TERMS AND CONDITIONS FOR USE OF THE SAFARICOM PREPAY BLACKBERRY SERVICE The following terms and conditions apply to the Safaricom Prepay Blackberry Service ( Prepay Blackberry Service ) and by using the Prepay Blackberry Service you will be deemed to have read, understood and accepted the same. 1. DEFINITIONS: BlackBerry Handheld means the BlackBerry TM wireless handheld messaging device developed by RIM and that incorporates a SIM card to which the Subscriber s Server forwards emails and which the Subscriber is also capable of using to access the Safaricom Network; "Charges" means the amounts payable for the Services as published in these terms and Conditions and as may be varied from time to time; (c) "Connection" means the activation of the MSISDN for use on the Network; (d) Content means information, communications, images and sounds, software or any other material transmitted or communicated through the Services; (e) Intellectual Property Rights means all intellectual property rights including without limitation, copyright, patents, trade marks, registered designs, design rights, know how and all other rights; (f) Month means thirty (30) days. (g) MSISDN means the Mobile Subscriber Integration Services Digital Number, which is the Subscriber s telephone number; (h) "Network" means the cellular network operated by Safaricom; (i) Offending Material means any Content that is: (i) in breach of any law, regulation or code of practice invoked by the Safaricom or industry regulator or any policy adopted by Safaricom with regard to the acceptable use of the Services, or (ii) abusive, indecent, defamatory, obscene, offensive or menacing, or (iii) in breach of confidence, intellectual property rights, privacy or any right of a third party. (j) RIM means Research in Motion Limited; (k) Services means the BlackBerry mobile communications solution provided by Safaricom pursuant to this (l) Terms and Conditions and includes voice and other data services provided through the Network; SIM means the subscriber identity module which is programmed with the Subscriber s MSISDN and that enables the Subscriber to use the Services when used with the BlackBerry Handheld handset; (m) Software means the BlackBerry Software and/or the software installed on a BlackBerry Handheld; (n) "Subscriber" means the Safaricom customer applying for, or using the Services and includes any person who Safaricom believes is acting with the customer s authority; (o) Subscriber s Equipment means the necessary compatible computer systems including, servers, hardware, and software required by the Subscriber to access and/or make use of the Services; (p) Streaming means to receive multimedia constantly from a streaming provider and includes but is not limited to video, audio. 2. THE SERVICE The Safaricom Prepay Blackberry Service enables the Subscriber to access RIM Blackberry services and other services offered by the Network through the Blackberry Handheld, Software and Safaricom SIM; Prepay subscribers can opt into any of the Blackberry Plans described in clause 5 below. 3. ELIGIBILITY The Prepay Blackberry Service is available to all Safaricom Prepay subscribers who own or use a Blackberry Handheld. Blackberry Handheld can be purchased at any Safaricom Retail Shop subject to the terms of sale which include the Manufacturer s Warranty. 4. HOW TO REQUEST FOR THE SERVICE To activate the Service, subscribers will dial *210# from their Blackberry Handheld The Subscriber will receive an SMS confirming the status of the subscription.

5. BLACKBERRY PREPAY PLANS The Prepay Subscribers can opt into any of the following Blackberry Prepay Plans:- 5.1 Blackberry Internet Service Blackberry Internet Service entitles the Subscriber to the following:- i. Free unlimited e-mail, with a maximum of ten (10) web e-mail accounts; ii. Free unlimited browsing excluding streaming. For streaming, the subscriber will be charged the normal Safaricom published data rates iii. Free unlimited Facebook and Twitter iv. Free instant messaging and Blackberry Messenger (BBM). v. Blackberry App world. The Subscriber pays Kshs. 999/- per month. (c) Upon expiry, the Subscriber will receive a notification of the expiry and the service will lapse at midnight of the relevant expiry day. (d) To renew the subscription, the Subscriber will dial *210# and follow the prompts. 5.2 Blackberry Complete Blackberry Complete entitles the Subscriber to the following:- i. Blackberry Messenger (BBM) ii. Blackberry E-mail iii. One (1) Web-based E-mail account iv. Instant messaging v. Browsing excluding streaming. For streaming, the subscriber will be charged the normal Safaricom published data rates vi. Blackberry App world. vii. Unlimited Social networking The subscriber pays Kshs. 499/- per month. (c) Upon expiry, the Subscriber will receive a notification of the expiry. The service will lapse at midnight of the relevant expiry day. (d) To renew the subscription, the Subscriber will dial *210# and follow the prompts 5.3 Daily Blackberry Daily Blackberry entitles the Subscriber to the following:- i. Blackberry Messenger (BBM) ii. Blackberry Email iii. One (1) Web based Email account iv. Instant messaging v. Browsing excluding streaming. vi. Blackberry App world. vii. Unlimited Social networking The Subscriber pays Kshs. 20/- per day (24 hours) (c) The subscription lapses after 24 hours and automatic renewal is done at midnight subject to availability of air time. (d) To opt out of the Service, the Subscriber will dial *210# and choose the BB Daily then chose unsubscribe 6. GENERAL PROVISIONS 6.1 Safaricom may in its sole discretion suspend or vary the Services without compensation for any period during which: Safaricom is required or requested to comply with an order or instruction of or a recommendation from the government, court, regulator or other competent authority;

