband with a different user account is not covered by the "wireless connection" offer in the package. The Customer is not obliged to pay any charges if the actual wireless broadband usage does not exceed the monthly allowance of the package. Excessive wireless broadband usage is charged at the standard rates. When connecting to wireless broadband in different places, the Customer may experience uneven connection speed or internet service may be temporarily unavailable when the network is busy The inclusive local mobile data allowance of this package supports CDMA1X and EVDO connection, and covers local data usage incurred by the Customer via CARD-CARD, WAP, BREW and JAVA (excluding information charges). The Customer is not obliged to pay any charges if the actual mobile internet usage (local and domestic roaming included) does not exceed the monthly allowance of the package. Excessive data usage is charged at the standard rates (including local and domestic roaming). In different situations users of wireless connection may experience variations in connection speed or temporary unavailability of service. In this package, domestic mobile data charges are capped at CNY 1000, inclusive of CDMA 1X/EVDO/WLAN charges but excluding the basic monthly fee/monthly committed spending and charges for SMS, voice call and other value-added services. The maximum charge of CNY 1000 covers domestic data usage of no more than 20GB per month. After the 20GB limit is exceeded, the CDMA 1X/EVDA/WLAN functions will be automatically suspended. In the case of internet service suspension, all value-added services requiring internet connection will become unavailable. Mobile internet access will automatically resume in the beginning of the following month. If you would like to reactivate your suspended mobile internet service, please visit the sales outlets of China Telecom Shanghai or call our hotline For the remainder of the month, new data usage will be charged at the standard rates. The cap on domestic mobile data charges and usage and the subsequent service suspension will resume in the following month Customers subscribing to this package are entitled to a 189 Mailbox (their mobile

4 number will serve as account number) which supports Webmail and cell phone The value-added services of the package only covers monthly service fees. Charges for mobile data usage are excluded. The charges incurred by mobile data usage through the value-added services are calculated separately (mobile data usage can be covered by the monthly data allowance of the package (if any)) The standard charges of the basic package will become effective on the first day of the month after the application is accepted. Before the standard charges become effective, charges will be calculated according to the following for new customers: The monthly service fee for the fixed line service in the basic package is calculated on a pro-rata basis according to the standard rates, whereas airtime charges are calculated according to the standard rates. The monthly service fee of the mobile service is waived, and the Customer will enjoy 20 MB of free mobile local data usage. Local-to-local calls are charged at CNY 0.20/minute. Domestic incoming calls are free. The inclusive Airtime and WiFi/mobile data allowance will not apply. The service charges for caller display and ringback tone for fixed line and mobile, the ringback tone package for mobile, the 189 Mailbox and relevant one-off charges will be waived. Other charges are calculated according to the standard rates. Existing Customer: If under the original package charges incurred in the current month are due in the next month, then the charges of the original package will continue to apply in the month of subscription change, until the standard charges of the package of this promotion offer become effective. Value-added services that are activated by default during this time (which are not included in the original package) are charged at the standard rates for the relevant services The services and mobile data specified in these terms and conditions can only be delivered to handsets that support the said services and/or functions For all other unspecified charges, the current effective standard rates apply Mobile Add-on Package: One mobile number can be added to the basic package through each mobile add-on package. The mobile number(s) subscribing to the add-on package(s) must be linked to the fixed line account of the basic package Upon activation of the add-on package(s), the Customer is obliged to pay the corresponding monthly service fee for the package(s). No separate monthly fee will be charged for the mobile number and corresponding functions Free local calls between mobile and fixed line means local calls made between the mobile numbers subscribing to the add-on package(s) and the fixed line and mobile numbers participating in the main package are free If call forwarding is set up on the mobile numbers subscribing to the add-on package(s), the voice call minutes incurred by call forwarding are not covered by the inclusive airtime of the basic package. The standard rates apply for charges incurred by call forwarding.

5 The standard charges of the mobile add-on package will become effective on the first day of the month after the application is accepted. Before the standard charges of the add-on package become effective, charges will be calculated according to the following for new customers: The monthly service fee for the mobile number subscribing to the add-on package is waived. Local-to-local calls are charged at CNY 0.20/minute. Domestic incoming calls are free. The service charges for caller display, ringback tone and relevant one-off charges will be waived. Other charges are calculated according the standard rates. Existing Customer: If under the original package charges incurred in the current month are due in the next month, then the charges of the original package will continue to apply in the month of subscription change, until the standard charges of the mobile add-on package become effective. Upon activation of the mobile add-on package(s), in the case of outbound calls exceeding CNY 0.20/month (excluding free local calls within the package), the monthly service fee for the add-on package will be reduced to CNY 8/month/number For all other unspecified charges, the current effective standard rates apply Call Charges Rebate: Customers who purchase 3G smartphones through channels designated by China Telecom Shanghai, take part in this promotion offer and ensure normal voice service consumption by the mobile number in the basic package are entitled to variable free voice call credits during the promotion period. In a particular month, if five or more outgoing calls (including free calls within the plan but excluding calls to free special service numbers) are made from the mobile number in the basic package, the Customer is entitled to a corresponding rebate of voice call charges against the basic monthly service fee/monthly committed spending of the basic package in the beginning of the following month. The rebates are only valid in the current month; they cannot be carried forward or exchanged for cash, are not transferrable, and cannot be used to offset outstanding account balance from previous months. If no outbound call that matches the above requirements is made from the mobile number in the basic package during a month, no free credits will be offered to the Customer for the month, and the credits will not be reoffered at a later date. During the validity period of the offer, in the case of changes in account information, including but not limited to the submission of information missing at the time of account opening, new service package subscription and switch between pre-paid and post-paid service, no free credits will be offered in the month that the changes are made, and the credits will not be reoffered at a later late. The free voice call credits are divided into two parts: The free credits for the first month after service commencement" are offered in the first month after service commencement; the free credits for the following 23 months" refer to equal amounts of free credits offered to the Customer on a monthly basis from the 2 nd to the 24 th month after service commencement. The corresponding free credits offered for various amounts of committed spending are as follow:

