Wabasha County Geospatial Data Distribution Policy & Fees Schedule 1
Purpose Wabasha County has been working with geospatial data since 1996. The Wabasha County Board realizes that geospatial data benefits County staff, as well as other governmental jurisdictions, academic users, the private sector, including businesses, and Wabasha County residents. In 2005, the Wabasha County Board adopted the first GIS Data Distribution Policy and Fees Schedule. A modified, 2006 GIS Data Distribution Policy and Fees Schedule was adopted by the board in 2006, and this current GIS Data Distribution Policy and Fees Schedule is intended to serve as the ongoing model for GIS data distribution. Introduction Minnesota law dictates that all GIS data are public unless private information is co-mingled with it. The government entity is responsible to separate out the private data and make the public data available to the public. Furthermore, government cannot ask the person requesting the data what it will be used for, or limit the amount of data being requested. All of the current Wabasha County data would fall under the public data category. The exception currently is the E911 driveway points, which do contain resident names. These resident names may be obtained from telephone databases, which would include unlisted/non-published numbers, which is would be categorized as private information. However, the AS400 tax database will be updated to include E-911 addresses, which is public information. Wabasha County GIS and The Wabasha County Board of Commissioners have decided that resident name information must be removed from the E911 driveway point database before distribution to the public. Other government agencies, utilities, and emergency services are allowed the resident name information, provided they agree to not release such data. Wabasha County is also allowed by state statute to charge for certain data. This is discussed in more depth in the GIS Data Fee Schedule. The Data Distribution Policies are subdivided into several categories, and explain how data will be delivered by agency: Wabasha County Departments Format Available: Digital (ESRI shapefiles,.dbf or raster) via ArcIMS, which is a web-based viewing platform. Also, in some situations, paper maps. Metadata: Paper maps will contain a brief citation of data s source. Metadata will also be made available on Wabasha County s website at http://www.co.wabasha.mn.us/ Disclaimer/Data Agreement: None required. GIS Software: ArcIMS, which is a server based GIS viewer, will allow internal departments to view, query, and do simple analysis on GIS data. This viewer can be accessed from any standard web browser (e.g. Internet Explorer) via the Wabasha County Intranet. Fees: None, IF the data/maps are not passed on to the public (public viewing is acceptable). Also, all fees will be waived for external requests of data, provided that the requestor can demonstrate that their use of the data can directly support internal Wabasha County Departments. Support: The GIS department will offer free, unlimited support to all Wabasha County staff during normal business hours. 2

Metadata: MGMG metadata will be required to accompany all digital files. Paper maps will contain a brief citation of data s source. Metadata will also be made available at Wabasha County s website at http://www.co.wabasha.mn.us. Disclaimer/Data Agreement: Each Agency will be required to sign a data disclaimer and data agreement form to be filed with the GIS Coordinator. These forms will be updated each time a new dataset is requested, but no more than once every two years. GIS Software: Agency is required to provide it s own software or download ESRI s ArcExplorer via the internet. Fees: None, provided the agency complies with the Data Use Agreement. 1 Support: Limited Other Companies Format Available: Digital (ESRI shapefiles,.dbf or raster) via Email or CD-R, and paper/pdf maps. Internet Format Available: ESRI ArcIMS Internet based interactive map viewer at Wabasha County s website at http://www.co.wabasha.mn.us/ Metadata: ArcIMS maps will contain links to metadata. PDFs will contain a brief citation of data s source. Disclaimer/Data Agreement: User will be required to click on a link agreeing with the web posted data disclaimer. GIS Software: None Required Fees: None Support: None/Very Limited Re-Distribution Applies to Public and Private Sector re-distribution of Wabasha County data Redistribution will be allowed provided that the requesting agency adheres to the following guidelines: o Agency must sign Data Use and Acceptance Agreement (For Re-Distribution)-see following page. o Wabasha County will not be liable for any errors or omissions. o Fees (if any) will be as shown in existing fee schedule. Government & Academic user fees will be waived. 2 o Private agencies will receive a snapshot of the data as it is on the date it is requested. No updates will be provided for re-distribution without additional fees. These additional fees will be equal to the original fee that was charged. These additional fees will apply to each update. Individuals may not re-distribute any Wabasha County data. Internal Wabasha County departments may not re-distribute any Wabasha County collected/maintained GIS data. Requests for GIS data should be directed to the Wabasha County GIS Coordinator. Data Disclaimer There shall be two different data disclaimers. The disclaimer used depends on how the data will be used. The first disclaimer is for organizations that do not intend to re-distribute the data. The second disclaimer is for users that will re-distribute the data. Wabasha County Geospatial Data Fee Schedule (Effective Jan. 1, 2008) Introduction Minnesota Data Practices Act allows government agencies to charge for making, certifying, and compiling copies. It also allows for fees to be charged when the data has commercial value and significant public funds have been spent by the agency for this purpose. That has been kept in mind when compiling the Wabasha County Geospatial fee schedule.
