1 2016 Missouri VOTING RECORD YOUR LEGISLATORS VOTING RECORD ON SMALL BUSINESS ISSUES 2016 EDITION Floor votes by your state legislators on key small business issues are listed inside. The Voting Record does not reflect all elements considered by a lawmaker when voting, nor does it represent a complete profile of a legislator, but it can be a guide in evaluating a legislator s attitude toward small business. Many issues affecting small business are decided in committees and never make it to the floor of the House or Senate. Please thank those legislators who supported small business, and continue to work with those who have fallen short. 1. Missouri Tax Code (SB 15): This bill would establish a commission to study Missouri s tax code. A YES vote supports NFIB s position. Passed the Senate Department of Revenue Notification (SB 18): This bill requires the Missouri Department of Revenue to notify businesses when there is a change in the collection of sales tax. A YES vote supports NFIB s position. Passed the Senate Passed the House 142-2, with 17 not voting and 2 vacancies. 3. Medical Malpractice Reform (SB 239): This bill restores medical malpractice caps. A YES vote supports NFIB s position. Passed the Senate 28 2, with 4 not voting. Passed the House , with 10 not voting and 1 vacancy. 4. Restaurant Tax Relief (SB 336): This act relieves employers of liability to the Missouri Department of Revenue for any amount of under-reported tips by an employee. A YES vote supports NFIB s position. Passed the Senate 31 0, with 3 not voting. Passed the House 141 1, with 20 not voting and 1 vacancy. 5. Right to Work (HB 116 & 569): This bill would have enacted Right to Work in Missouri. A YES vote supports NFIB s position. Passed the Senate during the regular 2015 session. During 2015 Veto Session, with a vote of 96 63, with 1 not voting and 3 vacancies, the House failed to garner the 109 votes needed to override the Governor s veto. 6. Tax Clarification (HB 117): This bill spells out which entertainment establishments and events should be required to pay sales tax. A YES vote supports NFIB s position. Passed the House , with 7 not voting and 1 vacancy. 7. Unemployment System Reform (HB 150): This bill bases the number of weeks one can draw unemployment on the unemployment ratio. Restaurant Gratuity Changes (HB 517 & 754): This bill specifies that mandatory gratuities imposed at restaurants are not subject to sales tax. A YES vote supports NFIB s position. Minimum Wage/Local Preemption (HB 722): This bill would bar municipalities from banning plastic bags and also prohibit a local government from raising the minimum wage higher than that of the state or federal government. A YES vote supports NFIB s position. Passed the Senate Passed the House , with 10 not voting and 1 vacancy. 10. Expert Witness (SB 591): This bill would put Missouri in line with 40 other states and the federal government in using the Daubert Standard for expert witnesses. A YES vote supports NFIB s position. Collateral Source Rule (SB 847): This bill modifies provisions relating to the collateral source rule and provides that parties may introduce evidence of the actual cost, rather than the value of the medical care rendered.
