1 GAME RULES "Nespresso Recycling" Sweepstakes (hereinafter referred to as: the "Sweepstakes") Rules of Participation and Data Processing Policy Duration of the Sweepstakes: : :00 or until stocks of the Special Edition coffee selection defined as a precondition to participate are exhausted. The organizer of the game is Nestlé Hungária Kft. (1095 Budapest, Lechner Ödön fasor 7.; hereinafter referred to as: the "Organizer") 1. In order to participate in the Sweepstakes the Contestant must purchase or order at least 1 "Special Edition selection" at one of the Nespresso Boutiques (Andrássy út, Allee, Arena Mall, Árkád Győr) or Mini Boutiques (Mom Park, Mammut, Árkád Budapest, Westend City Center, Árkád Pécs), the website or mobile application or via the phone number during the duration of this promotion. By shopping the Contestant accepts all terms and conditions set forth in these Game Rules and consents to the Organizer managing his personal data for the purposes of this Sweepstakes in compliance with the contents of these Game Rules (hereinafter jointly referred to as: the "Entry"). All orders placed and purchases made prior to the start or subsequent to the closing of the promotion do not entitle one to participate in the promotion. Only purchases effected by the Contestant via the above channels as a Club member using his Nespresso Club registration are deemed valid. Purchases made at Nespresso Boutiques do not entitle someone to participate in the promotion if the purchase was not done using one's Nespresso Club membership. Promotional stocks are not equal in size. 2. Only private individuals* outside the scope defined under point 3.*, who are not incapacitated*, permanently reside in Hungary*, have an address registered by Nespresso*, are Nespresso Club members and are minimum 18 years old*, are Hungarian citizens having full legal capacity* (hereinafter: Contestants) shall be allowed to participate in the sweepstakes, if they also fulfill the conditions set forth in section The individuals belonging to any of the following categories shall not be allowed to participate in the sweepstakes: employees*, contractors* of Nestlé Hungária Kft.*, and of Cereal Partners Hungária Kft.* including close relatives* of these as defined under point 1), section (1), 8:1. of the Civil Code ; persons* and companies* participating in the organization and implementation of the Sweepstakes under contract with Nestlé Hungária Kft. 4. The Organizer may exclude a Contestant from the Sweepstakes if he is not entitled to receive the prize because he entered false or incorrect personal data upon registering with Nespresso Club or when giving his address or the Contestant does not meet the personal and other pre-conditions set forth in these Game Rules (and marked with an *). The Organizer shall not be liable for any incorrect data submitted by the Contestant. Contestants shall at all times warrant the validity of all personal data submitted. 5. In case of suspected fraud the Organizer has the right to override the Sweepstakes procedures and even exclude Contestants, if appropriate. The Organizer shall automatically exclude all Contestants participating with incorrect data. 1

2 6. The Organizer shall only consider Entries containing orders that Contestants have submitted through their own registered Nespresso Club membership. If the Contestant uses a Nespresso Club membership not registered by himself, the Organizer shall not be held liable in any disputes regarding the Contestant's authorization to use that Club membership for the purposes of this 7. Participation in the Sweepstakes means that the Contestant accepts that the Sweepstakes' technical infrastructure in terms of content, performance, messaging, data communication and response speed is contingent upon the servicing technology and thus factors outside the Organizer's control may have an adverse effect on the aforementioned, for example (but not limited to) connection errors, server hardware performance, network overload, network bottlenecks, reception problems, as well as maintaining a secure network connection. The Organizer excludes its liability for all events arising from the contents of this section. In order to avoid later disputes, the Organizer hereby stipulates that the recording of the order in the Nespresso system shall be authoritative in terms of ascertaining the exact time of a purchase. The Organizer is entitled to exclude Entries from the Sweepstake, where the Contestant canceled his order until the Drawing as per section of Conditions of Sales available at page. If the Contestant exercises his right of withdrawal after the draw, contestant will not be entitled to collect the prize if the contestant won the prize. 8. All guides, regulations and conditions published in advertisements or information materials related to the Sweepstakes shall constitute an inseparable part of these Game Rules subject to the limitation that in case of any contradiction or conflict between them, the provisions of these Game Rules shall prevail over all other guides, regulations and conditions. 9. In order to ensure compliance with the Game Rules the Organizer may audit the Entries. If an Entry or the Contestant submitting it does not fully comply with the conditions set forth in the Game Rules for any reason whatsoever, the Contestant may be excluded from the 10. The Organizer may elect to exclude from the Sweepstakes Contestants who attempt to participate in a manner that goes against the spirit of the game, such as playing in team under the name of one private person or with a mass generated Nespresso Club membership or Nespresso Club memberships registered under the name of unreal persons with the objective of increasing their chances to win. Persons cooperating to participate in raffles and other sweepstakes, who coordinate efforts in order to win a prize and present the activities of several persons under the identity of a single one and thereby reduce the chances of decently participating Contestants, shall be deemed as such persons. In addition, persons participating in the Sweepstakes with false data in order to indecently increase their chances of winning shall also be considered as such persons. Contestants resorting to dishonest practices defined in this section shall be held liable to reimburse all damages caused to the Organizer with respect to the 2

