Product of Promotion: China Telecom Shanghai fixed line and cable broadband (limited to FTTH ) services, and value-added fixed line and broadband services. 5. Details of Campaign 5.1. 2180 One 100M cable broadband connection (4Mbps upstream, 25 Notes: 100Mbps downstream) The 30M unlimited broadband connection refers to connection speed of 30Mbps downstream and 2Mbps upstream.the 50M unlimited broadband connection refers to connection speed of 50Mbps downstream and 4Mbps upstream. The 100M unlimited broadband connection refers to connection speed of 100Mbps downstream and 4Mbps upstream. After the Customer has subscribed to this package, China Telecom Shanghai shall choose a suitable connection method for the Customer, based on the broadband resources available in the vicinity of their address. 5.2. Package details: 5.2.1. This offer is limited to one fixed line and one cable broadband subscribing to the package. The broadband and fixed line must be held under the same account name and billing address. 5.2.2. Upon activation of the package, the Customer is obliged to pay a yearly service fee of CNY 2180.No separate monthly fee will be charged for the fixed line, caller display, colorful ringback tone, ringback tone package and cable broadband services. 5.2.3. For new broadband customers, the one-off installation and testing fees and corresponding handling fees will be waived. ( One-off fees for broadband service include: installation and testing fees of CNY 300/line and handling fees of CNY 10/line). For new fixed line customers, a one-off fixed line installation and handling fee of CNY 140/line will be charged. 5.2.4. Inclusive voice call allowance: During the validity of the promotion offer, if the actual voice call charges incurred by local-to-local calls and local-to-domestic long-distance calls (excluding Family Long-distance Call, IP calls, and calls to Taiwan, Hong Kong and Macau) made from the fixed line in the package in a month exceed the Inclusive Voice Call Allowance in the
selected yearly package, the Customer will be billed for the charges in excess in addition to the basic yearly fee of the package. Charges incurred by calls made to Voice Information Service and dial-up internet connection from the fixed line are not covered by the Inclusive Voice Call Allowance and discounted rates of the package. 5.2.5. The package includes ringback tone for fixed line, but does not cover the charges for setting new ringback tones. The ringback tone package for fixed line includes a number of tunes, which will automatically be played in rotating order for each incoming call. 5.2.6. Upon activation of the package, the fixed line will no longer enjoy the previous CNY 6 discount. 5.2.7. The standard charges of the basic package will become effective on the first day of the month after the application is accepted. Before the standard charges become effective, charges will be calculated according to the following for new customers: The monthly rental for the fixed line in the package is calculated on a pro-rata basis according to the standard rates, whereas the broadband service fee is calculated on a pro-rata basis at a 50% off the standard rates. Calls made from the fixed line are charged at the standard rates; the inclusive monthly voice call allowance in the package will not apply. The service charges for caller display, colourful ringback tone and ringback tone package for the fixed line and relevant one-off charges will be waived. Other charges are calculated according to thestandard rates. Existing Customer: If under the original package charges incurred in the current month are due in the next month, then the charges of the original package will continue to apply in the month of subscription change, until the standard charges of the package of this promotion offer become effective. Value-added services that are activated by default during this time (which are not included in the original package) are charged at the standard rates for the relevant services. 5.2.8. Apart from the discounted rates offered with the package, all other telecommunications charges incurred by the fixed line and broadband connection in the package are calculated according to the current effective standard rates. 5.2.9. The Customer can choose to subscribe to an optional package for fixed line or broadband connection. For details and basic monthly fees, see the latest version of Terms and Conditions for Value-Added Optional Packages. The Customer choosing to subscribe to an
optional package is bound by the aforementioned Terms and Conditions. 5.2.10. Family broadband service supports internet access for up to 4 computers at any one time sharing the bandwidth offered in the basic package. China Telecom Shanghai shall not guarantee the quality of connection if the number of computers connecting to the internet exceeds the agreed number, and reserves the right to terminate the Customer s broadband connection. 6. Notes to Customer: 6.1. These Terms and Conditions are valid for one year, from the first day of the month after the services in the package commence. After the Terms and Conditions expire, the Customer is free to change their subscription or terminate their account. After the subscription charges or account termination becomes effective: the offers of the package will end. The Customer may choose to subscribe to other E-Surfing e-home packages or promotion offers of China Telecom Shanghai available at the time of account termination.changes in package subscription will become effective on the first day of the month after the relevant procedures have been completed. Upon contract expiry, if the Customer does not change their service subscription or terminate their account, China Telecom Shanghai shall not terminate the communications services provided to the Customer if it remains capable of providing the Customer with the package specified in these Terms and Conditions and if there is no outstanding balance in the said Customer s account. Service will continue to be provided based on standard charges of the Package specified in these Terms and Conditions. If China Telecom Shanghai is unable to provide the accorded package, notification of package termination shall be given to the Customer one month in advance. 