1 Commonwealth Edison Company Renewable Energy Resource RFP Registration with PJM-EIS GATS The Commonwealth Edison Company ( ComEd ) procurement plan provides for the procurement of Renewable Energy Credits ( RECs ) through a Request for Proposals ( RFP ). REC Suppliers pursuant to this RFP fulfill their REC delivery obligations by transferring RECs to ComEd s PJM EIS GATS ( GATS ) or M-RETS Account. Each REC Bidder certifies in its Part 1 Proposal either that it is an account holder with GATS or with M-RETS, or that it has no impediments to becoming a GATS or M-RETS account holder by August 1, This document provides a summary of the requirements for setting up a GATS account. Information provided here is a summary only and is provided for the convenience of REC Bidders. REC Bidders are solely responsible to obtain from the PJM-EIS GATS Administrator any information necessary to their participation with GATS. Read and agree with the GATS Terms of Use ( Terms of Use ). 2. Complete, fax and mail originals of the following Schedules to the Terms of Use. a. Schedule A Generator Owner s Consent. b. Schedule B Statement of Subscriber Affiliate, if applicable. c. Schedule C-1 Consent of Subscriber d. Schedule D-1 Declaration of Agency, if applicable. e. Schedule E Billing Information Form of Subscriber (E-1) and Subscriber Affiliate, if applicable (E-2). 3. Complete an on-line New Account Application. 4. Activate its account. 5. Register its Generators with GATS (if applicable). An applicant may need to obtain a State Certification Number from one of five state agencies registered with GATS. Review, sign and return by fax the applicable schedules to the Terms of Use described below. A Subscriber is required to: agree to be subject to any guidelines and/or operating rules of GATS; represent that all information provided to PJM-EIS shall be true, complete and correct; agree to take all appropriate steps and precautions to safeguard and protect the access, use and security of GATS and Subscriber s user access information from unauthorized users; agree to comply with all applicable local, state, federal and international laws and regulations, including but not limited to United States export restrictions that relate to the use of or activities on GATS site; agree to pay any Subscription Fee, Volumetric Fee and Certification Fee as appropriate. Schedule A to the Terms of Use Generator Owner s Consent Through this schedule, a Generator Owner names its generating unit(s), and grants authority and permission to the subscriber to create and trade all RECs associated with the named generating unit(s). The Generator Owner further represents that no other subscriber or account holder have been granted similar authority or permission for use in GATS or any similar system. If the Generator Owner is a corporation, partnership or other legal entity, Schedule A must be executed by a company officer of the Generator Owner. If Generator Owner is an individual, Schedule A must be executed by the individual. 2b. Schedule B to the Terms of Use Statement of Subscriber Affiliate The term Subscriber Affiliate is defined in the Terms of Use, and is used to refer to a Subscriber s parent, Subscriber s wholly owned subsidiaries or any wholly owned subsidiary of Subscriber s parent (each a Subscriber Affiliate ). The rights and permissions to use GATS under the Terms of Use are granted only to the Subscriber and the Subscriber Affiliate(s) named in Schedule B. Each Subscriber Affiliate s signatory agrees to be bound to the terms and conditions of the Terms of Use and the Consent of Subscriber (Schedule C-1) executed by the Subscriber as though signatory to the same, except that, as a Subscriber Affiliate, it will not be obligated to pay the Subscription Fee as otherwise required by the Terms of Use. 2c. Schedule C 1 to the Terms of Use Consent of Subscriber A signatory for the Subscriber acknowledges that he/she has read the Terms of Use and understands that PJM-EIS may modify the Terms of Use from time to time. A signatory affirms that he/she has the authority to execute this Consent on behalf of Subscriber. The Subscriber is not given access to GATS until the Consent has been signed and has been received by the GATS Administrator. The signatory also makes several representations and certifications regarding its use of GATS. 2d. Schedule D 1 to the Terms of Use Declaration of Agency A Subscriber may name a third-party agent to access GATS on its behalf. If it wishes to do so, the Subscriber and each Subscriber Affiliate execute the Declaration of Agency for any thirdparty agent it desires to contract with to access GATS on its behalf. The Subscriber must also execute this Declaration of Agency for each entity for which it is acting as a Generator Broker and for each entity with which Subscriber has a legally enforceable agreement with respect to unit(s) owned or controlled by such entity which agreement entitles Subscriber to all (or some) Attributes associated with such unit(s). Schedule E 1 and Schedule E-2 to the Terms of Use Billing Information Form A Subscriber must complete Schedule E-1 (Subscriber Billing Information Form) and each Subscriber Affiliate must complete Schedule E-2 (Subscriber Affiliate Billing Information Form). The information contained in these forms will be used by PJM EIS to bill the Subscriber and the Subscriber Affiliate for its use of GATS. Bills for use of GATS will be ed to the contact provided in these forms. 3. On-line Application Form (See Appendix 1) The On-line Application Form requires the applicant to indicate which types of account it is applying for, to provide basic information, to name a contact person and provide contact information for this representative, and to set up the initial login information. The on-line form is available by visiting and clicking on the "Not a member? Register Here" link. Please see Appendix 1 for a screenshot of the Application Form. Click here. 5 4. New Account Activation Once an applicant completes the On-line Application Form, the applicant receives an from the GATS Administrator. By clicking on the link provided, the account will be activated and verified. Click on this link to activate and verify a new account. The account will have limited functionality until it is approved by the GATS Administrator. The account will not be approved unless the Terms of Use and all applicable Schedules have been received by the GATS Administrator. 5. New Account Approval The applicant receives an from the GATS Administrator once its account is approved. Approval should take no longer than one week. A new account is not approved unless the Terms of Use and all applicable Schedules have been received by the GATS Administrator. 6. Register your Generators with GATS If an applicant has no generating units, the registration process is complete at this point. If an applicant has generating units, the PJM administrator may require the applicant to obtain a State Certification Number from one of five state agencies (Delaware, Maryland, New Jersey, Pennsylvania and the District of Columbia).