The Organizer shall attempt to deliver the prizes twice within 60 calendar days from the date of the draw. The Winner is obliged to co-operate in order for delivery to be effected by the above deadline in compliance with the contents of the effective General Terms and Conditions of the Hungarian Postal Services and Act No. CLIX of 3

4 2012 on postal services. The Organizer can only ensure delivery of the prizes under such conditions. The Organizer excludes all liabilities if the winning Contestant fails to comply with the co-operation requirement set forth above and delivery of the prize is therefor unsuccessful. The Organizer cannot ensure another opportunity for prize collection. 13. The prize can also be delivered to a proxy. Any person with full legal capacity who can prove his right of representation and receipt of the prize with a formal power of attorney providing full evidence, signed by both the principal and the authorized representative may take delivery of the prize. The requisite formalities of a power of attorney are the family name, mother's maiden name, place and date of birth, address and personal ID number of the participants. 14. The Organizer shall exclude all Entries for which the prize cannot be delivered due to false, incomplete or incorrect information given in the Nespresso Club membership or the confirmation of Notification, or if the Contestant submitting the Entry fails to comply in any way with the personal conditions set forth in the Game Rules. The Organizer shall not be liable for any damages resulting from incorrect data submitted by the Contestant. 15. Contestants will be identified on the basis of their data given upon Nespresso Club registration as contact address and their Nespresso Club membership number. The Organizer excludes all liability for technical problems arising from any possible changes in data not attributable to the Organizer (especially but not exclusively changes in data, deletion of Nespresso Club membership etc.). 16. The Organizer excludes all liability for situations where participation in the Sweepstakes is delayed or unsuccessful due to system overload, broken internet connection or any other technical difficulties or hindrances not attributable to the Organizer. 17. The Organizer reserves the right to change these Game Rules and the Sweepstakes mechanism or prizes. The Organizer excludes all liability for all possible printing errors in any communications materials related to the 18. The Sweepstakes Organizer shall fulfill all legal obligations related to declaration of the prize and taxation (declaration, payment), but other potentially arising expenses shall be borne by the Contestant. Postal service expenses related to the delivery of the prizes shall be borne by the Organizer. 20. The Organizer shall publish the list of winners on Nespresso's Facebook page ( within 2 days from receiving the winners' confirmations. The name and the address (only town) of the winners shall be published. 21. By entering the Sweepstakes the Contestant shall: 4

5 - unconditionally and expressly consent to the Organizer processing their names, addresses, phone numbers, their Entries uploaded and their personal data (i.e. Hungarian delivery address) required for communicating the winners list and for delivering the prizes and using them for the purposes of managing the Sweepstakes in compliance with the provisions of Act CXII. of 2011 about informational self-determination and the freedom of information; - acknowledge that the Organizer shall not handle and process their data for any purpose other than that defined hereunder. 22. By participating in the Sweepstakes the Contestant accepts the above rules for participation and privacy. 23.The Organizer warrants that all aspects of data processing shall be executed in full compliance with effective legal norms. The Organizer ensures that the Contestant shall be able to request information on the management of his personal information at any time or request to have his data deleted, blocked or corrected at the below addresses: Nestlé Hungária Kft. With regard to the management of his personal data the Contestant may request the following from the data processor: a) information regarding the management (processing) of his data, b) correction of his personal data and c) deletion (blocking) of his personal data. The Contestant may approach the data processor with his requests and statements regarding data management and data processing via the aforementioned channels. Upon the Contestant's request, the data processor shall provide information about his data, their source, the purpose of data processing, its legal grounds, duration, name and address of the data processor and his activities related to data management, the circumstances and impact of and measures to avert a possible data protection incident. The data manager shall give a written response to any such request within 30 days from receipt. Furthermore, the Contestant is entitled to object to the processing of his personal data. If the Contestant's objection means that he does not agree with the data processor's decision, he may turn to the National Authority for Data Protection or the court with jurisdiction at the data processor's registered seat or the Contestant's place of residence. If the Contestant requests the deletion of his personal data while the Sweepstakes is still running, he also accepts the loss of all rights regarding the Sweepstakes and shall be excluded therefrom. 5

The Organizer reserves the right to change the rules applicable to participation and data processing. In case of any suspicion of an abuse of the rules, or unfair play, which could result in cheating, the Organizer shall reserve the right to suspend or terminate the 28. The Organizer excludes all liabilities for failure or delay to deliver prizes arising from incomplete/incorrect data given in the confirmation of a winning Notification or a Nespresso Club registration (i.e. misspelling of a name or address, disclosure of incorrect or false data etc.) or due to reasons not attributable to the Organizer. 29. The Organizer reserves the right to immediately exclude any Contestant from the Sweepstakes if the former becomes aware of any suspicion of (computer) manipulation by a Contestant, for example a team or mass generated Nespresso Club membership is participating under the name of one private person or participation with the Nespresso Club membership of an unreal person with the aim of increasing their chances to win via misleading actions.
