Shanahan, City Manager Ric Goss, Planning Director Date: August 2, 2017 Subject: Registration of Fibernet Direct Florida LLC Commission Goal: Technology - Cell tower connectivity Introduction This is notification of staff's intent to approve a registration application filed by Fibernet Direct Florida, LLC ( Fibernet Direct ) to access the public rights-of-way for the provision of telecommunication services, which is required before they can file for a permit to enter the right-of-way. Background Fibernet Direct Florida, LLC, provides end-to-end bandwidth infrastructure services specializing in fiber-optic network solutions. It offers Ethernet services; dedicated Internet access services; wavelength services that connect enterprises and data centers to support mission-critical applications; cloud connectivity and predictable performance to cloud-based applications; private fiber networks services; managed services that include managed router and managed security; data center colocation services; and SONET or SDH signals transportation and/or multiplexing. The company also provides wireless colocation and infrastructure services that include FPL communication towers, FPL service centers, FPL transmission structures, and rooftops. Fibernet Direct serves public and private organizations of all sizes, including national telecom and wireless carriers, data centers, healthcare providers, financial institutions, media and entertainment companies, schools, and a range of professional service firms; and local, city, and state governments. The company serves major metropolitan markets throughout Florida and Texas with connectivity across the United States. The company was formerly known as FPL FiberNet, LLC, and changed its name to Fibernet Direct Florida, LLC, in January, 2017. Fibernet Direct was founded in 2000 and is headquartered in Miami, Florida. Fibernet Direct is a consolidated subsidiary of Crown Castle International Corporation, which received registration approval in 2016. Discussion Page 1 of 3 Packet Pg. 106
8.I Fibernet Direct is applying for the right to construct, operate, manage, and maintain a telecommunication network in the public rights-of-way of the city in compliance with Chapter 8.1 of the City Code of Ordinances in order to serve its wireless customers and to improve capacity. To that end, Fibernet Direct is requesting authorization for the right to enter into the public way to provide telecommunication services. Section 8.1-4 requires the telecommunication service provider desiring to use the public rights-of-way to register and provide the following information: 1) Identity of the applicant and name, address and telephone number of applicant's primary contact person in connection with the registration; 2) General description of the various system(s) using the rights-of-way to prevent interference between the system(s) as well as a statement of whether the applicant is or expects to be a local service provider and/or a toll service provider; 3) Evidence of insurance coverage required under this chapter and acknowledgment that registrant has received and reviewed a copy of this chapter, which acknowledgment shall not be deemed an agreement; 4) A copy of federal and/or state certification authorizing the applicant to provide telecommunications services; 5) Annual bond or corporate guarantee in the minimum sum of one hundred thousand dollars ($100,000.00) having as a surety a company qualified to do business in the state, in accordance with section 8.1-15 of this chapter. Fibernet Direct has complied with Section 8.1-4 and the company is entitled to be registered to file engineering permits to construct small cell wireless facilities within the public rights-of-way. Budget Impact There is no budget impact. Citizen Impact The use of existing or new poles within the rights-of-way will bring service to business locations and residential neighborhoods where wireless service coverage or capacity is negatively affected by network congestion due to the use of smartphones, I-pads, and home computers for streaming videos and surfing the web. This advantage of improving coverage and capacity will come at the cost of additional poles should existing poles and street light poles be found not to be suitable for deployment of wireless service.
