Scope of Campaign:Individual customers of China Telecom Shanghai 3. Product for Promotion: China Telecom Shanghai s postpaid mobile service (hereafter mobile ) postpaid fixed line service (hereafter fixed line ); mobile and fixed line based value-added services 4. Duration of Campaign: January 1 to June 30, Details of Campaign: 5.1. Details of Package: Basic Package(Enjoy 4G Mobile Main UIM Card): Additional Basic Domestic Charge on Domestic Monthly Data Top of Fee Usage Airtime Package: (Min./ (CNY/ (per Domestic Month) No.) Month) Airtime (CNY/Minute) MB Additional Charge on Top of Package: Domestic Data Usage Under 100MB, CNY 0.30/MB; MB, free; the same principle applies for excessive data usage of 500 MB or more (i.e. CNY 30 for every 500 Domestic Free SMS/MMS Incoming (CNY/Message) Call 0.1 Domestic Complimentary Offer Caller ID; 189 mailbox
2 MB). Remarks: 1. Taiwan, Hong Kong and Macau are not covered in the service area for domestic. Local refers to Shanghai Municipality. 2. In these Terms and Conditions, Domestic Call includes local to local calls, local to domestic long distance calls, domestic calls while on domestic roaming. Voice call charges do not cover and 11808, Family Long-distance calls, 800 Paid Toll Free calls and calls to Voice Information Service. Voice calls are charged by the minute. 3. Inclusive Mobile Data Usage is restricted to Mainland China only, irrespective of the type of network access by 4G, 3G or 2G and excluding WLAN (WiFi) Enjoy 4G Mobile Supplementary UIM Card: Basic Monthly Fee Content (CNY/number) Sharing of airtime, data usage and 5 the extra fee out of package with main package Remarks: Free Incoming Call Domestic Complimentary Offer Caller Display; 189 Mailbox 1. One main UIM card can only be grouped with a maximum of 4 supplementary cards.2. Service options including SMS, MMS service and data packages for designated applications are available for Main and Supplementary UIM Cards while all the usages are not shared between main and supplementary UIM cards e6 Fixed line add-on package Basic Monthly Fee Content (CNY/number) Both Enjoy 4G mobile main UIM card and supplementary UIM cards share with 200 minutes/ month 5 domestic airtime Sharing of airtime, data usage and the extra fee out of package with Enjoy 4G main package Remarks: Free Incoming Call Local Complimentary Offer Caller Display; 189 Mailbox 1. The Customer can choose one add-on fixed line package of his preference for each basic package. 2. Fixed line add-on package is limited to one post-paid residential fixed line number Package Description:
3 5.4.1The offer is limited to one handset joining a basic package. One main UIM card can only be grouped with a maximum of 4 supplementary cards. Each basic package can only add-on one fixed line package. Main and supplementary UIM cards, and fixed line add-on package must be billed under an identical account with same registered name and address Main and supplementary UIM cards can be either 4G or 3G with its relevant handset One supplementary card plan can only be operated on one number only. After the activation of the supplementary card(s), they can share free airtime and data usage of the main package s limit. If the main UIM card is terminated in the service package, all supplementary accounts, and fixed line add-on package will also be withdrawn. Standard charges for the product will be resumed Basic Monthly Fees: After the activation of the package(s), customers should settle the basic monthly fee according to the package selected. Separate monthly rental charges no longer apply to the handset, and corresponding functions in the basic package. The relevant offers and charges are executed under the terms and conditions of this basic package This promotional offer is a monthly plan. Service(s) in the package is only available in the respective service month Any change or termination of the service will be effective upon the next service month. Refund is not entertained in the first month If call forwarding is set up on the handset and fixed line participating in this package, the call minutes incurred by call forwarding can be covered by the inclusive domestic call allowance of the package. After the inclusive minutes are used up, the package s standard rates for domestic call apply The WIFI account number is the number(s) of the Main or Supplementary UIM cards joining the plan. The password will be sent through SMS for secure login to China Telecom WLAN network. Fee will be charged on the basis of the standard service charge All customers of the above plans are entitled to a 189 mailbox (account number is identical to main UIM card or supplementary UIM card number) with WEB mailbox and mobile mailbox functions Domestic SMS/MMS: SMS/MMS service is included in our packages. Our MMS service is comprehensive with text, images, voices, video clips and various