9 THE LAWS 44 States including DC, PR, Guam, Virgin Islands have a texting ban: ü 39 States have primary texting enforcement ü 5 States have secondary enforcement Remaining 6 States have no law or limited ban: ü Arizona and Montana have no texting law ü Texas, Oklahoma, Missouri, Mississippi have texting ban for novice drivers only Some States have applicable laws that help with Distracted Driving Enforcement ü Impeded Operation

11 PROVIDE SUPPORT Be familiar with what is enforceable under the law. Distracted driving laws can be very specific or they may include some level of vagueness.

12 PROVIDE SUPPORT The enforcement community, officers need to be made aware of the viola8on codes and exactly what the distracted driving laws prohibit. In Delaware, for example, a driver can legally pick up and use a cell phone when not in mo8on, e.g., at a stop light.

13 TAKING ACTION HOW? Enforcement agencies are unique; there s no one size fits all approach. From past and current projects, NHTSA has demonstrated a variety of successful enforcement techniques. 15 WHAT DO WE KNOW In 2009 NHTSA launched two pilot tests of HVE programs to assess whether increased law enforcement combined with media can get drivers to put down their cell phones and focus on the road. Hartford, CT and Syracuse, NY Texting while driving declined 72% in Hartford, CT (from 3.9% to 1.1%) and 32% in Syracuse, NY (from 2.8% to 1.9%). Results high visibility enforcement can reduce talking or tex<ng using a hand- held cell phone This project was intended to focus on hand- held bans but research added tex<ng enforcement as well. There were far fewer cita<ons and observa<ons. This was impetus for the MA and CT tex<ng ban demos.

16 MORE EVIDENCE California 10,700 distracted driving citations issued. Recognition of the message Phone in One Hand. Ticket in the Other quadrupled from 16% (baseline) to 57% (post). Delaware 5,600 distracted driving citations issued. Message recognition doubled (from 7% to 15%). Overall, widespread deployment is feasible Distracted Driving Enforcement Mobilization

17 EFFICACY OF STRATEGIES NHTSA is partnered with Connecticut and Massachusetts to test the enforceability of texting bans. Four enforcement waves were conducted in both States. While different techniques worked best in different areas, both Massachusetts and Connecticut implemented techniques that appeared to be effective for enforcing texting bans.

20 TRAINING Texas Jase Herring, Law Enforcement Liaison Distracted Driving Course for Law Enforcement 4 hour course Through the Commission on Law Enforcement Officer Standards and Education (TCLEOSE) The goal of this project is to reduce the number of crashes and injuries related to distracted driving.

21 TRAINING TEXAS CONTINUED Getting Officer s Attention Getting Back to Basics Develop and implement public information and education efforts on traffic safety issues. Provide assistance to update the drivers' education curriculum and administrative standards. Conduct and assist local, state and national traffic safety campaigns. Implement and evaluate countermeasures to reduce the incidence of distracted driving. Conduct public information and education campaigns related to distracted driving. Improve the recording of distracted driving as a contributing factor on crash reports.
