3 EXAMINATION AND CERTIFICATES 3 SASKATCHEWAN REGULATIONS 311/77 The Boiler and Pressure Vessel Act REGULATIONS RESPECTING EXAMINATIONS AND CERTIFICATES OF ENGINEERS AND FIREMEN 1 In these regulations: (a) INTERPRETATION Act means The Boiler and Pressure Vessel Act. (b) Approved unless otherwise stated, means approved by the chief inspector, and all other expressions shall have the same meaning as in the Act. 4 Nov 77 s1; 19 Feb 88 SR 9/88 s3. APPLICATION FOR EXAMINATION 2(1) Every candidate for an examination other than an examination for a fireman s certificate, shall make application in writing to the chief inspector on a form prescribed by the department, at least twenty one days prior to the examination, and shall submit, together with his application, references from the employer or employers in whose services he has acquired such experience as is necessary pursuant to these regulations to qualify him for such examination, and such references, also any other documentary evidence of his qualifications as may be required, shall be in such form as is prescribed by the department. (2) Where any false or misleading statement is made in an application or in a reference or other evidence of qualifications submitted by or on behalf of a candidate, the candidate may, in the discretion of the chief inspector, be disqualified, and if the discovery of such false or misleading statement is made after a certificate has been issued such certificate may, in the discretion of the minister, be cancelled. 3 A candidate for examination for a fireman s certificate may make application orally to an inspector. 4 Nov 77 s2. RE-EXAMINATION 4(1) (a) A candidate failing to pass the A or B parts of the examination for a first or second class engineer s certificate, shall not be examined again within a period of six months and shall before undertaking any further examination, show proof that he has had not less than three months additional experience. (b) Notwithstanding paragraph (a), if a candidate passed two papers in the A or B parts of the examination for a first or second class engineer s certificate he may be examined again after three months without additional experience.

4 4 EXAMINATION AND CERTIFICATES (2) A candidate who fails to pass the examination for a third, fourth, fifth class or refrigeration engineer s certificate shall, upon making application, be eligible for re-examination at any time after the expiration of three months from the date of the previous examination. (3) A candidate who fails to pass the examination for an engineer s special (provisional), fireman s or refrigeration operator s certificate, shall, on making application, be eligible for re-examination at any time after the expiration of one month from the date of the previous examination. 4 Nov 77 s4. GENERAL REQUIREMENTS 5 No applicant for an examination shall be permitted to undergo such examination unless his application has first been approved by the chief inspector or by an inspector designated for the purpose by the chief inspector. 4 Nov 77 s5. 6 Where a fee is prescribed in these regulations for any examination, the candidate shall pay such fee to the examining officer at the time of the examination. 4 Nov 77 s6. QUALIFICATIONS OF CANDIDATES 7(1) For the purposes of sections 8, 9 and 10 inclusive: (a) the expression shift engineer means regular employment of the candidate in a steam plant, in connection with the actual operation of steam boilers of the kilowatt rating specified or of major steam driven units directly connected therewith, while holding an engineer s certificate as specified and includes the shift engineer in charge of those operating in a lesser capacity; (b) the expression assistant shift engineer means an engineer who holds a certificate of competency under these regulations and who takes charge of a section of a steam plant under the supervision of a shift engineer; (c) the expression graduate engineer means an engineer who has graduated from any recognized university with a degree in mechanical engineering or equivalent; (d) the expression maintenance where used shall mean regular employment of the candidate in a steam plant in an approved capacity in connection with the installation, repair testing and control or maintenance of steam boilers and auxiliaries of the kilowatt rating specified or of steam equipment directly connected therewith. (2) For the purposes of sections 8 to 15 inclusive: (a) a candidate shall be deemed to have the experience prescribed by any of the said sections only if such experience has been acquired immediately prior to the date of his application or within such longer period as may be determined by the chief inspector to be reasonable;

