BY-LAW 2012- A by-law to appoint Municipal Law Enforcement Officers WHEREAS section 15 of the Police Services Act, R.S.O. 1990, c. P.15, as amended, (the Police Act ) authorizes municipal councils to appoint persons to enforce the by-laws of the municipality; AND WHEREAS subsection 1(3) of the Provincial Offences Act, R.S.O. 1990, c. P.33, as amended, provides for the designation by a Minister of the Crown of any person or class of persons as a Provincial Offences Officer for the purpose of all or any class of offences; AND WHEREAS, by Orders dated July 30, 1984 and August 21, 1987, the Solicitor General has designated all employees of municipalities whose duties include the enforcement of municipal by-laws and persons appointed as Municipal Law Enforcement Officers under the Police Act as Provincial Offences Officers; AND WHEREAS Bill 212, Good Government Act, R.S.O. 2009, c. 33, defines provincial offences officer as, a by-law enforcement officer of any municipality or of any local board of any municipality, while in the discharge of his or her duties. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE CITY OF MARKHAM HEREBY ENACTS AS FOLLOWS: 1. Employees in the following Departments whose duties may include the administration, review or enforcement of By-laws enacted by the City, applicable Provincial Acts and Regulations, or other applicable laws either administered or enforced by the City are hereby appointed as Municipal Law Enforcement Officers: a) Legislative Services; b) Building Standards; c) Engineering; d) Environmental Services; e) Fire & Emergency Services; f) Planning & Urban Design; g) Operations; and, h) Right of Way Assets
2. Those persons who are employed by the Ontario Society for the Prevention of Cruelty to enforce the Animal Control By-law within the City of Markham are appointed Municipal Law Enforcement Officers for the purpose of enforcing the Animal Control By-law 2005-254, as amended 3. Those persons who are employed by the companies and corresponding locations noted in the attached Schedule A are appointed Municipal Law Enforcement Officers for the purpose of enforcing the Parking Control By-law 2005-188, as amended. 4.
