Building Trust in Government; Civic Engagement in Policy Development ACP EU Cooperation The establishment of EU-funded Non-State- Actors (NSA) Advisory Panels and capacity building programmes in the Eastern Caribbean. By Spiros Polycandriotis Spiros Polycandriotis Head of Social Development Section EC Delegation in Barbados & the Eastern Caribbean Rationale and legal basis Initiative launched in early 2005, out of the post-mid Term Review realisation that appropriate mechanisms to ensure involvement of civil society in the EDFfinanced part of partnership with Eastern Caribbean countries were not present. Legal basis: Article 4 The Actors of the Partnership of the Cotonou Partnership Agreement, signed on 23 June Past civil society involvement Since early 1990s, STABEX resources have provided assistance to farmers dependent upon the Windward Islands banana industry. STABEX funds have been used for complementary interventions: diversification of rural sector and broader (private sector led) economic diversification, to provide potential alternative employment opportunities. These interventions have been underpinned with establishment of social safety nets, including Social Investment Funds, and NGO activities which complement initiatives taken by Governments and their agencies. An EU instrument introduced in 1999, the Special Framework for Assistance (SFA), also related to the banana sector, provides complementary resources for this development agenda. The programmes and projects in Dominica, Grenada, St. Lucia and St. Vincent & the Grenadines, from their design stage and throughout their implementation have involved the active participation of farmers' organisations, chambers of commerce, representatives of particular sectors, NGOs and the local communities in general.
2 Background - NSA initiative May ToRs finalised for launching independent consultancy to assist: in the mapping of the NSA sector in the 7 Eastern Caribbean countries the establishment of the Advisory Panels the provision of pilot capacity building programmes to NSAs in the countries that have expressed interest (DOM and SVG) July to December consultants produced report that included: country NSA maps two draft Financing Proposals for the provision of capacity building programmes to NSAs in DOM and SVG Structure and functions of the NSA Advisory Panels Non-partisan bodies comprising between 8-13 organisations broadly representative of the full civil society spectrum, i.e. community based organisations, agriculture, business, gender, etc. Their main role is to channel civil society s input into the EU-Eastern Caribbean development partnership, including political and policy dialogue, programming and implementation of projects/programmes. To ensure that these bodies will not become another talking shop, provisions have been inserted in the MoU committing the Delegation and the Governments to, at least once a year, come before the Panels to discuss the consideration given to the Panels comments/suggestions. Modest financial allocations have also been envisaged to cover the running costs of the Panels, in some cases bridge-funding until FAs are approved. Existence of provisions aimed at ensuring a measure of rotation in the membership of the Panels and regarding dissemination of the Panel s work in the broad NSA community. Current state-of-play A&B, BAR, DOM, SLU The Non-State Actors (NSA) Advisory Panels were successfully launched on: A&B: 14 June 2006 BAR: 13 November 2006 DOM: 1 June 2006 SLU: 31 May 2006
3 The NAOs, Delegation and all NSA members of the Panels formally approved the Memoranda of Understanding establishing the Panels and the Operating Guidelines governing their work. A modest financial allocation was established to cover the running costs of the Panels, in the form of Programme Estimates. There are also provisions aimed at ensuring a measure of rotation in the membership of the Panels and regarding dissemination of the Panels work in the broad NSA community. In DOM, a 9th EDF Financial Agreement for institutional strengthening of NSAs ( 300,000) - including networking and fund-raising skills - was approved in early The Delegation and the NAO offices decided to seize the opportunity offered by the launching of the NSA Advisory Panels to discuss 10th EDF programming matters with civil society. The NAOs have agreed to earmark some non-focal sector funding for institutional strengthening of NSAs, including networking and fund-raising skills, under their 10th EDF NIP. Current state-of-play GRENADA Hurricane Ivan: no separate NSA Advisory Panel was to be created. Meeting with Forum for Social Dialogue : 12 June 2006 to discuss 10th EDF programming. Several of NSAs claimed that