5 EXAMINATION AND CERTIFICATES 5 (b) a boiler shall, unless the contrary is specifically provided, be deemed to be a high pressure boiler only if it is stationary, is equipped with a safety valve which is set to relieve at more than 100 kilopascals and is not used solely for heating purposes, and a steam plant shall be deemed to be a high pressure steam plant only if it is equipped with such boilers. 4 Nov 77 s7. FIRST CLASS ENGINEER S CERTIFICATE 8(1) Any person may be accepted as a candidate for examination for a first class engineer s certificate who is the holder of a valid second class engineer s certificate since the issue of that certificate: (a) has for a period of thirty months operated as chief engineer of a high pressure steam plant exceeding 5,000 kilowatts, or (b) has for a period of thirty months operated as a shift engineer in a high pressure steam plant exceeding 10,000 kilowatts, or (c) as an assistant shift engineer for forty two months has assisted in supervising all aspects of the shift operations in a high pressure steam plant having a capacity exceeding 10,000 kilowatts, or (d) has been employed for a period of fifteen months as specified in paragraphs (a) (b) or (c) and in addition is a graduate engineer, or (e) has been employed for a period for one half that specified in paragraphs (a) (b) or (c) and in addition has been employed for a period of thirty six months in an approved supervisory capacity on the design, construction, installation, repair, maintenance or operation of equipment to which the Act applies. (2) One year s credit in lieu of operating experience as specified in paragraphs (a) (b) or (c) will be granted on successful completion of an approved course in power engineering leading towards a first class engineer s certificate. (3) The examination shall be divided into two Parts, A and B, and a candidate: (a) may write the papers for both parts at the one time, or (b) may write the papers for Part A at any scheduled examination after he has obtained a second class engineer s certificate, and (c) may write the papers for Part B at a time subsequent to writing the papers for Part A and completion of the required operating experience. (4) The examination shall consist of questions relating to the subjects contained in the current reference syllabus as established by the chief inspector for the first class engineer s examination, and (a) Part A shall consist of four papers, and (b) Part B shall consist of four papers. (5) Candidates shall be allowed four hours to write each paper.

6 6 EXAMINATION AND CERTIFICATES (6) Where a candidate writes Part A and Part B of the examination at the same examination he must obtain not less than 60% of the marks for each paper and an average of 70% of the total marks. (7) Where a candidate writes Part A and Part B of the examination separately he must obtain not less than 60% of the marks of each paper and an average of 70% of: (a) the marks for Part A, and (b) when Part B is written, 70% of the total marks for Part A and Part B. (8) A candidate will not be required to be re-examined in any paper which he has received a mark not less than 70% of the total marks allotted for the paper. (9) The educational minimum requirements to qualify for a first class engineer s examination shall be at least a 50% standing in Physics 30 or 32, Mathematics 20 or 22 and English 20 or 23 or equivalent. 4 Nov 77 s8. SECOND CLASS ENGINEER S CERTIFICATE 9(1) Any person may be accepted as a candidate for examination for a second class engineer s certificate who is the holder of a valid third class engineer s certificate and since the issue of that certificate: (a) has for a period of twenty four months operated as chief engineer of a high pressure steam plant exceeding 1,000 kilowatts, or (b) has for a period of twenty four months operated as a shift engineer of a high pressure steam plant exceeding 5,000 kilowatts, or (c) has for a period of thirty six months operated as a shift engineer in a high pressure steam plant exceeding 1,000 kilowatts and not exceeding 5,000 kilowatts, or (d) has for 24 months operated as an assistant shift engineer in a high pressure steam plant exceeding 10,000 kilowatts, or (e) has been employed for a period of twelve months as specified in paragraphs (a), (b) (c) or (d) and in addition is a graduate engineer, or (f) has been employed for a period of one half that specified in paragraphs (a) (b) (c) or (d) and in addition has been employed for a period of twenty four months in an approved supervisory capacity on the design, construction, installation, repair, maintenance or operation of equipment to which the Act applies. (2) Nine months credit in lieu of operating experience will be given on successful completion of an approved course in power engineering leading towards a second class engineer s certificate.

