3 Outcome of February 9, 2018 PSC Meeting All proposers allowed opportunity to update Staffing Plan by February 16, 2018 Investigation by Third-Party Forensic Data Expert Continued Investigation by the Greater Orlando Aviation Authority Focus of Additional Investigation: Was there an existence, or at a minimum the appearance, of a conflict of interest and other irregularities stemming from PMA s role as GOAA s OAR and PMA s teaming with Jervis B. Webb on the BP-S STC BHS DBOM Procurement? 2

4 Staffing Plan Updates At the February 9, 2018 PSC Meeting, Jervis B. Webb stated they would be excluding PMA from their Staffing Plan PMA likewise indicated they would not object if they were excluded On February 16, 2018, Jervis B. Webb submitted a Revised Staffing Plan that did not include PMA Neither Glidepath nor Vanderlande submitted an updated Staffing Plan 3

5 Main Considerations for Supplemental Investigation To provide a comprehensive review given the two-week timeframe that minimizes delay to the South Terminal C project, since BHS is on the critical path To address the privacy and public records concerns associated with the review methods of different devices and content 4

6 Revised Protocol GOAA, with the cooperation of PMA and Jervis B. Webb, created a protocol to guide the investigation by the forensic data consultant (Data Analyzers LLC) and GOAA Provides a realistic scope for a forensic data investigation in the allotted timeframe Requires PMA to supplement the forensic data investigation with s from PMA server between PMA and Jervis B. Webb, and s between Noel Alvarez and Martin Ineichen Requires PMA and Jervis B. Webb to retain a third-party consultant to preserve forensic copies of the cell phones possibly used in connection with this procurement 5

Webb. 11 computers or laptops belonging to: Sales Department: Todd Alderman, Joe Emery, Ken Hamel, Colin Oatley, Alex Wuchute Estimating: Alan Daavettila, Dave Daavettila, Paul Lalinsky, Brian Hoppe Project Management: Andrew Grusnick PMA: 4 laptops used by: Martin Ineichen, Noel Alvarez, Richard Johnson, Robert Sanders* GOAA: 2 computers used by: Martin Ineichen, Noel Alvarez * The laptop used by Robert Sanders required a specialty SSD adapter and could not be unencrypted within the investigation timeframe 6

8 Notable Findings As Related to All Computers: No evidence in the metadata and system artifacts suggest that Jervis B. Webb had in its possession any of the Technical and Design Proposals previewed or downloaded by Mr. Martin Ineichen The Technical and Design Proposals previewed and downloaded by Mr. Ineichen were not found on any computer system examined by Data Analyzers 7

9 Notable Findings As Related to Mr. Ineichen s GOAA Computer (The computer on which the proposal documents were viewed): The computer did not contain a copy of the Technical and Design Proposals Mr. Ineichen previewed or downloaded There was no USB storage device connected to the computer at the time of the incident The metadata timeline shows that after accessing the Technical and Design Proposals on box.com, Mr. Ineichen accessed PMA s web-based outlook service* * Mr. Ineichen s PMA s provided by PMA did not contain a copy of the Technical and Design Proposals 8

10 Notable Findings As Related to Mr. Ineichen s PMA Computer: The metadata and system artifacts on Mr. Martin Ineichen s PMA laptop were altered, which Data Analyzers considers digital forensic evidence of tampering 9

19 Options for Proceeding Accept Jervis B. Webb s Revised Staffing Plan and continue procurement with all three proposers Disqualify Jervis B. Webb Postpone STC BHS procurement pending further investigation of Jervis B. Webb Cancel the STC BHS procurement and initiate a new, perhaps different procurement methodology Other options and considerations may be presented by the Shortlisted Proposers 18
