2 Deere Attachment FF April 13, 1999 Mr. Jack Leutza Director, Telecommunications Division California Public Utilities Commission 505 Van Ness Avenue, Room 3210 San Francisco, California Re: Results of 2PIC Customized Routing Trial for Lucent Switches Dear Mr. Leutza: Ordering Paragraph ( O.P. )12 of Decision requires that within 30 days of the technical workshop, Pacific must conduct any necessary technical trials of switching Options B and C, including the 2PIC element of Option C, and provide the results of the trials with the Director of the Telecommunications Division no later than 30 days after conclusion of the technical trials. After the conclusion of the technical workshops in February 1999, Administrative Law Judge Jacqueline A. Reed issued a ruling ( Ruling ) dated March 2, In the Ruling, she acknowledged that the parties at the workshop had discussed a test plan for the trial of 2PIC customized routing for Lucent switches. She noted that the plan was satisfactory to all parties and that the plan had been modified to include changes suggested by the parties. Ruling, p.4. The Ruling adopted the test plan and required that it be conducted within the timeframe of O.P Pacific completed the trial as defined in the test plan within the timeframe required by O.P. 12. The results of the trial consist of three attachments: Attachment 1 is a summary of the results, Attachment 2 is the completed test scripts, and Attachment 3 consists of the switch outputs. Attachment 3 is proprietary to Pacific and is submitted to you and Ms. Jones pursuant to General Order 66-C and to Mr. Stover and Ms. Rogers under the terms of the nondisclosure agreement which has been executed between the parties. Although the trial demonstrated 2PIC customized routing is feasible in Lucent switches, it is important to understand the potential effect of the use of this type of customized routing on access charges. CLECs can use unbundled loops, switching (including customized routing), and transport to provide local service to their end users. If the CLEC is providing local service to an end user using unbundled switching and transport and that end user originates an intralata call, the CLEC will pay UNE rates, instead of access rates, for the originating end of the call. CLECs must still pay originating access charges to Pacific when they do not provide local service to the end user originating the intralata call. If an intralata call terminates to an end user served by the same CLEC providing local service to the originating end user, then the CLEC will pay UNE rates instead of access rates for the terminating end of the call. If the call terminates to a facilitiesbased CLEC, then charges as agreed to by the two CLECs will apply. If a CLEC end user, who is served with unbundled elements, originates a call terminating to another CLEC end user, who is also served using unbundled elements, then Pacific will bill the first CLEC UNE rates for the originating end of the call and will bill the second CLEC UNE rates for the terminating end of the call. Finally, the CLEC will pay Pacific terminating switched access charges for the transport and termination of intralata calls to a Pacific end user or to a Pacific resold line. It is appropriate that terminating access charges continue to apply because the call terminates on Pacific s network and Pacific s intrastate access charges are its Commission-authorized wholesale charges to transport and terminate interexchange calls. 1 The Ruling actually stated the filing must be made in accordance with O.P. 2. Pacific believes this is a clerical error because O.P. 2 deals with CPNI and the timeframes for technical trials are set forth in O.P. 12. WD Attachment FF-1
3 The key to understanding assessment of UNE and access charges is that the correct rates must be applied to the originating and terminating portions of each call. The FCC s First Report and Order and the Shared Transport Order indicate that Pacific should assess switched access charges for the originating and/or terminating portion of the call depending on whether the CLEC is serving the originating and/or terminating end user. See First Report and Order, 363, fn. 772, and Shared Transport Order, 52. The use of UNEs by CLECs to carry intralata toll calls for their end users will allow CLECs to pay UNE rates instead of access rates for specific local portions of intralata calls depending on whether the CLECs serve the originating and terminating end users. Pacific is providing this information to you so that there is no misunderstanding concerning its views on the appropriate pricing, subject to future Commission determinations in pending proceedings. Also, under a recent Supreme Court decision, AT&T Corporation v. Iowa Utilities Board, 119 S. Ct. 721 (1999), there will necessarily have to be further determinations as to UNEs Pacific might be required to provide to CLECs and the appropriate pricing for any such UNEs. Pacific hereby reserves its rights with regard to these matters as they apply to 2PIC customized routing and unbundled transport. 5 5ESS INTRALATA TOLL PIC2 CUSTOM ROUTING TECHNICAL TESTING Scope of Test Executed To validate translation configurations designed to support custom routing of direct dialed intralata toll calls in a post-pic2 environment. The translation configurations tested were based on an assessment of PIC2 technology capabilities for custom routing provided by Lucent, the supplier of the 5ESS switch.
