4 The new Telecommunications Act: obliges companies dominating the market to provide unbundling. offers investment protection, as it only prescribes the unbundling of the copper access network; Investments in the network (such as optical fibres) are therefore protected. definitely specifies the types of unbundling: full unbundling (FULL), co-location, access to ducts; leased lines, re-billing of subscriber connections and bitstream access. Laid down in the ordinance: cost-oriented rental charge for the unbundled offers to be calculated by the LRIC method. 4

6 Swisscom has market dominance only in certain areas Market dominance means: - being able to act independently of other providers - being able to shape prices freely Swisscom does not have dominance in the broadband market and therefore does not have to make a bitstream offer: - Intense competition with over 2.5 million broadband-capable cable television connections - The Appeals Commission for Competition Issues (REKO/WEF) ruled that there was no market dominance. 6

8 Swisscom to invest massively in network expansion thanks to the Telecommunications Act's investor protection To date Swisscom has invested several hundred million francs in extending its optical fibre network (VDSL) to local neighbourhoods. Swisscom will set up 5,800 street cabinets in order to route optical fibres into the neighbourhoods. Swisscom installed 74,025 kilometres of optical fibres in 2006 alone. Bluewin TV is accessible by around 65% of households. By the end of 2007, Swisscom will provide VDSL 750 (up to 30 MBit/s) coverage to some 50% of the Swiss population. 8

20 Swisscom is not free to decide the regulated prices Law LRIC Method ComCom/ Federal Court ruling on LRIC The Telecommunications Act prescribes cost-based prices The Ordinance on Telecommunications Services prescribes the LRIC method* for this purpose LRIC is used in most EU countries The LRIC method aims to calculate the 'right' prices to allow for infrastructure-based competition not to devalue existing telecommunications infrastructures Approach of model: 'an efficient provider setting up a new network replacement values rather than asset values Following the Federal Court ruling on LRIC (April 2006), Swisscom has changed its LRIC model and adapted it to the requirements of ComCom/the Federal Court Amortisation period in line with International Financial Reporting Standards (IFRS) *LRIC: Long Run Incremental Costs 20

28 In brief: the Telecommunications Act commits only those companies which dominate the market. The Telecommunications Act offers investment protection for new investments. Swisscom is investing: Switzerland currently has the best infrastructure within Europe and that applies across the whole country thanks to Swisscom. Swisscom has prepared for the unbundling offers prescribed by the state Swisscom does not have a free hand in pricing matters but follows the law - LRIC method. LRIC is based on the assumed expenditure of an efficient provider. Prices are cost oriented rental prices: the last mile will stay in our possession Swisscom retains responsibility for maintenance, customer support, etc. 28
