CORPORATE REPORT NO: R160 COUNCIL DATE: SEPTEMBER 29, 2014 REGULAR COUNCIL TO: Mayor & Council DATE: September 23, 2014 FROM: Deputy City Engineer FILE: 5450-30 (Rogers) SUBJECT: License Agreement with Rogers Communications Partnership for Use of Road Allowances RECOMMENDATION The Engineering Department recommends that Council: 1. Receive this report as information; and 2. Authorize the Mayor and the City Clerk to execute a license agreement with Rogers Communications Partnership ( Rogers ) that will act to grant Rogers a non-exclusive right to install, operate and maintain telecommunications infrastructure for a ten (10) year period within the road allowances as illustrated on Appendix I to IV attached to this report. BACKGROUND Rogers has approached the City for permission to install, operate and maintain underground fibre optic cables within the road allowances as illustrated in Appendix I to IV. This infrastructure will allow Rogers to provide better telecommunication services to the low coverage areas in Surrey. Prior to such installations, Rogers must enter into a license agreement with the City for the use of the road allowances. DISCUSSION The City has entered into site-specific license agreements with other telecommunications carriers including A2B, Allstream, AT&T, Bell Canada and Bell Mobility. A new model license agreement has been developed by the Canadian Radio-television and Telecommunications Commission (CRTC). Staff are working with Rogers on certain terms of the new license agreement, which will be finalized, prior to submitting the new license agreement to the Mayor and the City Clerk for execution. The Legal Services Division has confirmed that it has reviewed the new license agreement and has no concerns.

- 2 - The license agreement will allow telecommunication services to be extended to the currently low coverage areas in Surrey. SUSTAINABILITY CONSIDERATIONS The expansion of telecommunications infrastructure that is contemplated by Rogers will assist in achieving the objectives of the City s Sustainability Charter; more particularly the following: EC2: Economic Development Strategy and an Employment Land Strategy The proposed infrastructure will provide expanded communications capacity for the low coverage areas in Surrey; and EN8: Sustainable Engineering Standards and Practices The construction processes that will be utilized will minimize environmental impacts. CONCLUSION Based on the above discussion, it is recommended that Council authorize the Mayor and the City Clerk to execute a license agreement with Rogers Communications Partnership ( Rogers ) that will act to grant Rogers a non-exclusive right to install, operate and maintain telecommunications infrastructure for a 10-year period within the road allowances as illustrated on Appendix I to IV attached to this report.