Upon modification of package subscription, the mobile add-on packages must also be upgraded in accordance with the basic package (local, domestic). The new package will be effective on the first day of following month. 6. Notes to Customer: 6.1 Terms and Conditions Validity: These Terms and Conditions are valid for two years, from the first day of the month after the services in the basic package commence. After the Terms and Conditions expire, the Customer is free to change their subscription or terminate their account. After the subscription changes or account termination becomes effective: the offers of the package (including mobile add-on packages) will end. The Customer may choose to subscribe to other E-Surfing e-home packages or promotion offers of China Telecom Shanghai available at the time of account termination. Changes in package subscription will become effective on the first day of the month after the relevant procedures have been completed. Upon contract expiry, if the Customer does not change their service subscription or terminate their account, China Telecom Shanghai shall not terminate the communications services provided to the Customer if it remains capable of providing the Customer with the package specified in these Terms and Conditions and if there is no outstanding balance in the said Customer s account. Service will continue to be provided based on standard charges of the Package specified in these Terms and Conditions (rebates not included). If China Telecom

7 Shanghai is unable to provide the accorded package, notification of package termination shall be given to the Customer one month in advance. 6.2 If a fixed line and/or mobile number already participate(s) in other promotion offers of China Telecom Shanghai and is/are bound by the Terms and Conditions of the promotion offer(s), the said fixed line and/or mobile number may not participate in this promotion offer without the consent of China Telecom Shanghai. 6.3 The Customer is obliged to choose a monthly committed spending that is higher or equal to the basic monthly service fee of the selected package (including mobile add-on package(s)). The monthly committed spending is deductible against the basic monthly service fee of the package (including mobile add-on package(s)) and voice call charges incurred under the package, with the exception of SP/CP charges, Taiwan, Hong Kong and Macau long-distance/roaming charges and international long-distance call/roaming charges. If the actual monthly spending of a Customer is lower than their monthly commitment, China Telecom Shanghai will charge the Customer their monthly committed spending. Spending in excess of the monthly commitment will be charged accordingly. 6.4 Customers with outstanding accounts are not eligible for this promotion offer, unless the outstanding payment is settled in full. 6.5 The Customer opts to use the CDMA UIM card provided by China Telecom Shanghai. In the case of loss, theft or damage of the UIM card, the Customer can present their valid identity document to China Telecom Shanghai to arrange for voluntary service suspension, card replacement or card exchange. The Customer is liable for any charges that may apply. Card replacement and card exchange are charged at the standard rates for the relevant services. 6.6 For customers who participate in this promotion offer with their own devices, if services cannot be delivered due to the terminal device(s), China Telecom Shanghai shall not be obliged to reduce the service charges. 6.7 After the UIM card is activated, please change the password immediately and keep it in a safe place. All requests for services submitted with the Customer s user password are considered to have been submitted by the Customer in person. 6.8 During the validity period of these Terms and Conditions, in the case of changes to non-designated packages, or account transfer, service suspension with number retention or service termination relating to this promotion offer (including mobile add-on packages), the Customer will be considered to have withdrawn from this promotion campaign. 6.9 The Customer is obliged to settle their account on time. If payment is not made before the due date, the Customer is liable to a contract violation penalty equivalent to 3 of the outstanding account balance per day. If the Customer s account remains outstanding 30 days after the agreed payment due date, China Telecom Shanghai shall suspend the services provided to the Customer If the mobile or fixed line number subscribing to this promotion offer is suspended due to the Customer s responsibility, including but not limited to outstanding account balance,

8 the Customer shall remain obliged to pay the basic monthly fee of the selected package(s)/monthly committed spending. For Customers participating in the Call Charges Rebate Offer, no voice call credits will be offered for the corresponding month(s), and the credits will not be reoffered at a later date. If service is suspended for more than 60 days, and the account remains outstanding, or if any other causes for the service suspension remain, China Telecom Shanghai reserves the right to terminate the services provided to the Customer During the validity period of these Terms and Conditions, should the Customer withdraw from this promotion campaign or cause it to end prematurely, they are required to pay all outstanding charges and a pre-mature contract termination penalty equivalent to four times the basic monthly service fee. Customers who have enjoyed waivers of one-off charges are obliged to reimburse China Telecom Shanghai in full for the said waivers and all the free credits received under this promotion offer. The promotion offer of this package (including mobile add-on and optional packages) will be terminated, and the service offerings in the package will be charged at the standard rates Upon service commencement, the Customer will be billed for the service fee of the package for the first month and all one-off charges in the next service month. The basic monthly service fee/monthly committed spending will be reflected in the bill from the third service month onwards Each individual customer with one ID can subscribe to a maximum of five post-paid single-product packages and mobile bundle packages. 7. During the service period, China Telecom Shanghai shall provide communications services in compliance with The Telecom Regulations of the Peoples Republic of China and related ordinances and regulations. In the case of violation, Chine Telecom Shanghai shall take responsibility for contract violation. 8. These Terms and Conditions serve as a supplementary agreement to the Service Agreement of China Telecom Corporation Limited Shanghai Branch and the Mobile Service Subscription Agreement of China Telecom Corporation Limited Shanghai Branch. Should the aforementioned agreements interfere with the contents of these Terms and Conditions, these Terms and Conditions shall prevail. The Customer s signature on the Customer Registration Form of China Telecom Corporation Limited Shanghai Branch serves as proof of their confirmation and acceptance of these Terms and Conditions and the aforementioned agreements.
