1 Terms of Reference (ToR) for ICAT support to MRV in the Energy Sector in Kenya The Agreement sets forth the terms and conditions of the cooperation between the Consultant and UNEP DTU Partnership for achieving the Project objectives, as set out in the Project ToR (this document). A. Justification and Background Since the launch of Vision 2030, which states the long-term development plan to transform Kenya to a middle-income country by 2030, there has been an increasing acknowledgement that the impacts of climate change is one of the greatest threats to achieve its development goals. Kenya s response to climate change and its contribution to the global mitigation goal of limiting global warming to below C is communicated to the UNFCCC in its Nationally Determined Contribution (NDC) The Kenya NDC mitigation target seeks to abate GHG emissions by 30% by 2030 relative to the BAU scenario of 143 MtCO2eq. To implement the NDC the Government of Kenya (GoK) plans to build on the National Climate Change Response Strategy (2010), the National Climate Change Action Plan (NCCAP) currently being updated for the period , the National Adaptation Plan (NAP) and the Climate Change Act (2016). The implementation of climate change action plans, strategies and policies is a requirement of the Climate Change Act, which establish a legal framework to function as the operational mechanism for NDC implementation in line with the Vision Kenya aspires to mainstream climate change mitigation and adaptation actions into development plans in all sectors and at all levels of government including sub-national levels through Medium Term Plans (MTP) in line with the Vision 2030 and the sustainable development Agenda Institutional reforms established in the Climate Change Act are of special importance to enhance the coordination of climate change actions for NDC implementation. The Act mandates the Ministry of Environment and Natural Resources (MENR) though Climate Change Directorate (CCD) to coordinate all climate change actions including establishment of a Climate Change Registry and NDC implementation as well as measurement, reporting and verification (MRV) of climate policies and actions. Furthermore, the Act establishes a National Climate Change Council chaired by the President and a Kenya Climate Change Fund as enablers to climate change actions. On this background the Initiative for Climate Action Transparency (ICAT) seeks to support Kenya s efforts to establish a domestic MRV system for tracking of progress with NDC implementation in the energy and transport sectors. B. Project Objective ICAT s overall objective is to support the implementation of domestic MRV efforts and goals through country-specific capacity building programs with national stakeholders, training on MRV concepts, methods and tools, including iterative testing and application of ICAT Guidance, continued observation of future UNFCCC transparency requirements and development of a road map to sustain ICAT outcomes. ICAT Kenya objectives have been identified by the Government of Kenya during the scoping mission in February with Climate Change Directorate and other key stakeholders as follows: 1 An Initial Scoping Mission to Kenya was held 6-10 February 2017 to introduce the project to stakeholders and get their feedback on priorities and needs, understand institutional arrangements for climate change including a status of the MRV system, meet with key governmental institutions involved in the MRV of NDC policies and actions, meet with key international partners and with civil society organizations (CSO) working in the space of climate change mitigation and MRV. 1

2 Objective 1: Needs and gap assessment for MRV of the energy and transport sectors Objective 2: Strengthen institutional arrangements for MRV in the energy sector Objective 3: Develop capacity for data management to track NDC implementation in the energy sectors based on ICAT Guidance Objective 4: Develop a road map to ensure the sustainability of ICAT outcomes C. Internal Country Coordination For coordination of all ICAT activities, the main institutional partner is the Climate Change Directorate (CCD), Ministry of Environment and Natural Resources (MENR) constituting the ICAT focal point. The CCD will coordinate the work and deliverables of ICAT support to be implemented by national experts supported and contracted by UNEP DTU Partnership. National experts will be identified through a public call for experts in Kenya informed by the needs and gaps assessment (Objective 1) and the terms of reference (ToR) approved by the CCD following UDP procurement procedures for contracting. UDP will review all written deliverables to provide technical support and training needed in the process. These includes: 1) all reports to be drafted by national experts, 2) feedback, comments and suggestions by CCD and UDP to be addressed by national experts and 3) CCD and UDP to approve of final versions of all deliverables. UDP s role is to provide technical assistance, capacity building and training as needed and to ensure coherence with the ICAT program. D. Coordination: Country and ICAT In the context of various MRV activities ongoing or planned in Kenya in the period , ICAT will seek to coordinate with all and partner with the ones, where synergies can be achieved. For an overview of planned and ongoing MRV initiatives see Figure 1. 2

3 Figure 1: Overview of MRV support initiatives in Kenya Coordination of NDC and MRV support initiatives is taking place in the NDC Cluster through bi-monthly, long-distance meetings (webinars, Skype, GoToMeeting etc.) among all donors lead by United Nations Development Programme (UNDP). ICAT engagement considerations are to build upon existing methods and approaches, flexibility in applying ICAT's 'toolbox approach' to adapt it to country needs and advance national MRV plans, and a high interest in partnerships to coordinate parallel MRV work, or sequence with others, for higher probability of implementation. Synergies have been identified with three support initiatives; 1) the Capacity Building Initiative for Transparency (CBIT) supporting the strengthening of national capacity in Kenya to meet the transparency requirements of the Paris Agreement including the coordination between national, regional and global transparency related activities in Kenya; 2) the Ambition to Action project in the energy sector and 3) the TraCS project in the transport sector. The energy and transport sectors have been identified for development of capacity to track NDC implementation through piloting of ICAT Guidance on transformational change, greenhouse gas emission reductions, stakeholder involvement and technical review. The Ministry of Energy supported by the Ambition to Action project will lead piloting of the ICAT Transformational Change Guidance and stakeholder participation and technical review guidance applied to a Flagship Initiative. The Ministry of Transport supported by the TraCS project will lead the application of the ICAT Transport Guidance, stakeholder participation and technical review guidance applied to a selected policy or action. 3

4 E. Expected Outcomes The work plan and timeline to achieve Kenya ICAT objectives is included in Annex A. Expected outcomes of the work plan are the following deliverables: Deliverable #1: Report providing recommendations on how best to remove the most significant visible barriers documented in activity 1.1 incl. draft ToRs Deliverable #2.1: Report with recommendations for a stepwise approach to develop and implement an MRV system for NDC implementation in the energy sector involving relevant stakeholders at the right level of decision making Deliverable #3.2: Report with proposed national guidelines and procedures for greenhouse gas and sustainable development data management in the energy sector including reporting formats building on ICAT Guidance Deliverable #4: Final report and participation in national workshop F.