7 EXAMINATION AND CERTIFICATES 7 (3) The examination shall be divided into two Parts, A and B, and a candidate: (a) may write the papers for both parts at the one time, or (b) may write the papers for Part A at any scheduled examination after he has obtained a third class engineer s certificate, and (c) may write the papers for Part B at a time subsequent to writing the papers for Part A and completion of the required operating experience. (4) The examination shall consist of questions relating to the subjects contained in the current reference syllabus as established by the chief inspector for the second class engineer s examination and (a) Part A shall consist of three papers, and (b) Part B shall consist of three papers. (5) Candidates shall be allowed four hours to write each paper. (6) Where a candidate writes Part A and Part B of the examination at the same sitting he must obtain not less than 60% of the marks for each paper and an average of 70% of the total marks. (7) Where a candidate writes Part A and Part B of the examination separately he must obtain not less than 60% of the marks of each paper and an average of 70% of: (a) the marks for Part A, and (b) when Part B is written, 70% of the total marks for Part A and Part B. (8) A candidate will not be required to be re-examined in any paper in which he has received a mark not less than 70% of the total marks allotted for the paper. (9) The educational minimum requirements to qualify for a second class engineer s examination shall be at least a 50% standing in Science 20 or 22, Mathematics 20 or 22 and English 20 or 23 or equivalent. 4 Nov 77 s9. THIRD CLASS ENGINEER S CERTIFICATE 10(1) Any person may be accepted as a candidate for examination for a third class engineer s certificate who is the holder of a valid fourth class engineer s certificate and since the issue of that certificate: (a) has for a period of one year operated as chief engineer of a high pressure steam plant exceeding 500 kilowatts, or (b) has for a period of one year operated as a shift engineer of a high pressure steam plant exceeding 1,000 kilowatts, or (c) has for a period of one year operated as an assistant shift engineer in a high pressure steam plant exceeding 5,000 kilowatts, or

8 8 EXAMINATION AND CERTIFICATES (d) has for a period of twenty four months operated as chief engineer or shift engineer in a low pressure steam plant of not less than 3,000 kilowatts, or (e) has been employed for a period of one half that specified in paragraphs (a) (b) (c) or (d) and in addition has been employed for a period of twelve months in an approved capacity on the design, construction, installation, repair, maintenance or operation of equipment to which the Act applies. (2) A graduate engineer who has accumulated not less than six months experience in the operation of a high pressure steam plant exceeding 1,000 kilowatts may be accepted as a candidate for a third class examination. (3) Six months credit in lieu of operating experience will be given on successful completion of an approved course in power engineering leading towards a third class engineer s certificate. (4) The examination shall consist of questions relating to the subjects contained in the current reference syllabus as established by the chief inspector for the third class engineer s examination. (5) To qualify for a third class engineer s certificate a candidate must receive sixty per cent of the total marks allotted for the examination. (6) A third class examination shall consist of four papers and a candidate will not be required to be re-examined in any paper in which he has received a mark of not less than 60% of the total marks allotted for the paper. (7) The educational minimum requirements to qualify for a third class engineer s examination shall be at least a 50% standing in Physics 10 or 12, Mathematics 10 or 12 and English 10 or 13 or equivalent. 4 Nov 77 s10. FOURTH CLASS ENGINEER S CERTIFICATE 11(1) Any person may be accepted as a candidate for a fourth class engineer s certificate who: (a) has for a period of one year operated a high pressure boiler having a capacity of not less than 250 kilowatts, or (b) has for a period of one year assisted in the operation of a high pressure boiler having a capacity of not less than 1,000 kilowatts, or (c) is the holder of a valid fifth class engineer s certificate and has for a period of two years operated as chief engineer in a low pressure plant of not less than 750 kilowatts, or (d) is the holder of a valid fifth class engineer s certificate and has for a period of two years assisted in the operation of a low pressure plant of not less than 1,500 kilowatts, or (e) has successfully completed a vocational course in power engineering approved by the chief inspector, or (f) is a graduate engineer, or