Forum not appropriate mechanism for regular dialogue with civil society, because its specific purpose was to mediate with Government for the reconstruction levy. Those organisations pointed in using the Multipartite Committee as best alternative. However, the NAO Office indicated that the Committee was not functional since some time. Since June 2006, no discussion has taken place between the NAO office, the Delegation and civil society regarding 10th EDF programming. The NAO has not yet agreed to earmark non-focal sector funding for institutional strengthening of NSAs under 10th EDF NIP. Nevertheless, the Delegation is still closely liaising with NAO Office, with the aim of identifying or establishing a workable mechanism to structure dialogue with NSAs. ST. KITTS & NEVIS In May 2006, the GoSCN decided that it did not wish to establish an NSA Advisory Panel. The NAO proposed to use instead the Economic and Social Partners Forum. During 2006, no further discussions took place between the NAO office, the Delegation and civil society regarding 10th EDF programming or other matters. Up to date, the NAO has not agreed to earmark non-focal sector funding for institutional strengthening of NSAs under their 10th EDF NIP. The Delegation has been in close contact with the NAO Office with the aim of revitalising the establishment of a workable mechanism, in order to structure dialogue with NSAs. It is hoped that a draft MoU and OGs will be finalised and signed by NAO, DEL and NSAs in the coming month.
4 ST. VINCENT & GRENADINES GoSVG decided to establish an NSA Task Force within the country s existing National Economic and Social Development Council (NESDC), an advisory body which included most of the organisations recommended by the mapping study for Panel membership. The SVG NSA Task Force was successfully launched on 9 June GoSVG, Delegation and all NSA members of the Task Force formally approved the MoU establishing the Panel and the OG s governing its work. There are also provisions aimed at ensuring a measure of rotation in the membership of the Panel and regarding dissemination of the Panel s work in the broad SVG NSA community. The Delegation and NAO office decided to seize the opportunity offered by the launching of the NSA Task Force in June 2006, to discuss 10th EDF programming matters with civil society. The NAO agreed to use 9th EDF nonfocal sector funding for institutional strengthening of NSAs ( 500,000), including networking and fund-raising skills, and potentially additional funds may also be earmarked under their 10th EDF NIP. Lessons learnt Challenging yet exciting common initiative that should help us articulate civil society s involvement in our partnership (including information dissemination about the EU and funding opportunities for NSAs), in a well structured manner. Launching of Panels during 10th EDF Programming exercise was most timely, as NSAs will increasingly have an opportunity to have a say in the process and hopefully will ensure that funds are devoted to working with and strengthening often institutionally/financially weak civil society organisations. As this experience unfolds, the Barbados Delegation is sharing lessons learnt with other Delegations and other regions, colleagues at Commission Headquarters, as well as with colleagues from other regional bodies and International Organisations. It is Extremely important that UNDP has been involved in the process from early stages. CARICAD could also be involved actively in future. There is a measure of scepticism and concern among some NSAs that Panels could degenerate into talking shops and great eagerness on the other hand, to focus on fund-raising matters. The limits of the exercise are clear: it could help with fund raising, but the Panels are not a fund raising mechanism. DEL and NAOs have committed to discuss substance and inform NSAs once a year on the
5 consideration given to their suggestions. The issue of running costs is also key to the sustainability of these bodies; in that regard Programme Estimates from 9th EDF Technical Cooperation Facilities have been established to cover the Panels running expenses. Measurement of results and follow-up actions Launching the Advisory Panels has been just a first step. A great deal of nurturing, particularly from NAO Offices, that unlike the Delegation, are physically present in the countries will be needed for these Panels to become dynamic and self-sustaining mechanisms. The EC Delegation will continue to liaise closely with NAO Offices and Panel members in these first critical months. Governments and NSAs are seriously committed in general, although that varies from country to country and from organisation to organisation.