multimedia contents. It is transmitted by WAP over the Data network of China Telecom Shanghai for point-to-point messaging The mobile Internet access is compatible with 4G, 3G and 2G network access. No extra payment shall be incurred if the domestic data usage via mobile device(s) does not exceed the maximum limit of the package. For extra domestic data usage generated below 100MB, 0.3CNY/MB will be incurred; extra domestic data usage generated within 100MB-500MB will be free of charge, while extra domestic data usage generated beyond 500MB will be charged in accordance with the above rule (i.e. every 500MB exceeded will be charged 30 CNY), and by this analogy. Minimum charge unit is CNY /KB. Usage under 1KB will be rounded up to the nearest 1KB and charges under 0.01 CNY will be rounded up to
4 the nearest 0.01CNY For new fixed line customers, a one-off fixed line installation and handling fee of CNY 140/line will be waived The Caller Display and Colourful ringback tone services for fixed line and mobile as included in the package do not cover fees for customization of colourful ringback tone Charges of the basic package and fixed line add-on package will become effective on the first day of the following month after the subscription application is accepted. Before the standard charges become effective, charges will be calculated according to the following: For new customers, the payment of the first month is calculated with the formula: basic monthly fee of the first month = (basic monthly fee/number of calendar day of that month) * number of days among the first day of service to the last calendar day of the month (including domestic airtime and internet access). The level of discount is exercised in proportion to the number of calendar days in the first month of service and calculated with round off basis (The nearest KB for network traffic, the nearest minute for domestic airtime).service charges for domestic incoming call, 189 mailbox, caller ID service and all one-off charges are waived. Domestic internet access over 500MB will be charged at CNY 30. All other services with excessive usage are charged according to the standard charging scheme. For existing customers subscribing the service, original payment will remain intact until the date of this plan becomes effective Supplementary UIM card charging standard is validated on the first day of the next service month after subscription application is accepted. Between the effective date of this plan and new service activation: For new customers of supplementary UIM card (Original Enjoy 3G customers who upgraded the supplementary card to 4G are excluded), the payment of the first month is calculated with the formula: basic monthly fee of the first month = (basic monthly fee/number of calendar day of that month) * number of days among the first day of service to the last calendar day of the month.supplementary UIM cards can share the offers of the Main UIM card (including domestic airtime and internet access). Service charges for domestic incoming call, 189 mailbox, caller ID service and all one-off charges are waived. Exceeding domestic internet access will be charged according to standard fees for the Enjoy Main UIM card. All other services with excessive usage are charged according to the standard charging scheme. Services for Supplementary UIM cards of original Enjoy 3G customers upgrading to Enjoy 4G will be charged according to the original Enjoy 3G plan s charging rates. For existing customers subscribing the service, original payment will remain intact until the date of this plan becomes effective All services and modes of mobile Internet access and Wi-Fi Internet access pinpointed
5 in our Terms and Conditions are activated alongside the compatible mobile device The total monthly nationwide data usage fee (including additional charges incurred by 4G/3G/2G internet access, excluding basic monthly fee of the plan, SMS, MMS, voice call, WLAN, other value-added services and fee of all optional packages) of the main UIM card and supplementary card(s) is capped at CNY 600. In addition, the monthly domestic data usage is capped at 15GB. The internet access service (4G/3G/2G/WLAN) will be suspended automatically when the ceiling is reached. Value-adding service components which are based on internet access of both main UIM card and supplementary card(s) cannot be used. The internet access service will resume in the first calendar day of the following service month automatically. If customers would like to resume the internet access service in the month of suspension, please contact our sales representatives in sales outlets or call to reactivate internet access function (customers may choose to activate the internet access function in main UIM card or supplementary card(s) only). For internet access, additional charge of CNY 0.3 /MB is incurred for usage below 