5 The EXBS Program EXPORT CONTROL AND RELATED BORDER SECURITY The EXBS program is part of the U.S. government s response to UNSCR 1540 and supports its intent to prevent proliferation of Weapons of mass destruction, Missile delivery systems, Conventional weapons, and Related items by cooperating with other governments to establish and implement effective export and border control systems that meet international standards.
6 The EXBS Program EXPORT CONTROL AND RELATED BORDER SECURITY The EXBS program works bilaterally and multilaterally to improve export control capabilities in the following areas: Comprehensive Legal/Regulatory Frameworks that meet international standards in controlling exports and re exports; transits and transshipments; brokering and technology transfers Effective Licensing Procedures and Practices, including interagency coordination, development of national control lists, automated licensing systems, and end use/end user analysis Enforcement Techniques and Equipment that include inspection, interdiction, investigation, and prosecution Government Outreach to Industry and the public to improve awareness and compliance under national laws (also called for by UNSCR 1540) Interagency Coordination and cooperation between ministries (e.g., licensing and enforcement)
7 The EXBS Program EXPORT CONTROL AND RELATED BORDER SECURITY The EXBS program is engaged on 5 continents and in 64 countries in the Americas, Europe, Africa, Asia, and the Middle East The EXBS program has been active in the ASEAN region since EXBS partner countries include: Malaysia Singapore Indonesia Philippines Cambodia Thailand Vietnam
8 EXBS Activities Effective Licensing Practices & Procedures Jan 2012 Provided Applying Catch all Controls workshop to Malaysia. Feb 2012 Provided licensing workshop for Thai interagency sub committee on licensing Enforcement Techniques and Equipment Oct 2011 Prepared Thai Instructors to provide WMD Commodity Identification Training. Thailand can now provide full academy instruction without US assistance. May 2010 Through EXBS assistance, Indonesian Customs developed and established a Customs Intelligence and Targeting Center, modeled after the U.S. Customs National Targeting Center for Cargo and Passenger. This is the first of its kind among the ASEAN countries. Legal/Regulatory Frameworks Mar 2010 Provided technical assistance and legal consultations on international best practices as Malaysia authored its Strategic Trade Act of 2010.
9 Strategic Trade Controls-Achieving Trade Security-Trade Facilitation Balance Strategic Trade Controls Enhance Security Export Controls contribute to national, regional, and global security Support the multilateral nonproliferation and antiterrorism regimes Assist in ensuring the safety and security of supply chains and markets. Strategic Trade Controls Facilitate Trade Increases trust among trading partners Prevents abuse of legitimate commercial activities Enables more foreign investment Facilitates access to advance technologies
10 ASEAN Single Window A way to help ASEAN Community facilitate secured trade in Global Environment The ASEAN Single Window is a cornerstone of ASEAN s goal to achieve an ASEAN Economic Community by Trade facilitation has been a focus of the international supply chain within the WCO Framework of Standards to secure and facilitate trade (2006) SAFE Framework. Customs Administrations of several Member States of ASEAN signed the Letters of Intent to implement the SAFE Framework. ASEAN Member States are establishing National Single Windows (NSW) to enable the single submission of data for imports or exports that is quickly processed by all relevant agencies to provide expeditious decision making for customs clearance of cargo. The ASEAN Single Window (ASW) is an environment where the ten NSWs of individual ASEAN Member States operate and integrate.
11 ASEAN Single Window In addition to facilitating trade and helping integrate ASEAN economies, ASW will help improve border enforcement, including trade security, by allowing the electronic exchange of key cargo date between ASEAN Member States. This, however, will necessitate the effective use of risk management and targeting tools to make sense of the data. Trade facilitation enabled through the National Single Windows and the ASW architecture complements international trade security initiatives. The ASW seeks to promote trade facilitation in a globalized environment, but can also provide the means for improved trade security. Using the ASW for nonproliferation objectives would conform with ASEAN s existing commitments in implementing UNSCR 1540.
12 U.S. Role and Support for ASEAN Single Window The ASEAN Single Window Project is a five year USAID/US State Department funded program, to support and facilitate ASEAN integration. The ASW Project supports ASEAN s efforts through: Harmonizing transaction data and developing software applications to promote the electronic exchange of cargo clearance data; Developing legal frameworks necessary to support cross border exchanges of electronic data; Technical and legal capacity building, and providing limited support to the development of national single windows; and Promoting involvement of the private sector and the general public in ASW development.
