TouchStar service consists of the following central office call management features offered in addition to basic telephone service. A13.19.2 Definitions of Feature Offerings A. Call Return This feature enables a customer to place a call to the telephone number associated with the most recent call received, whether or not the call was answered or the number is known. The customer can dial a code to request that the network place the call. Where facilities permit, upon activation of the feature, the customer will receive a voice announcement stating that Call Return has been accessed. In addition, the announcement will provide the Directory Number (DN) of the last incoming call. In some locations, the date and time of receipt of the call will also be provided. The Call Return user will then be prompted to enter an additional digit to continue with the feature activation, or to hang up to abort the activation. If the called line is not busy, the call is placed. If the called line is busy, a confirmation announcement is heard, the customer hangs up and a queuing process begins. For the next 30 minutes, both the calling and called lines are checked periodically for availability to complete the call. If during this queuing process the called line becomes idle, the customer is notified, via a distinctive ring, that the network is ready to place the call. When the customer picks up the telephone the call will automatically be placed. In some locations, due to technological limitations, Call Return must be purchased with Repeat Dialing. This feature is not available on operator handled calls. In connection with Call Return, the Company will deliver all numbers, subject to technical limitations, including telephone numbers associated with Non-Published Listing Service. If the last incoming call originated from a telephone where delivery of the number was suppressed, via per line blocking, that number will not be available for voicing-back to the Call Return customer. If the incoming call is from a caller served by a PBX, only the main number of the PBX is transmitted and available for voice-back. If the incoming call is from a RingMaster service customer, the telephone number transmitted and available for voice-back will be the main Directory Number rather than any dependent RingMaster service number. If the incoming call originates from a multi-line hunt group, the telephone number transmitted and voiced-back will always be the main number of the hunt group, unless the telephone numbers are TN identified within the group. This feature is available, facilities permitting, to residence and business customers as follows: (a) monthly subscription, or (b) per activation/occasion. If the customer subscribes to the feature on a monthly basis, unlimited access is provided with no additional charge for each activation. Where facilities permit, the feature may be utilized on a non-subscription basis with a per occasion charge for each activation. Access to the usage option can be restricted at the customer's request at no charge. B. A113.18.1 General A. 976 Service consists of a special arrangement for subscriber use to provide announcement and recorded program services within the local calling scopes of the Atlanta and Savannah exchanges. The subscriber may apply a charge to its client for announcements or services delivered in response to calls to a 976 number. The Company will bill these charges on behalf of the subscriber and apply a charge to the subscriber for transport and billing of the call. A "client" of the subscriber is defined to be: The calling party when 976 charges are applicable for Company originated and transported calls, or The appropriate interexchange carrier when 976 calls are delivered by said carrier to a local 976 number. A "subscriber" to 976 Service provides information to the calling public by means of recorded announcements and may apply a charge to its client for announcements or services delivered in response to: Each local call completed to the subscriber's program from flat rate or certain message rate telephones. Each Company originated and transported intralata toll or WATS call completed to the subscriber's program. Each Optional Extended Area Service (OEAS) call completed to the subscriber's program. Each call delivered by an interexchange carrier to the subscriber's program. The Company agrees to provide billing on behalf of the subscriber. The subscriber is responsible for provision of service as described following. The Company will produce a record of the number of calls completed and billed to clients of the subscriber for each 976 telephone number and will issue a remittance check to the subscriber based on the difference between his charge for the billed call and the Company's charge to the subscriber, less uncollectable billing from prior periods. No charge for a 976 call will be made by the subscriber, and no remittance will be made to the subscriber, for calls originating from mobile telephone stations within the local calling area. Where facilities permit, no calls will be permitted to a 976 number from pay telephones or four-party stations. No customer dialed operator assisted calls will be permitted to be placed to a 976 number and no third party or collect toll calls will be permitted to be billed to a 976 number. 