9 EXAMINATION AND CERTIFICATES 9 (g) has been employed for a minimum period of not less than one half that specified in paragraphs (a) and (b) and in addition has been employed for a period of twelve months in an approved capacity on the design, construction, installation, repair, maintenance or operation of equipment to which the Act applies. (2) Six months credit in lieu of operating experience will be given on successful completion of an approved course in power engineering leading towards a fourth class engineer s certificate. (3) To qualify for a fourth class engineer s certificate a candidate must receive sixty percent of the total marks allotted for the examination but if he receives fifty per cent of the total marks allotted he may be granted a fifth class engineer s certificate. (4) The examination shall consist of questions relating to the subjects contained in the current reference syllabus as established by the chief inspector for the fourth class engineer s examination. (5) The fourth class examination shall consist of two four hour papers. 4 Nov 77 s11. FIFTH CLASS ENGINEER S CERTIFICATE 12(1) Any person may be accepted as a candidate for examination for a fifth class engineer s certificate who has attained the age of seventeen years, and has been issued a valid fireman s certificate for one year and has during the possession of such certificate been in charge or a boiler or plant having a capacity of not less then 300 kilowatts or a high pressure boiler having a capacity of not less than 50 kilowatts or has assisted in the operation of a boiler or plant having a capacity of not less than 1,000 kilowatts. (2) To qualify for a fifth class engineer s certificate a candidate must receive 60% of the total marks allotted for the examination. 4 Nov 77 s12. SPECIAL (PROVISIONAL) CERTIFICATE 13 Any person may be accepted as a candidate for examination for an engineer s special (provisional) certificate who has attained the age of eighteen years and satisfies an inspector that he has sufficient knowledge of and experience in the operation and maintenance of boilers and related equipment and that he will be employed directly in the operation of a boiler or plant for which an operator holding such a certificate is required. 4 Nov 77 s13.

10 10 EXAMINATION AND CERTIFICATES FIREMAN S CERTIFICATE 14(1) Any person may be accepted as a candidate for examination for a fireman s certificate who has attained the age of sixteen years and satisfies an inspector that he has sufficient knowledge of and experience in the operation and maintenance of boilers and related equipment and that he will be employed directly in the operation of a heating boiler or plant for which an operator holding such certificate is required. (2) To qualify for a fireman s certificate a candidate must receive 60% of the total marks allotted for the examination. 4 Nov 77 s14. REFRIGERATION ENGINEER S CERTIFICATE 15(1) Any person may be accepted as a candidate for examination for a refrigeration engineer s certificate who has attained the age of eighteen years, and: (a) has for a period of twelve months operated or assisted in the operation of a refrigeration plant having a capacity of not less than three tonnes of refrigeration per twenty four hours, or (b) is the holder of a first, second, third, fourth or fifth class engineer s certificate. (2) To qualify for a refrigeration engineer s certificate a candidate must receive 60% of the total marks allotted for the examination. 4 Nov 77 s15. REFRIGERATION PLANT OPERATOR S CERTIFICATE 16(1) Any person may be accepted as a candidate for examination for a refrigeration plant operator s certificate who has attained the age of eighteen years, and: (a) has graduated from a refrigeration plant operator s course as conducted by the Kelsey Institute of Applied Arts and Sciences, Saskatoon, or its equivalent. (2) To qualify for a refrigeration plant operator s certificate a candidate must receive 60% of the total marks allotted for the examination. 4 Nov 77 s16.

