2 Appendix A: Routes through which schools can open since 1 February 2012 Since the commencement schedule 11 the Education Act 2011, a number changes to the above have occurred: EIA 2006 section 6A (as introduced by EA 2011 schedule 11 paragraph 2) requirement to seek proposals for establishment new Academies. If a local authority in England think a new school needs to be established in their area, they must seek proposals for the establishment an Academy (specifically, a Free School). EIA 2006 section 7 (as amended by EA 2011 schedule 11 paragraphs 3 and 10) competition. As before, but now requires consent the Secretary State to run which will not be given unless section 6A has already been followed. Furthermore, it is now up to the Secretary State to decide any Academy proposals before others are considered. Only if the Secretary State rejects all Academy proposals, or directs that other proposals are to be considered, are other proposals subsequently considered. Finally, the local authority can no longer be propose schools through this route (and so Community schools cannot be proposed through this section at all). EIA 2006 section 10 (as amended by EA 2011 schedule 11 paragraph 6) outside competition, with consent the Secretary State. VA schools can no longer be proposed through this route, as they can now be proposed through EIA 2006 section 11 instead. Furthermore, LAs can now only propose Community and Foundation schools through this section when the school will be providing education suitable only to the requirements persons above compulsory school age, or is to replace one or more maintained schools. VA schools can now be proposed through this route with no strings attached. LAs can now propose Community and Foundation schools through this section, but only if a section 7 competition is held, and no new schools are opened as a result.

13 Appendix D: Schools opening through section 482 sponsor-led Academies Approved by the Secretary State EduBase tells us that 153 sponsor-led Academies opened through section 482, from 25 May 2007 to its repeal on 29 July In fact, they all opened prior to the coalition government. Of these 153 schools: 23 are Christian, 19 are Church England, 1 is Roman Catholic, and 110 have no religious character. In addition, one Academy with a Steiner ethos opened during this period (it is designated as having no religious character). Rejected by the Secretary State The FOI for the number rejected by the Secretary State was itself rejected, as being too costly, so it is difficult to do further analysis on this list. 1 There were 203 Academies to open under Labour in total. 46 were prior to 25 May 2007, and four were subsequent to that date, but as a result competitions.