976 Service will be provided under the following conditions: 1. The subscriber shall provide, via the 976 Network, continuous, uninterrupted automatic announcement and recorded program services. The customer-provided equipment will allow access to an announcement message by a calling party within a maximum of 30 seconds. This equipment will provide each call, an off-hook condition (answer supervision) at the beginning of each call and an on-hook condition (disconnect supervision) upon completion of a full announcement cycle time duration. 2. Subscriber sponsorship of any particular announcement or recorded program service shall not preclude another subscriber from sponsoring the same or similar announcement. 3. For network sizing and protection, each subscriber must provide an estimate of annual call volumes, the expected busy hour and busy hour call volumes, and holding time for each announcement. The provision of access to the 976 Network by the Company for the transmission of announcement or recorded program services is subject to availability of such facilities and the requirements of the local exchange and toll network. In no event shall the Company be liable for any losses or damages of any kind resulting from the unavailability or failure of its equipment or facilities or for any act, omission or failure of performance by the Company, or its employees, or agents, in connection with this Tariff. The Company shall not be responsible for calls that cannot be completed as a result of repair or maintenance difficulties on Company facilities and equipment nor on equipment owned by the subscriber. 5. The location of the central office providing 976 Service in any exchange is entirely the selection of the Company. 6. A written notice will be sent to any subscriber following oral notification when their service unreasonably interferes with or impairs other services rendered to the public by the Company or by other subscribers of 976 Service. If after notification the subscriber makes no modification in method of operation or in the service arrangements that are deemed service-protective by the Company, or if the subscriber is unwilling to accept the modifications, or if the subscriber continues to cause service impairment, the Company reserves the right, at any time without further notice, to institute protective measures, up to and including termination of service. In an emergency situation as defined by the Company, the Company reserves the right to discontinue service without advance notice. 7. The subscriber assumes all financial responsibility for all costs involved in providing announcement or recorded program services including, but not limited to, the recorder-announcement equipment, producing the recordings, advertising and promotional expenses. 8. The subscriber assumes, according to other specific rates and charges under tariff, all financial responsibility for all facilities required to connect the recorder-announcement equipment located on the subscriber's premises to the Central Office which serves the 976 Service central office (NNX) code. 9. The holding time for each recorded announcement shall not exceed 60 seconds or one complete cycle of a 60 second message unless otherwise stated and agreed upon by both parties. If the agreed upon holding time does exceed 60 seconds, the subscriber will pay the additional holding time rate. The subscriber must notify the Company at least 30 days in advance if the holding time is to be increased or decreased and such change shall start at the beginning of the next month following the expiration of the 30 days notice. 10. The Company will issue a remittance check each month to each subscriber based upon the total revenue billed to clients of the subscriber less the Company's per call charges as specified in A13.18.2.A.2 and A.3 following. The Company reserves the right to require a deposit, advanced payment and/or withold portions of the remittance based on the history of collectability of the vendor's service. Remittance will be made to the vendor within a period of time based on studies which determine the average number of days of cash float on billed revenue. This shall not exceed 45 days from the last day of the month in which the calls were billed to the clients. The Company report of the number of local calls completed to each 976 program will serve as the sole document upon which remittance will be made. The Company will not be liable for incorrect counts of completed calls resulting from lost or damaged tapes or program failures. The remittance will be adjusted to reflect uncollectable billing of 976 calls from prior billing periods. In the event the Company's charges for calls exceed the revenue from billed calls, the subscriber will be liable for payment of the difference to the Company. Nonpayment of the 976 call billing to the caller shall not be cause for denial or termination of exchange telephone service. 11. One directory listing is furnished per 976 number, without additional charge, in the alphabetical section of the serving exchange's directory. Rates and regulations as identified in the Directory Listings section of this Tariff will also apply. 12. The Company reserves the right to provide to the general public, upon specific request, the complete address and telephone number of the subscriber in response to inquiries and comments referring to subscriber services.