11 EXAMINATION AND CERTIFICATES 11 EXAMINATIONS Conduct of Examinations 17(1) Every examination, other than an examination for a fireman s certificate or for an engineer s special (provisional) certificate, shall be written, and an examination for a fireman s certificate or an engineer s special (provisional) certificate shall be written or oral or both at the discretion of the examining inspector. (2) A candidate for an examination, other than an examination for a first or second class engineer s certificate may, with the approval of the chief inspector or the examining inspector use the services of an amanuensis, provided that such amanuensis first executes a statement, verified by statutory declaration, that he or she has no special knowledge of the subject matter in respect of which the candidate is being examined. 4 Nov 77 s17. 18(1) A candidate may during an examination refer to the Act, any regulations may thereunder, any C.S.A. Standard, the Codes of the American Society of Mechanical Engineers, table of logarithms, decimal equivalents, steam tables, a slide rule, a calculator and any other similar material which the examining inspector may approve, but may not refer to any text book, notebook or any part of a course of instruction in engineering. (2) The candidate shall request the examining inspector prior to the examination to examine all material to which he wishes to refer and the inspector s decision as to whether the candidate may use such material shall be final. (3) Any candidate who during an examination refers to material which has not been first approved by the inspector may be disqualified. 4 Nov 77 s18. 19(1) Every candidate shall, on the completion of the examination or any part thereof, surrender to the examining inspector all papers used in the examination, including scrap or scribble paper. (2) A certificate shall not be issued to any candidate who removes or copies with intent to remove from the examination room any question given in the examination and the minister may, upon the recommendation of the chief inspector, cancel any certificate issued prior to the discovery of such removal or intended removal. 4 Nov 77 s19. NATURE OF ANSWERS 20(1) When answering any question involving mathematical calculations, the candidate shall show, in addition to the final answer the formula used, the various steps involved in arriving at the solution and all necessary explanations, and no credit shall be given for any question where only the final answer is shown. (2) Where answers to questions are of an explanatory nature, such explanations shall be complete and cover all points asked. 4 Nov 77 s20.

12 12 EXAMINATION AND CERTIFICATES CERTIFICATE Issue of Certificates 21(1) Upon the recommendation of the chief inspector and subject to the provisions of the Act and these regulations the department shall issue a first, second, third, fourth, fifth class, refrigeration engineer s, refrigeration plant operator s or fireman s certificate to every candidate who obtains the marks as outlined in the previous sections as required for the different candidates. (2) Where in any examination a candidate obtains less than the marks referred to in subsection (1), the department may, in the discretion of and subject to the recommendation of the chief inspector, issue to such candidate a certificate one class lower than that for which he was examined. 4 Nov 77 s A special certificate, as provided for in section 30 of the Act, may be issued to a candidate for a third class, fourth class, or fifth class engineer s certificate who has, in two successive examinations conducted within a period of twelve months, obtained less than 60 percent, of the possible marks but has obtained such marks as deemed necessary by the chief inspector to justify the issue of the special certificate. 4 Nov 77 s22. 23(1) A first, second, third, fourth or fifth class engineer s certificate, refrigeration engineer s certificate or refrigeration plant operator s certificate described in section 25 of the Act is valid for a period of one year commencing on the date of issue of the certificate. (2) The holder of a certificate mentioned in subsection (1) shall: (a) if his certificate has not been registered pursuant to this section, apply, in the manner prescribed in this section, not later than seven days before the expiry of the period mentioned in subsection (1), apply for registration of that certificate; (b) if his certificate has been registered pursuant to this section, apply, in the manner prescribed in this section, not later than seven days before the expiry date stated in his registration certificate, for renewal of registration of his or her certificate; (c) if the registration of his certificate has been renewed pursuant to this section, apply, in the manner prescribed in this section, not later than seven days before the expiry date stated in the renewal of his certificate, for further renewal of registration of his certificate. (3) The holder of a certificate who applies for registration or renewal of registration pursuant to subsection (2) shall: (a) apply on a form supplied by the department; and (b) forward to the department the fee prescribed for the certificate that is prescribed in The Boiler and Pressure Vessel Fees Regulations, 1981.

