Raley, Commissioner PUBLIC HEARING STAFF REPORT To: Planning Commission From: Jeffrey Jackman, Senior Planner Date: May 4, 2005 Hearing Date: May 23, 2005 Re: Ranieri Run, CWSP # Pursuant to the provisions of the St. Mary s County Comprehensive Water and Sewerage Plan (the CWSP ), the Planning Commission will hold a public hearing May 23, 2005, to consider a request to amend the CWSP as follows: Proposed: amend service area maps III-51 and IV-51 to change the service area category from W-6 and S-6 (service in 6 to 10 years) to W-3D and S-3D (service in 3-6 years, developer financed) for property described as Tax Map 51, Grid 22, Parcels 272 and 282 in the Eighth Election District in anticipation of a 112-lot subdivision for residential development. I. DEVELOPMENT DATA: Owner: Sturbridge Homes Agent: The Tech Group Location: Map 51, Grid 22, Parcels 272 and 282 in the Eighth Election District Zoning: RL II. BACKGROUND INFORMATION: This concept site plan was reviewed by all the TEC agencies in February The Planning Commission granted concept approval on March 28, III. ANALYSIS REQUIRED PURSUANT TO SECTION 1.5.3(D) OF THE ST. MARY S COUNTY COMPREHESIVE WATER AND SEWERAGE, 1.5.3(D)(1) 1.5.3(D)(2) 1.5.3(D)(3) A public hearing is scheduled for May 23, 2005; notice has been duly advertised in The Enterprise, a newspaper of general circulation in St. Mary s County, on May 4, 2005 and May 11, The Department of Land Use and Growth Management has: (a) Consulted every official planning agency having any immediate jurisdiction in the county, including those with multi-county or regional jurisdiction; (b) Provided to the Maryland Department of the Environment ( MDE ) a statement that the above agencies have been consulted; and (c) Provided MDE with prior written notice of the hearing. 2 Public hearing staff report for May 23, 2005 Ranieri Run Subdivision CWSP # Page 2 ii) iii) iv) A. i. a. supports the extension of sewer service within growth areas Establish and maintain public and community facilities to encourage Resource Conservation and to meet the public health, safety, and welfare needs of residences in an efficient and cost effective manner (iii)(a) Protect and manage groundwater resources to maintain a safe and adequate water supply (iii)(c) Provide phased distribution system matched to growth in the county. This project is consistent with these provisions of the comprehensive plan Planning and zoning issues. Per section 1.5.3(a) of the CWSP, concept approval of the proposed development by the Planning Commission is prerequisite to eligibility for amendment, and was granted March 28, The proposed development is permitted in the RL zoning district. Population estimates. The subdivision proposes 112 dwelling units. The daily water demand at build-out would be 36,400 gallons, and sewage generation would be 33,600 gallons per day The Lexington Park water distribution system and the Marlay Taylor wastewater treatment plant are well able to provide service in these amounts. Engineering. All construction will be in accordance with St. Mary s Standard Specifications for Water and Sewerage Construction. v) Economics. Applicant will bear all installation costs. No other properties are contemplated for service under this amendment. vi) vii) State, regional and municipal plans. Before an amendment to the CWSP is finalized, it must be reviewed by the state for compatibility with state laws and programs. Staff does anticipate that the proposed amendment(s) will be found to be compatible with applicable state laws and programs. Comments received from other agencies in the County. Per section C. of the CWSP, principal Technical Evaluation Committee comments from the Health Department and Metropolitan Commission must become part of the record to complete the application. In summary, these agencies support the provision of community sewer service to the subject properties. IV. ACTION REQUESTED OF PLANNING COMMISSION. i) Conduct public hearing ii) Close record iii) Forward a recommendation to the Board of County Commissioners SAMPLE MOTION: In the matter of Raneri Run Subdivision, Case CWSP : having accepted the staff report dated May 4, 2005, and having held a public hearing on the request for amendment to the St. Mary s County Comprehensive Water and Sewerage Plan (CWSP), and having made findings of adequacy with respect to the objectives and policies of the CWSP as required by the Environment Article of the Maryland Annotated Code and of consistency with the St. Mary s County Comprehensive Plan, and having determined that the proposed amendments are consistent with the Comprehensive Plan, I move that the Planning Commission recommend to the Board of County Commissioners to amend service area maps III-51 and IV-51 to change the service area category from W-6 and S-6 (service in 6 to 10 years) to W-3D and S- 3D (service in 3-6 years, developer financed) for property described as Tax Map 51, Grid 22, Parcels 272 and 282 in the Eighth Election District in anticipation of a 112-lot subdivision for residential development, and authorize the Chairman to sign a resolution to transmit this recommendation to the Board of County Commissioners
