1 BEFORE THE PUBLIC UTILITY COMMISSION OF OREGON UM 1587 IN THE MATTER OF ) ) Northwest and Intermountain PUBLIC UTILITY COMMISSION OF ) Power Producers Coalition OREGON ) ) Investigation of Issues Relating to Direct ) Access ) The Northwest and Intermountain Public Power Producers Coalition (NIPPC) supports the Commission s investigation into direct access and appreciates the opportunity to comment on issues for consideration in the docket. NIPPC members own and operate approximately 4500 megawatts of operating power plants fueled with both fossil and renewable resources. Independent power producers (IPPs) have successfully completed the permitting of approximately twice as much capacity. Currently, the market opportunities for IPPs are effectively constrained by the monopsony power exercised by utilities. Enabling customers to purchase power from the wholesale market is an opportunity of great interest to IPPs active in the Northwest. NIPPC appreciates the Commission s May 03, 2012 amended ruling issued to focus this docket. There is no need to over-analyze or complicate the proceeding. Focused, timely analysis leading to clear-eyed decision making by the Commission is all that is needed for the Commission to find merits in creating a truly robust competitive market for Oregon s large electric consumers.

2 I. Issues List A. Certification Process While Oregon s direct access rules 1 have been in place for nearly ten years, there is currently only one active electricity service supplier serving Oregon direct access customers. The direct access certification process for electricity service suppliers is too burdensome and is hindering the direct access market. 2 Without greater participation by suppliers a competitive and efficient direct access market cannot be realized. If there is to be an increase in supplier participation, the certification requirement should be eliminated or dramatically simplified. B. Puget Sound Energy Approach NIPPC supports an investigation by parties into the Puget Sound Energy approach (Schedule 449). The Puget approach offers a solution to disincentives currently present in the direct access program by including a one-time transition charge and not requiring the Commission to certify energy suppliers. However, the Puget model is restrictive in that it was a one-time opt-out offering with no subsequent enrollment windows. In this respect, the Puget approach is only available to a limited class of customers, foreclosing the option for others who might later wish to access the wholesale market. Should greater participation be found to be desirable, the Puget approach should be referenced as a model rather than be replicated. 1 See generally ORS ; OAS OAS

3 C. Impact on Other Customer Classes The implementation of a direct access program should be analyzed with respect to impacts on other, non-participating customer classes. Since a robust direct access program could, if poorly designed, impose additional costs on nonparticipants, a clear understanding and documentation of potential impacts on all customer classes should be modeled and considered in this docket. In addition, such an assessment need include an examination of reduced expenditures in the cost of utility service. After all, the departure of load will, all other things held constant, reduce the need for utilityowned generation capacity that all three investor-owned utilities have identified in their current Integrated Resource Plans.
