Introduction: The ISV/TP named herein ( you ) is authorised to distribute, on a Restricted License basis, IBM Software purchased from the Distributor identified in this Enrolment Form. Customer: This term means an end user authorised to use your ISV/TP Solution for its intended use, and not for remarketing, but not including you or any of your affiliated companies or other entities. Support Services: For certain IBM software products, the Distributor provides you with subscription and support services (updates and maintenance) in accordance with the agreement between you and the Distributor. For other IBM software products IBM will provide subscription and support direct to you, provided that you have purchased Subscription and Support entitlement from your Distributor. Your distributor will confirm which products fit into which category. Agreement Structure: Your right to distribute IBM Software is subject to you supplying accurate information in this Enrolment Form and your acceptance of the IBM Software ISV/TP Terms and Conditions. In addition, if IBM is providing support services to you, then you agree to the terms and conditions of the IBM Software Support Services Attachment. IBM reserves the right to amend the terms of the Enrolment Form, the IBM Software ISV/TP Terms and Conditions and the IBM Software Support Services Attachment at any time upon giving not less than thirty (30) days prior written notice. Governing Law: This agreement shall be governed by the laws of....