The subscriber has exclusive responsibility and control over the content, quality and characteristics of speech used in recorded or computer generated messages; the Company assumes no liability for the quality of, defects in, or contents of, such messages. The subscriber shall exclude from such messages or announcements any matter, the dissemination of which is prohibited by law, contains matter which implicitly or explicitly invites, describes, simulates, excites, arouses, or otherwise refers to sexual conduct, or which contains sexual innuendo which may arouse or attempt to arouse sexual desire. The dissemination of such messages by the subscriber shall be grounds for immediate discontinuance of their subscriber service and the Company shall have no liability to anyone as a result of its action in this regard. 14. The subscriber is responsible for obtaining all necessary permission, licenses, written consents, waivers and releases and all other rights from all persons whose work, statements or performance are used in connection with the service, and from all holders of copyrights, trademarks and patents used in connection with said service. 15. The subscriber shall be liable for, and shall indemnify, protect, defend and save harmless the Company against all suits, actions, claims, demands and judgments, of all costs, expenses and counsel fees incurred on account thereof, arising out of and resulting directly or indirectly from the Service or in connection therewith, including, but not limited to, any loss, damage, expense or liability resulting from any infringement or claim of infringement, of any patent, trademark, copyright, or resulting from any claim of libel and slander. 16. The subscriber is responsible for informing potential callers that a call to their 976 announcement or recorded program telephone number will be at the charge the subscriber establishes and will be billed by the Company for calls from within the local calling area of the serving exchange or for Company originated and transported intralata calls; further that the Company will bill normally applicable rates for calls from outside the local calling area. The subscriber must notify the Company at least 30 days in advance if the call charge is to be increased or decreased and such change shall start at the beginning of the next month following the expiration of the 30 days notice. 17. Suspension of Service as covered in Section A2 of this Tariff is not applicable for this service. 18. If service is disconnected, all remittance money due to the sponsor may be credited or applied to the final bill issued for the recurring charges associated with this Tariff, or, to the final bill for the facilities leased to connect the recorder-announcement equipment to the serving Central Office. 19. The designation of Call Numbers, as defined in the General Regulations (Section A2.) of this Tariff, applies for this service. Customer requests for a specific telephone number are granted at the time of Service Order application providing the requested telephone number is available, i.e., unassigned, ready to be assigned and no equipment limitations exist. Requests for a specific telephone number will be honored on a first-come, first-served basis based on the application date of the Service Order. Once a Call Number has been assigned, it will be held 60 calendar days for the 976 announcement service to begin. If service has not been established by the subscriber within 60 calendar days, the number will be made available by the Company for reassignment. As set forth in other sections of this Tariff, the customer has no proprietary right in any area code, Central Office designation, or line number. 20. Upon the termination of a 976 Service, the Call Number, at the sole discretion of the Company, may be reassigned upon request. 21. In addition to 976 Service, a subscriber may arrange for a Public Announcement information service over which he may furnish recorded information announcements concerning 976 Services. Calls to such a Public Announcement Service will not be billed to the caller on a per call basis but charges to the subscriber will be applied. 22. The Company will not bill on behalf of the subscriber more than $5.00 per call for any 976 program. 23. The subscriber must state at the beginning of each 976 Service call: "This call will cost you $. If you do not wish to incur this charge, hang up now." (hereinafter referred to as the "Cost Disclosure Message"). The Cost Disclosure Message must be given in eight (8) seconds and must be followed by a silent period of six (6) seconds within which the caller can hang up without being charged the 976 charge for the call. The 976 caller will in any event be liable for all applicable toll charges.

Subscribers may not use 976 Service for live voice arrangements, nor shall subscribers use their 976 service, directly or indirectly, in connection with any teleconferencing or live bridge service. This prohibition shall include but not be limited to the provision of any information during any 976 call the receipt of which would permit the caller to obtain access to any teleconference or live bridge call which is or may be taking place on another telephone number. 25. 976 Service is subject to any requirements specified under Network Facilities for use with Automatic Dialing and Announcing Devices (ADAD) specified in A13.24. 26. Unless otherwise specifically provided in this Tariff, the Company shall be authorized to disconnect any service provided to the 976 subscriber used in conjunction, directly or indirectly, with the 976 Service in violation of these procedures and specifications upon five (5) days written notice to the subscriber unless adequate written assurance is provided by the subscriber to the Company that the violation or violations will cease immediately and not be repeated. The Company is authorized to disconnect without notice for repeat violations, and as otherwise provided in this Tariff. B. 976 Service will be provided under the following regulations. 1. All advertising inviting the use of or in any way relating to 976 Service shall conform to and comply with the procedures and specifications contained herein as well as all other applicable tariff provisions, rules, ordinances, laws and statutes. 2. The procedures for advertising are as follows: a. Any advertising must be deployed initially at least by the date new service is to be established, or new service cannot begin. b. Advertising reflecting a new price must begin at least three (3) days in advance of a price change or the new price cannot go into effect. c. Price changes to existing service must be submitted to the Account Executive in writing at least thirty (30) days prior to the effective date of the price change and must take place on the first day of a given month. d. Advertising may be distributed in any form that the subscriber chooses, provided it complies with and conforms to the specifications contained herein. 3. No advertising shall be permitted which, in form or substance, does not allow for an audit trail which is verifiable independent of the subscriber for review and confirmation, at any given moment, of compliance with the procedures and specifications set out herein, as well as in other applicable tariff provisions. 4. Each advertisement shall inform potential callers of the name, address, and telephone number of the person responsible for the advertisement, the charge for 976 calls and that the charge will appear on the telephone bill from which the call is placed. This information shall be displayed with such clarity and prominence to permit it to be noticed and understood by prospective callers and in any event, the telephone number and per call charge shall be printed in type of the same size as that of the number being advertised. In order to ensure that callers will have an adequate opportunity to notice and understand the foregoing information, advertisements inviting the use of or in any way relating to 976 Service will, at a minimum, be conducted in compliance with the following media-specific specifications: a. Print Media - Notice of the charge for each 976 call and the fact of inclusion of this charge on the telephone bill, and the telephone number of the person responsible for the advertisement shall appear on the face of any printed material, in BOLD type (if BOLD type is permitted by the advertising medium; if BOLD type is not permitted, the same type as used in the remainder of the advertisement shall be used.) of a size no smaller than the largest type contained elsewhere in the advertisement. b. Audio or Verbal Media - Notice of the charge for each 976 call and the fact of the inclusion of the charge on the telephone bill, and the telephone number of the person responsible for the advertisement shall be stated once during audio or verbal advertisements of fifteen (15) seconds or less and twice when such advertisments exceed fifteen (15) seconds. This portion of the advertisment shall be broadcast at the same audio level and with the same diction and pace as the remaining portions of the ad.

