INTRODUCTION 1. The Environmental Quality Act, 1974 was enacted to prevent, abate, control pollution and enhance the environment for the purposes connected therewith. 2. The emphasis is on prevention which is specially directed to the industries. 3. The concept of prevention taken by DOE is through self regulation. 4. The mechanism used is through developing certification courses to train competent persons in the industrial sector. 5. Competent persons are responsible to : (a) operate a control equipement. (b) manage scheduled waste in their premises. (c) conduct of studies (d) prepare and submit reports, plans, proposals, engineering drawing or other documents relating to environmental matters.

LEGAL REQUIREMENT Act A1441 Environmental Quality(amendment) Act 2012 The principal Act is amended by inserting after section 49 the following sections: Competent person 49a. (1) An owner or occupier of a premise shall employ a person who has been certified by the Director General as a competent person to conduct all or any of the following activities: (a)the operation of a control equipment; (b)the management of scheduled wastes; (c) the conduct of studies; (d) the preparation and submission of reports, plans, proposals, engineering drawings or other documents relating to environmental matters. (2) The reports, plans, proposals, engineering drawings or other documents relating to environmental matters referred to in paragraph (1)(d) shall be prepared and submitted by the competent person to the Director General.

LEGAL REQUIREMENT Environmental Quality(Industrial Effluent) Regulations 2009 Regulation 10 Competent person 10. (1) The operation of an industrial effluent treatment system shall be supervised by a competent person. (2) A competent person shall be any person who has been certified by the Director General that he is duly qualified to supervise the operation of an industrial effluent system. (3) An owner or occupier of a premise shall ensure that a competent person is on duty at any time the industrial effluent treatment system is in operation.

LEGAL REQUIREMENT Environmental Quality(Sewage) Regulations 2009 Regulation 6 Competent person 6. (1) The operation of a sewage treatment system shall be supervised by a competent person. (2) A competent person shall be any person who has been certified by the Director General that he is duly qualified to supervise the operation of a sewage treatment system. (3) An owner or occupier of a premise shall ensure that a competent person is on duty at any time the sewage treatment system is in operation.

LEGAL REQUIREMENT Environmental Quality(Clean Air) Regulations 2014 - Regulation 7 Air Pollution Control System 7. (4) The operation of the air pollution control system shall be supervised by a competent person who shall be on duty at all times during the operation of the air pollution control system.

COURSE CONTENTS PRACTICAL HANDLING Storage, Handling, Transportation and Disposal of Scheduled Waste - Practices of good packaging, labelling and storage; - Understanding methods of safe handling, transportation and disposal of scheduled wastes; - Current practices in scheduled waste management; - Emergency response and preparedness. CERTIFICATION PROGRAMME FLOW CHART 5 days course + 1 day exam. Will get attendance certificate. If pass the exam, will get Competent Certificate (valid for 1 year) Training Course Field Training Report (FTR) Using 6 month of data. Time given: 1 year starting from getting exam result. Interview by Certification Panel. Pass the interview, then will get full Competent Certificate Interview

NEXT STEP AFTER CERTIFICATION Once a person is certified as competent, he/she will be issued a certificate of competency and his/her name will be automatically be registered in the National Registry of Certified Environmental Professionals. (NRCEP) NRCEP administered by EiMAS. The person s name and other particulars will be posted on DOE s website at www.doe.gov.my

. Continuing Professional Development CPD stands for Continuing Professional Development. It is a commitment by Competent Person to continually update their skills and knowledge in order to remain professionally competent and achieve their true potential. Under the National Registry of Certified Environmental Professionals (NRCEP) Scheme, all Competent Persons certified by Director General of Department of Environment Malaysia are required to collect a minimum of 50 CPD hours per year. Please refer to EiMAS latest Guidelines for further information.