Safaricom reasonably suspects or believes that the Subscriber is in breach of any of these terms and conditions. (c) Such a suspension or variation is necessary as a consequences of technical problems or for reasons of safety; (d) Safaricom suspends the provision of the Services for its commercial reasons. 6.2 The Subscriber shall reimburse Safaricom for all reasonable costs and expenses incurred as a result of the suspension or variation of the Services where the suspension or variation is implemented by Safaricom as a result of any act or omission of the Subscriber. 6.3 Safaricom may establish limits concerning the use of the Services for example the maximum size of an email message that may be sent or received, the maximum capacity allocated to you for storage and/or transmission of Content on/through the Network which you access via the Services. 6.4 Safaricom shall not be responsible for the deletion, corruption or failure to store any Content maintained or transmitted by the Network. 6.5 Safaricom reserves the right to vary the Charge applicable to a particular MSISDN if in its reasonable opinion the usage applicable to such BlackBerry Handheld exceeds any reasonable use limits communicated by Safaricom from time to time. 6.6 Although Safaricom will take all reasonable steps to ensure that the Services are available to the Subscriber at all times, it cannot guarantee a continuous fault free service. The quality and availability of Services may be affected by factors including (but not limited to) acts of God, geographical topography, weather conditions, planned maintenance or rectification work on the Network, the Software or the Subscriber s Equipment or Blackberry Handheld may interfere adversely with the quality and provision of the Services 6.7 All other services provided by the Network such as voice, SMS, other Value Added Services, data (excluding browsing as per the Blackberry Plans above) shall be charged at the published Safaricom tariffs for the respective services. 6.8 Safaricom, its officers, employees, agents and partners will not be liable to the Customer or any party for: (c) (d) (e) (f) any direct, indirect, consequential, incidental or special loss, corruption of data or other costs arising out of or in connection with this Service for any loss including as a consequence of a failure or delay in availability of the Network or Software notwithstanding Safaricom s awareness of the possibility of the Subscriber incurring the same; any losses arising in connection with (i) force majeure events or other circumstances outside our control or outside our knowledge including industrial disputes, terrorist or enemy action, or (ii) any unforeseeable acts or omissions or negligent acts on the part of RIM, the BlackBerry Handheld supplier or any other of Safaricom s service providers, contractors, agents or employees. the, loss, late receipt or non-readability of any download, transmission, or other communications. for any damage to or loss of information on the BlackBerry Handheld or Subscriber Equipment in the event that unwanted programs or material, Trojan horses, worms or viruses are downloaded to the BlackBerry Handheld or Subscriber Equipment as a consequence of receiving emails or accessing the internet using the BlackBerry Handheld. The Subscriber will be required to take reasonable precautions while accessing websites, sending or receiving emails using the Services. Any losses caused as a result or while the Subscriber is roaming resulting from a failure of the network of the foreign operator. Any charges or losses incurred as a result of or unauthorised use of the BlackBerry Hand including following a theft of the same.

7. SUBSCRIBER S OBLIGATIONS 7.1 The Subscriber shall not use and shall ensure that no other person using the Subscriber s access to the Services uses the Services: for storing, reproducing, transmitting, communicating or receiving any Offending Material; or fraudulently or for any criminal purpose or in a manner that is contrary to any regulatory or legal requirement; or (c) to cause annoyance, inconvenience or needless anxiety to any person; or (d) contrary to any other instructions that may be communicated by Safaricom to the Subscriber from time to time. (e) in a manner which is inconsistent with a reasonable subscriber s good faith use of the Services or the Network; 7.2 The Subscriber shall use the BlackBerry Handheld and the Software in accordance with any user guide or other reasonable instruction of any manufacturer or supplier of the same or reasonable instruction of Safaricom 7.3 The Subscriber shall not and in addition shall not permit any third party under its control to, modify, delete or destroy any Software residing in the BlackBerry Handheld without the prior written consent of Safaricom. 7.4 The Customer shall not reverse engineer, disassemble or decompile the Software, the BlackBerry Handheld or related accessories. 7.5 The Subscriber shall provide Safaricom with all the information Safaricom needs and allow Safaricom to use that information for purposes which may include: Carrying out any activity in connection with a legal, governmental or regulatory requirement on Safaricom in connection with legal proceedings or in respect of crime or fraud prevention, detection or prosecution. Monitoring or recording of the Subscriber s calls, emails or text messages for Safaricom s business purposes such as quality control and training, prevention of unauthorised use of Safaricom s telecommunications system and ensuring effective systems operation.. 8. TERMINATION Safaricom may terminate the provision of the Services at any time without incurring any liability to the Subscriber if: (c) (e) (f) (g) Safaricom has reason to believe that the Service is being used in an unauthorised way or for criminal activities; The Subscriber s BlackBerry Handheld is found to emit signals, which may interfere with the quality of the Services or the Network; The Subscriber fails to pay the full amount of Charges; Safaricom has good reason for believing that any information given by the Subscriber to Safaricom is false or misleading; The Customer commits any material breach of any of the provisions of this Terms and Conditions and if can capable of remedy fails to remedy the breach within the period notified by Safaricom; The Subscriber becomes bankrupt or become subject to an administration order;

(i) It is found that the Subscriber is no longer a subscriber to the Safaricom Network. (i) The agreement under which Safaricom provides the Services is terminated.. 9. OTHER TERMS Safaricom reserves the right to withdraw the Services at any time and to vary or amend any element of the Services at any time without further notice. These terms and conditions may be varied or amended by Safaricom at any time and by continuing to use the Services you will be deemed to have read, understood and accepted such amended terms and conditions. The varied terms and conditions will be available on the Safaricom website www.safaricom.co.ke (c) The standard terms and conditions for the Safaricom PrePay services (www.safaricom.co.ke) will apply to the Services save where expressly varied by these terms and conditions. (d) Safaricom offers Blackberry Enterprise for its Postpay Subscribers and corporate users. Inquiries can be made through our Customer Care lines or any Safaricom Retail Shop.
