Part C: Specific Terms and Conditions for Celcom First One Plan for Mobile Devices This Part C of the Terms and Conditions shall only be applicable to you if you subscribe to the Celcom First Data for Mobile Device and shall be read together with Part A: General Terms and Conditions which is made available at www.celcom.com.my. In addition to these Terms and Conditions, you shall be subject to Celcom s Fair Usage Policy ( Fair Usage Policy ) which is made available at https://www.celcom.com.my/personal/plans/data/fair-usagepolicy?pid=1360826467695 1. Duration of Service 1.1 This Service shall commence on the Activation date and shall continue to be effective until terminated by you or Celcom. 2. Universal Subscriber Identity Module (USIM) 2.1 Upon Celcom s acceptance of your subscription to the Service, Celcom shall provide a USIM card which shall be used with the Mobile Device to access the Service. 3. Service Availability 3.1 The availability and speed of the Service shall be subject to the following: (i) Celcom s network availability; and (ii) your Mobile Device capability including but not limited to the coverage, location, Celcom s network traffic and the type of data being transmitted by you. 3.2 Notwithstanding Clauses 3.1 and 3.2 above, the Service is provided on a best effort basis and Celcom does not guarantee or warrant the availability of the Service or continuous, uninterrupted or secure access to the internet. 4. Your additional obligations: 4.1 You agree that Celcom: (a) reserves the right to manage your allocated bandwidth including but not limited to reducing your speed, suspend or terminate your bandwidth to the Service to ensure fair access to all Celcom customers
on the same network with or without prior notice to you as prescribed in the Fair Usage Policy; (b) may, at its sole discretion, automatically disconnect your access to the Service after a period of your inactivity, which may vary from 20 minutes to 30 minutes to allow maximum network performance. 4.2 You shall not use the Service to run programs or servers that provide network content or connectivity to any third party not at the location where the connection is installed (including but not limited to FTP, HTTP, game, newsgroup, proxy, and IRC servers). 4.3 Celcom may reduce the speed of your bandwidth upon you reaching the monthly volume allocated to you according to your Package as per Clause 6.1 below. You may purchase additional bandwidth via: (a) Celcom s Online Customer Service (OCS); (b) sending SMS by typing BROADBAND VOL to 22188; (c) (d) contacting Customer Care Line at 1300 111 000; or visiting any of Celcom s branches. 5. Change of Bill Plan Service ( COBP ) 5.1 You may request for the COBP from the your existing Postpaid Service to any other Celcom First Postpaid/Prepaid Plans ( New Plan ) subject to Celcom s sole discretion. 5.2 Upon successful COBP, your existing Mobile Number shall be maintained 5.3 All your supplementary lines subscribed under Clause 3.1.1 of Part A above shall be subject to the COBP and shall be transferred to the New Plan. 5.4 In the event that your COBP is registered before your billing cycle, your bill shall be pro-rated from the date of the registration of the COBP. 6. 7. Tariff Rates 7.1 In addition to the charges prescribed in Clause 6.1 above, you shall be subject to the following : (i) (ii) (iii) (iv) (v) Pro-rated Monthly Fee ( Monthly Fee ) shall be charged in your first (1 st ) month s bill should you use the Service for less than a full month s billing cycle; Monthly Fee shall also be charged for the termination of the Service if you terminate the Service before the next billing cycle date. in the event that you register for the Service on a billing cycle date, one (1) backdated Monthly Fee shall be charged in your first (1 st ) month s bill. any additional usage shall be charged according to the tariff prescribed in the table above. the Packages shall apply for domestic usage only (within Celcom s network). Data roaming charges shall be charged separately and will be calculated based on data roaming charges as determined by Celcom s roaming partners and you may refer to http://www.celcom.com.my for such data roaming rates.