100MB. All additional charge will be waived for usage in between 100MB to 500MB. While the data usage out of package exceeds 500 MB, it will also be charged according to the principle mentioned above (CNY 30 / 500MB) and by this analogy. Usage less than 1KB will be rounded up to the nearest 1KB and charges under CNY 0.01 will be rounded up to the nearest CNY Maximum usage will be temporarily removed for the new top-up and reinstated in the next service month. Suspension of internet access when the ceiling is reached will continue in the next month All service charges not stated in this regulation are charged in accordance with standard charging scheme The data allowance rollover service has been activated in this package. Unused data allowance in the current month will be carried forward to the next month. However, all unused allowance will expire at the end of the second month. Promotional, complimentary or transferred data allowance cannot be carried forward. If the Customer changes the package, transfers or closes their account, the unused allowance in the original package will not be carried forward. Suspension due to non-payment, suspension while number is retained, suspension due to loss of handset and forced suspension: If the package monthly service fee is not paid, the unused data cannot be carried forward to the next month. When the carried forward allowance from the previous month has been confirmed, data usage will first be deducted from the carried forward allowance and then from the package allowance for the current month. 5.5Call Charges Rebate: During the promotion period, customers who subscribe E-Surfing 4G Package with the purchase of a cell phone of selected model(s) via designated channel(s) by China Telecom Shanghai or with their own handsets are eligible to join the contract package and enjoy the rebate in
6 accordance with the plan. Each number (main UIM card) can subscribe once without repetition. Duplicate subscription of E-Surfing Enjoy 4G Package or subsidies from other packages is not entertained. Details as follows: Monthly rebatefrom the Rebate in the Total Fee of Contract first month to the last month Rebate (CNY) Period second last (CNY) month(cny) months Note: The rebate is offered in relation to the package selected and is divided into two parts: Monthly rebate from the first month to the second last month is granted on a monthly basis from the first month to the twenty-third month upon subscription. Rebate in the last month is granted in the twenty-forth month upon activation The rebate is used for deduction of basic monthly fee in the package (main UIM card only). It is non-refundable and non- transferrable. It can neither be used for settling outstanding charges incurred in the previous months nor for reactivating a suspended number The system will deduct the rebate from the basic monthly fee according to packages and products selected by customer at the beginning of each service month. 6. Notes to Customer: 6.1 Terms and Conditions Validity: The contract period of the above packages is 24 months: For new customers or customers with no on-going contract subscribing to the package ( E-Surfing e6 New Mobile Bundle Package (Rebate Version)), the contract period will start from the first day of the next service month upon service subscription of this rebate version (including Basic package) Customers whose phone number is used in other mobile promotion campaign of China Telecom Shanghai and customers whose contract will expire within the next six months can join this rebate version contract by extending their contract period or upgrading their package to a higher monthly fee package. After changes: The Basic package chosen by the customer will be effective upon the first day of the next service month upon service subscription The contract period of this rebate version contractwill commence upon
7 expiry of the original campaign. That is: The final contract period =Remainder of contract period of original campaign + Contract period of this rebate version contract The rebate is granted from the first month of this contract After the contract period, Customers may change the service package or terminate the service by following the procedure correspondingly. Offers of this promotion Package (includes basic package, supplementary card and fixed line add-on package inclusively) will be withdrawn when customers change the service package or terminate the service. Customers may choose any valid E-Surfing Plans or other promotions of China Telecom Shanghai at that time. Change of servicewill be effective on the 1 st day of next service month upon service activation Upon contract expiry, if the Customer does not change their service subscription or terminate their account, China Telecom Shanghai shall not terminate the communications services provided to the Customer if it remains capable of providing the Customer with their chosen E-Suring Enjoy 4G package and there is no outstanding balance in the said Customer s account. Service will continue to be provided based on the agreed standard charges of the package.the offer of rebate in this package, however, will be withdrawn. If China Telecom Shanghai is unable to provide the accorded package, notification shall be given one month in advance to customers and ask them to sign for a new contract. 