4 ASEAN Economic Community In 2003, the ASEAN Leaders resolved that an ASEAN Community shall be established comprising 3 pillars: a) ASEAN Security Community b) ASEAN Economic Community c) ASEAN Socio-Cultural l Community End Goal Economic Integration - Establishment of single market & production base - Five core elements of single market (free flow of goods, services, investments capital and skilled labour) Element of free flow of goods - Initiatives include: Harmonisation of standards, technical regulations & conformity assessment requirements Mutual recognition of test reports and certifications 5 Presentation Outline Introduction to ASEAN ASEAN Economic Community ASEAN Technical Cooperation - ASEAN Good Regulatory Practice Guide - ASEAN Policy Guideline on Standards and Conformance - ASEAN Framework on MRAs Outcomes for MRA & GRP Measures 6 3

5 ASEAN Good Regulatory Practice Guide (1/2) GRP essential in implementing ASEAN Common Market e.g. Helps industry reduce cost with implementation of harmonised technical requirements based on GRP principles p e.g. ASEAN Cosmetic Directive (ACD) and ASEAN Harmonised Regulatory Regime for Electrical and Electronic Equipment (AHEEERR) Guide is tool to promote GRP to ASEAN regulators What s in the Guide? Covers principles of GRP Used in conjunction with ASEAN Policy Guideline on Standards and Conformance Provides approaches to regulatory management within ASEAN - Preparation, compliance to, review of technical regulations & consultation 7 ASEAN Good Regulatory Practice Guide (2/2) Preparation Use of Regulatory Impact Assessment (RIA) to ensure proper assessment of the need for a regulation Helps to promote widespread consultation with likely affected groups Results of the RIA are detailed in the Regulatory Impact Statement (RIS) which structures a regulatory proposal Compliance to Technical Regulations Provisions set out for deciding appropriate Conformity Assessment procedures to support monitoring compliance to technical regulations Review of Technical Regulations Provisions set out for the review of current regulations and vetting of new regulatory proposals Consultation Transparent regulation making process which includes allowing at least 6 months between publication and entry into force 8 4

6 ASEAN Policy Guideline on Standards and Conformance Guidelines for the harmonisation of standards, technical regulations & conformance assessment procedures Covers the following activities: - Harmonisation of standards, technical regulations & alignment of international practices - Development & implementation of sectoral MRAs - Promoting transparency (in line with the WTO TBT agreement) in: a) Development and application of standards b) Technical regulations c) Conformity assessment procedures - Enhance technical infrastructure and competency in lab testing 9 ASEAN Framework on MRAs ASEAN Member States are in various preparation stage to implement/develop sectoral MRAs Pharmaceutical Good Manufacturing Practice (GMP) MRA - ASEAN MRA on GMP of Inspection of Manufacturers of medicinal products signed in Impact: Inspections can be carried out by competent local inspection bodies resulting in cost savings for manufacturers. - Full implementation of the MRA by MRA for Automotive Products - 19 UNECE regulations have been identified for harmonisation within the MRA - Harmonisation Target Date: Draft MRA to be finalised by end Impact: Regulators will accept test reports & product certificates performed by competent & listed bodies located outside the member state MRA for Prepared Foodstuffs - MRA to be finalised and ready by 2014 MRA for Electrical Electronic Equipment - Acceptance of test reports (underpinned by APLAC MRA & IECEE CB Scheme) and certification (underpinned by PAC MRA & IECEE CB Full Certification Scheme) - Supports implementation of ASEAN Harmonised Electrical Electronic Equipment Regulatory Regime (AHEEER) 10 5
