Prot 022/B/11 The Draft Regulation On Interconnection This Regulation is issued based on the Section 1, point 1, 2; Section 16 point 2(a), iv); Section 21 point 6; Section 22 point l); Section 53; Section 56; Section 57 of the Telecommunications Law No.2002/7, and as amended Law on Telecommunications No. 03/L-085 (hereinafter referred to as the Law), point 3.8.4a) of the document Telecommunications Sector Policy date 13.06.2007, Action Plan for European Partnership and implementation of the Directive 2009/140/EC which amends the Directive 2002/19/EC of the European Parliament and of the Council 7 March 2002, on access to, and interconnection of, electronic communications networks and associated facilities (the Access Directive) Article 1 Scope and aim of this Regulation 1.1 The purpose of this Regulation is to encourage and if necessary to force implementation,of interconnection and service interaction,aiming at promoting sustainable and efficient competition for maximum benefit to end users. 1.2 This Regulation shall be applicable in regard to the undertakings, which, according to the procedure, established by legal acts are held undertakings, Faqe 1 nga 7

holding significant power on the corresponding market and which are to execute the obligations, established by the Law and Regulation for Market Analysis and Definition of the providers with SMP. 1.3 This Regulation takes into account relevant EU legal acts (directives, regulations, recommendations) and best practices of the regional and international countries to the extent that is in conformity with Law. For the purpose of this regulation: Article 2 Definitions 2.1. The meaning or the definition of each word, phrase or term according to the law on Telecommunications will be also applicable for that word, phrase or term in this regulation. 2.2 The main definitions for the purpose of this Regulation: Interconnection is the physical and logical linking of the facilities of organizations providing telecommunications networks and/or telecommunications services, in order to allow users of one organization to communicate with users of another organization, or to access services provided by another organization. Public Telephone Service is the commercial provision of a service consisting of the conveyance of direct, real-time voice telephony by public telecommunications services providers Offering Operator (hereinafter the Operator) is the operator of the public telecommunications network obliged to offer interconnection according to the Law. Beneficiary Operator (hereinafter the Beneficiary) is the operator of a public telecommunications network or telecommunications services, which have applied in writing to obtain interconnection. Point of Interconnection is a geographically defined point in the offering operator s public network, where the offering operator and the beneficiaries are interconnected. Article 3 The Scope of Provision of the Information, Related With the Services, Specified In the Reference Offer To Interconnect Public Telephone Communication Networks 3.1 The Operator, when providing the general information, specified in Paragraph 8.3 of the Regulation for the Provision of Access (TRA Ref Prot.No.012/B/11) to the Beneficiary shall present the information on the operated switching network and the detailed list of all the public telephone communication exchanges, to which access for interconnection can be provided, existing in its network. 3.2 A Provider of a public fixed telephone communication network, when providing the information, specified in Paragraph 8.3 of the Regulation for the Provision of Access, shall specify the territory, serviced by the exchange, specifying the numbering blocks, directly serviced by the exchange and/or numbering blocks, serviced by the exchange in an indirect manner, i. e. attributed to the switches, subordinate to the exchange, at which no access can be provided for interconnection of networks. Article 4 The Specific Requirements for the Content of the Reference Offer to Interconnect Public Telephone Communication Networks 4.1 The Operator shall provide and include into the reference offer to interconnect public telephone communication networks the following specific services and information: Faqe 3 nga 7

4.1.1 taking into consideration the established obligations, the call traffic sending services, including: 4.1.1.1 calls termination services; 4.1.1.2 calls origination services, by using an individual service provider selection code. The providers of public fixed telephone communication networks shall additionally specify the information on the calls origination services by utilizing carrier pre-selection possibility; 4.1.1.3 calls transit services; 4.1.2 the information on the geographical point of connection to public telephone communication network, specifying the address of each point (name of the inhabited locality, name of the street, number of plot of land, building or complex of buildings on the street or in the inhabited locality, number of housing or uninhabited premises in the building, the zip code, if available), distinguishing the following: 4.1.2.1 national network interconnection points; 4.1.2.2 an operator, providing public fixed telephone communication network shall additionally specify the information on local network interconnection points, giving the Beneficiary the possibility to provide services to the end users, serviced by the point or the point in subordination to the former point; 4.1.2.3 network connection services, including: a) provision of a national networks interconnection point; b) provision of a local networks interconnection point (to be submitted only by the operators, providing public fixed telephone communication network); c) provision of capacities at networks interconnection points; d) signaling services; e) synchronization services; f) testing services; 4.1.2.4 An operator, providing public mobile telephone communication network, shall, in consideration of the established obligations, Faqe 4 nga 7

additionally submit the information on the offered virtual network services; 4.1.3 other public electronic communications networks interconnection services, including: 4.1.3.1 calls to emergency services (to short numbers of emergency services and the common number of emergency services); 4.1.3.2 numbering implementation services, including: a) non-geographic telephone communication number series implementation services; b) an operator, providing public fixed telephone communication network shall additionally specify the information on geographic telephone communication number series implementation services; 4.1.4 the services and conditions of access to information systems, including: 4.1.4.1 the conditions of access to operating support systems, information systems and databases of the Operator, by presenting advance orders, performing maintenance and/or fault elimination works, providing settlement information to the Beneficiary, to the extent it is related with provision of public telephone communication networks interconnection and associated services; 4.1.4.2 information on the technical specifications and interfaces, used for connection of the corresponding information systems of the Beneficiary with the systems of the Operator, listed in Paragraph 4.1.4.1 of these Rules. Article 5 Special Conditions for Provision of the Services, Specified in the Reference Offer to Interconnect Public Telephone Communication Networks 5.1 The Operator, shall provide access for interconnection of networks,both at network termination points offered to end users and non-network termination points in case the electronic communications operator, connecting Faqe 5 nga 7

to the network, wishes such access and interconnect networks at any telephone exchange. 5.2 In case of networks interconnection the Operator shall observe National Telephone Communications Numbering Plan approved by TRA on 2007 (TRA Ref Prot.No. 153/07) which was amended with Annex II (TRA Ref Prot.No.99/1/10) and the following requirements, related with numbering: 5.2.1 to implement the National Telephone Communication Numbering Plan in its network and to execute all the changes within the network and other works, related with implementation of telephone communication numbers by connecting the non-interconnected or already interconnected networks at its own expense not later than within the time period of two months from the date of receipt of the Beneficiary s request to ensure the operation of telephone communication numbers; 5.2.2 to ensure that the numbers of network termination points are transmitted up to the network termination point when forwarding calls from one network to another. The format of the numbers shall correspond to the international format of a telephone communication number, established in the National Telephone Communication Numbering Plan; 5.2.3 to transfer an unchanged number of network termination point in case calls are forwarded by transit. Article 6 Final Provision 6.1 Action or omission of the TRA related to application and implementation of this Regulation may be appealed against in the procedure established by the laws of the Republic of Kosovo. 6.2 In case no other provision is foreseen by the laws of the Republic of Kosovo in this regard the management body of the Operator shall be responsible for the timely submission of the documents and data of the Operator and other information to be provided to the TRA according to this Regulation. 6.3 The Operator shall be responsible for the failure to observe this Description according to the procedure, prescribed by the legal acts of the Republic of Kosovo. Article 7 Entry into force and validity 7.1 This regulation enters into force after its approval with a decision from the TRA Board and remains in force until another regulation is issued.