6.2 Mobile phone and fixed line customers already subscribed to other promotional offers of bundle package from China Telecom Shanghai and still in the validity period of the offer or customers whose phone number is used in other mobile promotion campaign with contract expiry within the next six months cannot take part in this promotion without the approval from China Telecom Shanghai. 6.3 Customers with outstanding accounts are not eligible for this promotion offer, unless the outstanding payment is settled in full. 6.4 Customers ought to cooperate with China Telecom Shanghai to implement the activation of services within the plan. 6.5 Customers benefit from their voluntary use of UIM card provided by China Telecom Shanghai. During the service period, if the UIM card is lost, stolen or damaged caused by misuse, customers can apply for temporary suspension, reissue or replacement with additional charges. Customers activating the 4G functions must use a mobile phone terminal that supports China Telecom 4G UIM card in order to access the service. 6.6After the UIM card is activated, please change the password immediately and keep it in a safe place. All requests for services submitted with the Customer s user password are
8 considered to have been submitted by the Customer in person. 6.7 Mobile Internet access may have unstable connection speed or failure in connection in some locations. Internet access while roaming depends on the network coverage of respective locations. Your understanding on the failure in connection while roaming is highly appreciated. 6.8 Customers should settle service charge on time to avoid any service interruption. During the validity period, initiations of account transfer and service cancellation of this campaign (including the basic package, Supplementary UIM Card and fixed line add-on package) will be regarded as withdrawal from this campaign due to personal reasons. Customers are required to pay all outstanding charges, and cover 4 times of basic monthly fee being penalty for pre-mature termination. Customers must return all rebates in full. Promotional offer of this package (basic package, Supplementary UIM Card and fixed line add-on package included) will be terminated, and standard charges for respective product will be resumed. Customers who join this rebate version package 6 months prior to expiry of their original campaign and withdraw before this campaign commences are liable to penalty for pre-mature termination in accordance with the terms and conditions of the original campaign. 6.9 Customers whose phone number is registered in other promotion campaign of China Telecom Shanghai and customers and its validity period of service is not less than 6 months are not eligible for subscribing this package Upon service commencement, postpaid Customers will be billed for the service fee of the package for the first month and all one-off charges in the next service month. The package s basic monthly fee will be billed from the third service month onwards Customer registered under one identical ID is eligible to subscribe maximum of 5 post-paid mobile single and bundled product(s). 7. During the service period, China Telecom Shanghai will provide service in accordance with The Telecom Regulations of the Peoples Republic of China and its related ordinances and regulations. In case of any dispute, responsibilities shall be allocated in accordance with the aforesaid regulations. 8. These Terms and Conditions serve as a supplementary agreement to the Service Agreement of China Telecom Corporation Limited Shanghai Branch, the Mobile Service Subscription Agreement of China Telecom Corporation Limited Shanghai Branch and the Broadband Service Subscription Agreement of China Telecom Corporation Limited Shanghai Branch (The valid version for the promotion period shall be considered as final). Should the aforementioned agreements interfere with the contents of these Terms and Conditions, these Terms and Conditions shall prevail. The Customer Registration Form of
9 China Telecom Corporation Limited Shanghai Branch is a component of these Terms and Conditions. These Terms and Conditions shall become effective after the Customer signs the Customer Registration Form. The Customer s signature on the Customer Registration Form serves as proof of their confirmation and signing of these Terms and Conditions and the aforementioned agreements.
