Sir, The undersigned is directed to state that National Pharmaceutical Pricing Authority (NPPA) has notified the ceiling prices of Orthopedic Knee Implant System vide Gazette Notification S.O. No (E)dated 16th August, 2017 under the provisions of the DPCO, Your attention is drawn towards note (j) of the order S.O. No (E)dated 16th August, 2017 which interalia states that:- 7n accordance with paragraph 24(4) of DPCO 2013, every distributor, dealer and institution shall display price list and the supplementary price list, if any, as furnished by the manufacturer/importer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same..' 2. Your attention is also drawn towards para 3 of the Office Memorandum No. 20(8)/20l3/Div.lll/NPPA/Part-3/Vol.lll, dated 25th August, 2017 (copy enclosed) which states that all hospitals/nursing homes/ clinics must display on 'home page' of their website, the MRP or Price of Knee Implant System at which they are charging/billing the patients, along with brand name, specifications and names of manufacturing/marketing company, within three working days from the issue of the said OM.

2 3.Perusal of the website of your hospital reveals that the MRP or Price of Knee Implant Systems at which the hospital is charging/billing the patients, along with brand name, specifications and names of manufacturing/marketing company do not appear at the home page of the hospital website till now. 4.The DPCO, 2013 has been issued by the Central Government in exercise of the powers conferred by Section 3 of the Essential Commodities Act, 1955 and any contravention of the provision of the DPCO, 2013 is punishable in accordance with the provisions of the Essential Commodities Act, Therefore, you are hereby directed to explain within seven days from the data of uploading of the Notice on the website the reason for not adhering the direction given in the notification no. SO 2668(E), dated 16th August, 2017 and subsequent OM dated 25/08/2017 in letter and spirit. 6. Kindly acknowledge the receipt. End: As above Copy to: Concerned State Drugs Controllers. Date; 25* August, 2017 The undersigned is directed to state that vide Gazette Notification SO 2668(E), dated National Pharmaceutical Pricing Authority (NPPA) has notified the ceiling prices of Orthopedic knee Implant system. 2.The ceiling price for various components of primary orthopedic knee implant system and revision knee replacement system has been specified in column no. 6 of the table under para 9 on page 3 of the above order. In this connection, attention is invited to para 9 Note (h) which interalia states thac- "The Ceiling prices mentioned in Table hereinabove are inclusive of aft components and consumables, which are used in the knee implant procedure and remain in the body of the patient"j In this regard, it is clarified that the price mentioned in the column no. 6 of the table is also inclusive of Bone Cement component of the knee replacement. It is also clarified that the price is inclusive of the cost of the instruments which are reusable and supplied free by the manufacturers to the distributors/hospitals. 3.As a logical extension of Para 24(4) of the DPCO, 2013, all manufacturers/importers/marketers of knee implant system and all hospitals/nursing homes/clinics/ must display on 'home page* of their website, the MRP or Price of Knee Implant System at which they are charging/billing the patients, along with brand name, specifications and names of manufacturing/marketing company.within three working days from the issue of this O.M. 4. All the manufactures/importers/ distributor/stockist of orthopedic knee implant system and hospitals/nursing homes/clinics are hereby directed to follow the order dated and subsequent OM issued in letter and spirit 5.
