The Programme will be produced by FremantleMedia Limited (trading as Talkback ) (the Producer, us we ). The Producer is the data controller. We will use the information you give us to decide whether or not to enter into a contract with you for your participation as a contestant on the Programme (the Contract ) and, if so, to perform that Contract. In particular, we will use the information you give us or which we generate about you (the Information ), in the following ways: 1. to assess your suitability to appear as a contestant on the Programme. As part of that process, to protect our legitimate business interests, we will also use information which is publicly available to check that you are who you say you are and that what you have told us about yourself is correct; 2. to contact you to progress your application; 3. if you are shortlisted as a potential contestant, to carry out further checks. At that stage, we will ask you: a. for proof of your (i) identity and (ii) right to live and work in the UK. We have a legitimate business interest in ensuring that you are who you say you are, and that you are able legally to participate in the Programme; b. about any health or medical conditions which might affect your ability to participate as a contestant. A medical professional will then determine whether you are fit to participate in the Programme, and advise on any adjustments as may be needed; c. to declare any unspent criminal convictions, and to verify that declaration by a criminal record check. We will use the Information at 3(b) and (c) to safeguard your welfare, as well as the welfare of other contestants, our staff and the audience. We will collect and use that additional Information only with your explicit consent, which you can withdraw at any time. We will also ask you about any reputational issues that you may have at this time. If you choose not to give us the Information asked for in this section (3), your application may fail; and 4. if you are selected as a contestant, to develop, produce, promote, transmit and otherwise exploit the Programme. The Producer will share your Information with the proposed broadcaster (ITV). We may also share your Information with our insurers, our regulators (such as OFCOM) and as required by law. To carry out background checks, it may be necessary to share your Information with data handling agencies, law enforcement and government agencies. We use a number of suppliers to help us produce the Programme. They are obliged under contract only to process your Information in line with our instructions, and will keep your Information secure. We will not share any of the Information with any third parties for marketing purposes, or store it outside the European Economic Area.

2 If your application is not successful this time, we will keep your Information for the period of six (6) months. If you indicate on the form that you would like us to contact you about the Programme if it goes to series or other Talkback programmes, we will keep your Information for a further 3 (three) years (though you can change your mind at any time). If your application is successful, we will keep your Information for 7 years from the date of delivery of the Programme to the Broadcaster, (except for the Contract, which we will need to keep for the duration of copyright in the Programme in order to exploit it).
