1 INTRODUCTION The purpse f this dcument is t prvide an understanding f Internet Slutins' Acceptable Use Plicy. This plicy serves t define the accepted behaviur f users n Internet Slutins' (IS) netwrk. This allws IS t: - Maintain the integrity and quality f their services, - Prtect their custmers and infrastructure frm abuse, - Adhere t the current laws and regulatins gverning rganisatins and service prviders in the cuntries that they perate in, - C-exist within the glbal internet cmmunity as a respnsible service prvider. THE NETWORK 1. The user acknwledges that IS is unable t exercise cntrl ver the data passing ver the infrastructure and the Internet, including but nt limited t any websites, electrnic mail transmissins, news grups r ther material created r accessible ver its infrastructure. Therefre, IS is nt respnsible fr data transmitted ver its infrastructure. 2. IS' infrastructure may be used t link int ther netwrks wrldwide and the user agrees t cnfrm t the acceptable use plicies f these netwrks. 3. Users f the IS netwrk include nt nly the IS custmers, but in the case f resellers f the IS' services, the custmers f the resellers t. Resellers f IS' services are respnsible fr the activities f their custmers 4. The user may btain and dwnlad any materials marked as available fr dwnlad ff the Internet, but is nt permitted t use their Internet access t distribute any cpyrighted materials unless permissin fr such distributin is granted t the user by the wner f the materials 5. The user is prhibited frm btaining, disseminating r facilitating ver IS' netwrk any unlawful materials, including but nt limited t: - Cpying r dealing in intellectual prperty withut authrisatin, - Child prngraphy, and/r - Any unlawful hate-speech materials. 6. T help ensure that all custmers have fair and equal use f the service and t prtect the integrity f the netwrk, Internet Slutins reserves the right, and will take necessary steps, t prevent imprper r excessive usage theref. 7. The actin that Internet Slutins may take includes, but is nt limited t: 8. This plicy applies t and will be enfrced fr intended and unintended (e.g., viruses, wrms, malicius cde, r therwise unknwn causes) prhibited usage. 9. Online activity will be subject t the available bandwidth, data strage and ther limitatins f the service prvided, which Internet Slutins may, frm time t time, revise at its wn discretin and withut prir ntice t the custmer.

2 SYSTEM AND NETWORK SECURITY 1. All references t systems and netwrks under this sectin includes the Internet (and all thse systems and/r netwrks t which user is granted access thrugh IS) and includes but is nt limited t the infrastructure f IS itself. 2. The user may nt circumvent user authenticatin r security f any hst, device, netwrk, r accunt (referred t as "cracking" r "hacking"), nr interfere with service t any user, hst, device, r netwrk (referred t as "denial f service attacks"). The hst, device, netwrk r accunt shall als nt be used fr any illegal purpse, including phishing. 3. Vilatins f system r netwrk security by the user are prhibited, and may result in civil r criminal liability. IS will investigate incidents invlving such vilatins and will invlve and c-perate with law enfrcement fficials if a criminal vilatin is suspected. Examples f system r netwrk security vilatins include, withut limitatin, the fllwing: - Unauthrised access t r use f data, systems r netwrks, including any attempt t prbe, scan r test the vulnerability f any system r netwrk r t breach security r authenticatin measures withut the express authrisatin f IS. - Unauthrised mnitring f data r traffic n the netwrk r systems withut express authrisatin f IS. - Interference with service t any user, device, hst r netwrk including, withut limitatin, mail bmbing, flding, deliberate attempts t verlad a system and bradcast attacks. - Frging f any TCP-IP packet header (spfing) r any part f the header infrmatin in an r a newsgrup psting. USE 1. It is explicitly prhibited t send unslicited bulk mail messages ("junk mail" r "spam") f any kind (cmmercial advertising, plitical tracts, annuncements, etc.). This is strngly bjected t by mst Internet users and the repercussins against the ffending party and IS can ften result in disruptin f service t ther users cnnected t IS. In additin, spam is unlawful in terms f the Electrnic Cmmunicatins and Transactin Act 2002, and IS is entitled t take apprpriate steps against the User in cntraventin f these prvisins f the Act. 2. Maintaining f mailing lists by users f IS is accepted nly with the permissin and apprval f the list members, and at the members' sle discretin. Shuld mailing lists cntain invalid r undeliverable addresses r addresses f unwilling recipients thse addresses must be prmptly remved. 3. Users may nt frward r prpagate chain letters nr malicius Public relay ccurs when a mail server is accessed by a third party and utilised t deliver mails, withut the authrity r cnsent f the wner f the mail-server.