6.2. Customers already participating in other fixed line, broadband or long-distance call promotion offers of China Telecom Shanghai, and still bound by the Terms and Conditions of the said promotion offers, are not eligible for this offer. 6.3 Customers with outstanding accounts are not eligible for this promotion offer, unless the outstanding payment is settled in full. 6.4. Customers are obliged to cooperate with China Telecom Shanghai in the
implementation of the services in the package. 6.5. During the validity period, in the case of account transfer, service suspension with number retention or service termination of the fixed line and/or broadband connection in this promotion offer, the Customer will be considered to have withdrawn from this promotion campaign. 6.6. During the validity period of these terms and conditions, changing to an alternative broadband package is not allowed. 6.7. The Customer is obliged to settle their account on time. If payment is not made before the due date, the Customer is liable to a contract violation penalty equivalent to 3 of the outstanding account balance per day. If the Customer s account remains outstanding 30 days after the agreed payment due date, China Telecom Shanghai shall suspend the services provided to the Customer. 6.8. During the validity period of these Terms and Conditions, if the fixed line or broadband connection subscribing to this promotion offer is suspended due to the Customer s (full or partial) responsibility, the suspension period shall not be excluded from the contract period of the yearly package. If service is suspended for more than 60 days, and the account remains outstanding, or if any other causes for the service suspension remain, China Telecom Shanghai reserves the right to terminate the services provided to the Customer. 6.9.China Telecom Shanghai shall provide the Customer with the necessary equipment for broadband connection free of charge. The Customer should use and take care of the equipment offered free of charge by China Telecom Shanghai properly, and is liable for all repair charges incurred by damage to the equipment due to their responsibility. If the equipment cannot be repaired, the Customer is obliged to pay compensation to China Telecom Shanghai that is equivalent to the value of the equipment. The Customer shall not lend, rent, sell or gift the equipment to a third party, or use it for service(s) not provided by China Telecom Shanghai without the consent of China Telecom Shanghai. China Telecom Shanghai reserves the right to terminate the broadband service provided to the Customer in the case of such violation(s). If the Customer withdraws from the package on their own accord, or if they choose not to continue using the broadband service of China Telecom Shanghai upon contract expiry, they are obliged to return the equipment to China Telecom Shanghai in good and working condition. Alternatively,
they can reimburse China Telecom Shanghai for the cost of the equipment offered to them (Modem: CNY 265/device; Household gateway: CNY 215/ device; ONU (for FTTH connection customers): CNY 360/ device). 6.10. During the validity period of these Terms and Conditions, should the Customer withdraw from this promotion campaign or cause it to end prematurely, they are required to pay all outstanding charges and a pre-mature contract termination penalty equivalent to two times the basic monthly service fee,i.e. CNY 263/ 297/ 363. Customers who have enjoyed waivers of one-off charges are obliged to reimburse China Telecom Shanghai in full for the said waivers. The service offerings in the package will be charged at the standard rates (broadband connection is charged according to the standard rates of the unlimited package of selected connection speed). 6.11. Upon service commencement, the Customer will be billed for the service fee of the package for the first month, the basic yearly fee and all one-off charges in the next service month. All charges in excess of the monthly allowance of the package will be reflected in the bill from the third service month onwards. 6.12. Each individual customer with one ID can subscribe to a maximum of five broadband basic-product, single-product and bundle packages. 7. During the service period, China Telecom Shanghai shall provide communications services in compliance with The Telecom Regulations of the Peoples Republic of China and related ordinances and regulations. In the case of violation, Chine Telecom Shanghai shall take responsibility for contract violation. 8. These Terms and Conditions serve as a supplementary agreement to the Service Agreement of China Telecom Corporation Limited Shanghai Branch and the Broadband Service Subscription Agreement of China Telecom Corporation Limited Shanghai Branch (The valid version at the time of subscription shall prevail). Should the aforementioned agreements interfere with the contents of these Terms and Conditions, these Terms and Conditions shall prevail. The Customer s signature on the Customer Registration Form of China Telecom Corporation Limited Shanghai Branch serves as proof of their confirmation and acceptance of these Terms and Conditions and the aforementioned agreements.
