Such MindCnnect prducts and custm agents, including any sftware, have t be kept up-t-date at all times. If an earlier versin is n lnger supprted, yu have t upgrade t a current apprved versin. Definitins Asset Cre Cmpnent Additinal definitins An Asset is a lgical representatin f a thing which can be a machine r an autmatin system with ne r multiple autmatin units (e.g. PLC) r even a factry site. Yu define an Asset with the Asset Cnfiguratin as part f the IT Data Mdeler applicatin (see chapter Asset Cnfiguratin ). Cre Cmpnents are Applicatins that are accessible t any MindSphere custmer by default (e.g. FleetManager). They may be priced separately and may cme with Specific Terms. Such fee is calculated based n MindSphere Units. In relatin t Applicatins, additinal fees may apply in accrdance with the terms and cnditins gverning the access t such Applicatins. Fr MindAccess User, a fixed mnthly fee set frth in the Order Frm applies. Included in this fee are 50 Users (see chapters User Management and Custmer Management ). Fr every additinal User (see chapter User Management and Custmer Management ) that yu define and that is nt already included in the Service as set ut in the applicable Order Frm, 30 MindSphere Units are cunted fr a full mnth, irrespective f the number f days fr which a User is defined. T the extent fees are calculated based n MindSphere Units, the fllwing applies: MindSphere Units are a measuring tl designed t help yu keep track f yur usage and the applicable amunt f fees. MindSphere Units are calculated, based n yur cnfiguratins under yur Accunt. The amunt f MindSphere Units depends n the number f Users that yu define and the cnfiguratin f yur data mdel. MindSphere Units are accumulated ver the mnth f usage, and any change f the cnfiguratin is tracked n a per minute basis and reflected in the calculatin f MindSphere Units. A MindSphere Unit has the value assigned t it in the Order Frm. Initial nbarding f Assets will immediately result in csts which will be charged t yu. factrs, including the amunt and type f variables, the reading cycles, and the duratin f data strage. T the extent that fees are based n MindSphere Units, the MindSphere Units applicable t the data mdel that yu created are shwn in the dialg Asset Aspects under Asset Cnfiguratin. Invicing The fixed MindAccess User Fee is inviced mnthly in advance and is nt refundable. The fee fr additinal User and the MindSphere Data Mdel Fee are inviced mnthly in arrears, based n the calculatin f the underlying usage. Service Levels and Availability Availability With respect t MindAccess User, it is ur gal t prvide at least 99% System Availability ver every calendar mnth. System Availability shall mean the percentage f ttal time during which the access t MindAccess User is available t yu at the WAN interface f the infrastructure used by us, fr the prvisin f Services during a calendar mnth. Fr the purpse f calculating the System Availability, Excluded Dwntimes shall be cnsidered as available. Excluded Dwntimes shall mean Planned dwntimes: Dwntime fr planned maintenance, fr which we will ntify yu at least ne day in advance, e.g. via the Web Interface, n MindSphere, r by email; and Unplanned dwntimes: (i) Emergency, when a temprary discntinuance f the Service and/r the MindSphere Platfrm is necessary t safeguard the stability r integrity f the MindSphere Platfrm r system; and (ii) An interruptin f the Service and/r the MindSphere Platfrm caused by circumstances beynd ur reasnable cntrl.