3 Users' mail servers must be secure against public relay as a prtectin t bth themselves and the Internet at large. Mail servers that are unsecured against public relay ften becme abused by unscrupulus peratrs fr spam delivery and upn detectin such delivery must be disallwed. 5. IS reserves the right t examine users' mail servers t cnfirm that their server is nt a public relay and the results f such checks can be made available t the user. IS als reserves the right t examine the mail servers f any users using IS mail servers fr "smarthsting", cntent filtering r similar services at any time t ensure that the servers are prperly secured against public relay. All relay checks will be dne in strict accrdance with IS' plicy f preserving custmer privacy. USENET NEWS 1. Users shuld, befre using the service, familiarise themselves with the cntents f the fllwing newsgrups: news.newusers.questins, news.annunce.newusers, news.answers. 2. Excessive crss-psting (i.e., psting the same article t a large numbers f newsgrups) is frbidden. 3. Psting f irrelevant (ff-tpic) material t newsgrups (als knwn as USENET spam) is frbidden. 4. Psting binaries t a nn-binary newsgrup is frbidden. 5. IS reserves the right t delete and/r cancel psts which vilate the abve cnditins. INTERCEPTION The User acknwledges that IS is lawfully required t intercept cmmunicatins in accrdance with the prvisins f the Regulatin f Interceptin and Prvisin f Cmmunicatin-related Infrmatin Act 70 f 2003 ("the Act"). Any interceptin f cmmunicatins shall be strictly in accrdance with the requirements f the Act, as and when required under the Act. Upn receipt f a cmplaint, r having becme aware f an incident, IS reserves the right t: - Infrm the user's netwrk administratr f the incident and require the netwrk administratr r netwrk wner t deal with the incident accrding t this AUP. - In the case f individual users suspend the user's accunt and withdraw the user's netwrk access privileges cmpletely. - Charge the ffending parties fr administrative csts as well as fr machine and human time lst due t the incident. - In severe cases suspend access f the user's entire netwrk until abuse can be prevented by apprpriate means. - Take such actin as may be necessary t prtect the integrity f the system, including, but nt being limited t, system mnitring, as well as prtcl management and shutting dwn f prts affected by viruses, wrms r ther malicius cde. - Implement apprpriate technical mechanisms in rder t prevent usage patterns that vilate this AUP. - Share infrmatin cncerning the incident with ther Internet access prviders, r publish the infrmatin, and/r make available the users' details t law enfrcement agencies. 2. Any ne r mre f the steps listed abve, insfar as they are deemed necessary by IS in its abslute and sle discretin, may be taken by IS against the ffending party. LAWS AND LEGISLATION 1. IS' infrastructure may be used nly fr lawful purpses. Users may nt vilate any applicable laws r regulatins f Suth Africa within the territry f Suth Africa. Shuld the user reside utside f Suth Africa, the laws f the cuntry in which the user resides shall apply. 2. Transmissin, distributin r strage f any material n r thrugh the infrastructure in vilatin f any applicable law r regulatin is prhibited. This includes, withut limitatin, material prtected by cpyright, trademark, trade secret r ther intellectual prperty right used withut prper authrisatin, and material that is bscene, defamatry, cnstitutes an illegal threat, r vilates exprt cntrl laws. 3. The User undertakes t use IS' services in accrdance with any restrictins impsed under the fllwing legislatin: - Electrnic Cmmunicatins and Transactins Act 25 f Electrnic Cmmunicatins Act 36 f Films and Publicatins Act 65 f 1996 (as amended) - Regulatin f Interceptin and Prvisin f Cmmunicatin-related Infrmatin Act 70 f 2003 LEGAL RIGHTS

Nthing cntained in this plicy shall be cnstrued t limit Internet Slutin's rights r remedies in any way with respect t any f the afrementined activities, and Internet Slutins reserves the right t take any actin that it may deem apprpriate with respect t such activities, including withut limitatin: - Investigating suspected vilatins f this AUP, - Taking actin t recver csts and expenses incurred in identifying and reslving abuse, - Terminating users' access t and use f the Internet Slutins service; - Levying cancellatin charges t cver Internet Slutins' csts in the event f terminatin f the Internet Slutins service. 2. In additin, Internet Slutins reserves all available rights and remedies with respect t such activities at law r in equity. 3. This AUP may be clarified r mdified peridically and Internet Slutins reserves the right t mdify this plicy at any time, any such changes cming int effect as sn as they are published n the Internet Slutins website( 4.
