New Mexico Proposed Orders and Notices of Hearing Overview: The purpose of this document is to outline the process for filing Proposed Order or Notice of Hearing within the File and Serve application for New Mexico district courts. Doing so will eliminate the need for attorneys to email the judge, as well as eliminate the need for the court staff to submit the signed documents themselves once the judge has completed them. Configuration has been established for filing attorneys to assist with submitting both Proposed Orders and Notices of Hearing within the File and Serve application. The filing codes will be specific to the judge on the case. These will read Proposed Order for Judge (Name) or Notice of Hearing for Judge (Name). The filer will want to select the appropriate filing code for the judge already assigned to the case. The judge assigned to the case can be located in the workspace screen beside the case title or from within the filing screen. Both locations are shown below Filing a Proposed Order: Before filing the filer will want to ensure that an accurate service contact has been added to the case service contact list. The filer will complete this by clicking on the Service Contacts icon to the right of the case title from the workspace screen
Doing so will open the Case Service Contacts list and display all current service contacts attached to the case. Should the filer need to add their service contact to the case this can be done from this screen by clicking either the or button. The button allows the filer to associate a service contact to the case that has previously been stored in their Firm s Master Service List. If the contact in question is not listed in the Firm s Master Service List then the button should be used. Once all information has been added or confirmed for the case service contacts, click the button in the lower right hand corner. Once the service contacts have been confirmed and the judge assigned to the case has been identified, start a new subsequent filing into the case by clicking the File into this Case icon as shown below This will take the filer into the filing screen starting with the Parties page
Should the filer need to add any parties to the case this can be done from this screen by clicking the clicking the button. Once all party information has verified or updated, proceed with the process by button in the lower right hand corner of the screen. This will navigate the filer to the Filings screen where they will be able to select the appropriate filing code and attach the necessary documents. In the first drop down box Select Filing Code the filer will select the Proposed Order for the Judge associated with the case Once selected, the filer will proceed to fill in the other necessary information in the top of the form including the Filing Description, Reference Number and determine if electronic service should be included in this filing. Note that the order, if granted by the judge, will be electronically served on all
case service contacts. Service at this point is one way to notify contacts on the case that the filing party has submitted a proposed order. The selection of the correct filing code will cause the lower half of the form to populate with the document fields Proposed Order and Endorsed Supporting Pleadings. These document types are designed to allow the filer to attach documents in the correct formats for the Proposed Order process. The Proposed Order document must be in.doc or.docx format when attached to the filing. This allows the court to edit the document during the review of the envelope and apply the necessary signatures. The Endorsed Supporting Pleading documents should be in PDF format and be the appropriate supporting documentation previously efiled and stamped by court clerks on the case. Should the filer need to attach more than one supporting document for the proposed order, the ability to upload multiples is available as well. Failure to attach the correct documents with the necessary format, signatures and stamps where applicable will result in rejection by the court clerk upon review. As a part of the Proposed Order process the court has requested that all filers utilize the Preliminary Copies box to notify the necessary parties that the filing has been submitted to the filer. This box allows the filer to enter a list of email address separated by commas that would normally be copied on the emails sent to the judge. Users can paste copied email addresses from another location into this field by holding down the control (Ctrl) key and pressing the letter V. The clerks will be confirming that this information has been filled in during review to verify that all necessary parties have been notified of this filing.
Should the filer need to submit more than one Proposed Order into this case they can do so by clicking the button located at the top of the screen and following the above steps for each field. Once all the fields on the left hand side of the screen have been filled out, the filer will proceed to select the payment account, party responsible for fees and filing attorney for their filing. Once the entire Filings page has been filed out, navigate to the next screen by clicking on either the,or button in the lower right hand corner.
The button will only be available if the filer selected service on the filing in the previous step. Here the filer will be provided the option to select which service contacts this filing should be served on upon receipt by the court. The will take the filer to a summary page that will provide a breakdown of the information selected during the filing process. Should the filer need to make any changes, each page can be navigated back to by clicking the button beside the desired section.