13 EXAMINATION AND CERTIFICATES 13 (4) On receipt of a completed application form and fee from an applicant and where: (a) the department is satisfied that the information furnished by the applicant is complete and accurate; (b) neither the certificate of the applicant nor the registration of his certificate has been cancelled, suspended or recalled pursuant to section 34 of the Act; and (c) if the registration of the applicant s certificate has expired, the period of expiry does not exceed five years from the date of the expiry; the department shall register or renew the registration of the certificate of the applicant, as the case may require, and issue to the applicant a registration certificate. (5) The department shall issue a registration certificate or a renewal of a registration certificate mentioned in subsection (4) for the period, not exceeding five years, that is determined by the chief inspector and the registration certificate or renewal, as the case may be, shall indicate that the certificate is registered for that period, and specify the expiry date of the certificate. (6) Notwithstanding subsections (3) and (5), a holder of a certificate mentioned in subsection (1) who is 65 years of age or older may apply to the department for a lifetime registration certificate without paying a fee. (7) On receipt of an application pursuant to subsection (6) and where the chief inspector is satisfied that it is appropriate to do so, the department may issue a lifetime registration certificate to the holder. (8) If the registration of a certificate mentioned in subsection (1) has expired, the holder may, within five years of the date of expiry, apply for renewal of registration, and subsections (3) and (4) apply mutatis mutandis to that application. (9) A registration certificate issued pursuant to subsection (8) is valid for a period not exceeding five years from the date on which the prior registration expired. (10) The issue of a registration certificate pursuant to subsection (8) does not relieve the holder of liability for any offences committed pursuant to subsection 38(4) of the Act during the period between the expiry of his prior registration and the date of issue of this registration certificate. (11) If the registration certificate mentioned in subsection (1) has been expired for a period of five years or more, the holder is not eligible for renewal of his certificate unless he passes the examination prescribed in these regulations for a certificate of that class. 19 Feb 88 SR 9/88 s4. 24(1) A fireman s certificate issued on successful completion of the examination mentioned in section 14 is valid for a period of one year from the date of its issue. (2) A fireman s certificate issued pursuant to section 25 is valid for a period of five years from the date of its issue.

14 14 EXAMINATION AND CERTIFICATES (3) An engineer s special certificate is valid for a period of five years or for any shorter period that is indicated on the certificate. 19 Feb 88 SR 9/88 s4. 25(1) The holder of a fireman s certificate or an engineer s special certificate may, not later than seven days before the expiry of his certificate, apply for a new certificate of the same class. (2) Subsections 23(3) and (4) apply mutatis mutandis, to an application for a new certificate pursuant to subsection (1). (3) Notwithstanding section 24 and subsection (2), a holder of a fireman s certificate mentioned in subsection (1) who is 65 years or older may apply for a lifetime certificate of the same class without paying a fee and subsection 23(7) applies, mutatis mutandis, to that application. (4) Where: (a) a person fails to apply for a new certificate and pay the fee for the certificate as prescribed in The Boiler and Pressure Vessel Fees Regulations, 1981 within the time prescribed in subsection (1); and (b) the chief inspector considers it appropriate; that person shall undergo an examination prescribed in these regulations for a certificate of that class before he is eligible to be issued a new certificate. 19 Feb 88 SR 9/88 s If a final or temporary certificate is cancelled by the minister pursuant to section 34 of the Act, that person is not eligible to be issued a new certificate unless he again passes the examination prescribed in these regulations for certificates of that class. 19 Feb 88 SR 9/88 s4. DUPLICATE CERTIFICATES 26 Where a valid certificate is lost, destroyed or defaced, the department shall issue to the holder a duplicate of such certificate upon receiving an application therefore on a form prescribed by the department together with the prescribed fee and proof of the applicant s identity. 4 Nov 77 s26. PERMITS IN URGENT CASES 27 Where the owner of a boiler, steam plant or refrigeration plant wishes a permit to be issued under section 29 of the Act, he shall apply therefor on a form prescribed by the chief inspector and shall submit the prescribed fee together with his application, and where he wishes a permit to be renewed, he shall submit an application together with the prescribed fee prior to the expiry date of such permit. No permit shall be granted to a candidate who has experience time to qualify for the higher class certificate and has made no attempt to do so.