In all other respects, the advertisement shall conform to the specifications for print advertisements and audio or verbal advertisement set out in sections a. and b. 5. In addition to complying with the procedures stated above and any and all other specifications relating to the advertisement of the charge and bill consequences associated with 976 Service, each subscriber shall comply with the following: a. The subscriber shall exclude from any advertisement any matter the dissemination of which is prohibited by law, contains matter which implicitly or explicitly invites, describes, simulates, excites, arouses, or otherwise refers to sexual conduct, or which contains sexual innuendo which may arouse or attempts to arouse sexual desire. The Company shall be authorized to disconnect any service provided to the 976 subscriber used in conjunction, directly or indirectly, with the 976 Service in violation of these procedures and specifications upon five (5) days written notice to the subscriber unless adequate written assurance is provided by the subscriber to the Company that the violation or violations will cease immediately and not be repeated. For calls (Sent-Paid) from flat and certain message rate lines within the local calling area of the serving exchange established by the subscriber, for Company originated and transported intralata toll or WATS calls terminating to 976 Service or for Optional Extended Area Service (OEAS) calls terminating to 976 Service, the charge per call will be established by the subscriber. Message rate usage charges will not be applicable to calls billed to the 976 charge. 2. For calls delivered to a local 976 number by an interexchange carrier, a charge per call will be billed to the interexchange carrier as authorized in Section E6.2.1 of the Access Service Tariff. 3. Calls from all telephones outside the local calling area of the serving exchange will be the appropriate toll, WATS, or Optional Extended Area Service (OEAS) rate for a call to the serving exchange in addition to the charges identified in B.1 or B.2 preceding. (M) A113.19 TouchStar Service (Obsoleted May 22, 1995, Type 4) Existing Caller ID - Multi-Line customers may retain their existing service as specified in this section of the Tariff if they so choose. However, if these customers want to change or add to their existing service, they will have to convert to Caller ID - Basic or Caller ID - Deluxe as specified in A13.19 of this Tariff. These conversions shall not be subject to service charges specified in Section A4. of this Tariff. All new customers desiring a TouchStar service calling information delivery feature will have to use A13.19 of this Tariff. A113.19.1 Definitions of Feature Offerings A. Caller ID - Multi-Line This feature allows residence and business customers with Rotary (Grouping) arrangements to receive and view on a display unit call related information on certain incoming telephone calls. The following information is transmitted to the Caller ID - Multi-Line customer and displayed on the called CPE during the first long silent interval of the ringing cycle: calling Directory Number, time of day (hours and minutes) the call was received, and date (month and day) the call was received. A service order is required to establish or discontinue Caller ID - Multi-Line. Subsequent to establishment, the feature can be activated and deactivated at the customer's discretion through the use of preassigned feature access codes. Any customer subscribing to Caller ID - Multi-Line will be responsible for the provision of a display device which will be located on the customer's premises. The installation, repair and technical capability of that equipment to function in conjunction with the features described herein will be the responsibility of the customer. The Company assumes no liability and will be held harmless for any incompatibility of this equipment to perform satisfactorily with the network feature described herein. If the incoming call is from a line equipped with RingMaster service, the telephone number transmitted will always be the main number rather than any dependent RingMaster service number.
