1 Plumbers, Gasfitters and Drainlayers Board (Plumbing Registration and Licensing) Notice 2010 Pursuant to sections 28 and 30 of the Plumbers, Gasfitters, and Drainlayers Act 2006 ( the Act ), the following notice is given. Notice 1. Title This notice may be cited as the Plumbers, Gasfitters and Drainlayers Board (Plumbing Registration and Licensing) Notice Commencement This notice comes into force on 1 April Plumbing registration and licensing Pursuant to sections 28 and 30 of the Plumbers, Gasfitters, and Drainlayers Act 2006, the Plumbers, Gasfitters and Drainlayers Board ( the board ) designates the classes of plumbing registration and prescribes matters relating to plumbing registration and licensing as set out in the Schedule of this notice. Schedule Plumbing classes of registration, authorised work for each class of registration, minimum standards for registration, and terms and conditions of licensing under the Plumbers, Gasfitters, and Drainlayers Act 2006 Part A Certifying Plumbers 1. Authorised work A certifying plumber, who holds a current certifying plumbing practising licence issued by the board: (a) may carry out sanitary plumbing (as defined in the Act); and (b) must be responsible for any supervision, testing and verification of the plumbing undertaken by: (i) licensed plumbers; (ii) holders of provisional licences ( provisional licensees ); (iii) trainee plumbers who hold limited certificates to undertake plumbing ( trainee plumbers ); and (iv) persons carrying out plumbing pursuant to section 19 of the Act ( exempt persons ). 2. Minimum standards for registration (1) To be registered as a certifying plumber a person must have:
2 (a) (b) held a licence as a licensed plumber (or as a registered plumber under the Plumbers, Gasfitters, and Drainlayers Act 1976 ( the 1976 Act )) for a continuous period of not less than two years under the supervision of a certifying plumber (or a craftsman plumber under the 1976 Act), and passed the three-hour certifying plumber examination (reference 9195) set by the board; or where applying on the basis of an overseas plumbing qualification: (i) submitted a completed registration application to the board that includes the following documentation: A. an international qualifications assessment from the New Zealand Qualifications Authority concluding that the applicant s plumbing qualification is equivalent to or greater than level 4 on the National Qualifications Framework; and B. unless the applicant has already been granted New Zealand residence, police certificates that are no older than 6 months from the applicant s country of citizenship (unless they can provide satisfactory evidence they have never lived there), and from any country the applicant has lived in for 12 months or more (whether in one visit or intermittently) in the last 10 years, that the board assesses as meeting its fit and proper person registration requirements; and C. evidence that the applicant has worked full-time in the plumbing trade for 6 years or more; and (ii) passed the board s advanced proficiency assessment (this practical assessment must be undertaken in New Zealand). (2) The certifying plumber examination, referred to above, will be set by the board so that to pass the examination an applicant demonstrates the ability to design, manage the installation of, and verify sanitary plumbing systems through possessing competencies in the areas of: (a) Trade calculations and trade science used in the design and installation of sanitary plumbing systems. Descriptors include, but are not limited to (i) estimation, measurement, and calculation using management systems; (ii) application of formulae including transposing; (iii) physics laws and their application as they relate to sanitary plumbing; (iv) hydraulic principles; (v) expansion and contraction; (vi) corrosion protection; (vii) water quality; (viii) density; (ix) energy transfer. (b) The selection of materials; their properties, applications, and how they are used in the design and specification of sanitary plumbing systems. Descriptors include, but are not limited to (i) compatibility, testing, and commissioning procedures; (ii) alternative materials, approval regimes, and protection of material.
3 (c) (d) (e) (f) (g) (h) (i) The drawings and specifications for sanitary plumbing. Descriptors include, but are not limited to, the preparation of plans and specifications. The design, specification, and verification of water services for sanitary plumbing systems. Descriptors include, but are not limited to (i) pipe sizing principles; (ii) hot and cold water reticulation systems; (iii) water storage systems; (iv) domestic fire sprinkler systems; (v) rain water harvesting; (vi) pumps; (vii) sanitary appliances and fixtures; (viii) backflow prevention; (ix) heating systems that relate to sanitary plumbing, including hot water systems, and solar water heating; (x) alternative water supplies. The design and specification of foul water systems for sanitary plumbing. Descriptors include, but are not limited to (i) principles of sizing and venting for foul water plumbing systems; (ii) pumps; (iii) sanitary appliances and fixtures; (iv) backflow prevention; (v) irrigation systems. Access to, and the application of, relevant documentation relating to sanitary plumbing to meet compliance requirements, and an understanding of the regulatory environment. Descriptors include, but are not limited to (i) Acts and Regulations; (ii) standards; (iii) codes; (iv) manufacturers instructions. Management of the effect on the integrity of structures relating to the design and installation of sanitary plumbing systems; including weather tightness consideration as they relate to penetrations to the building envelope and the coordination with other services. Descriptors include, but are not limited to (i) preservation of structural integrity; (ii) prevention of damage to property including weather tightness; (iii) positioning and protection of services along with the coordination with other building services. Responsibilities relating to managing health and safety. Descriptors include, but are not limited to health and safety systems, and the preparation of safety plans. Responsibilities relating to the oversight and/or supervision of persons who do, or assist in doing, sanitary plumbing work.
4 Transitional provisions (3) Any person who, at 4 July 2013, has passed the certifying plumber examination (reference 9195) set by the board, but has not passed the certifying common examination (reference 9194) that a person was required to pass from 1 April 2010 to 3 July 2013, is required to successfully complete one or more competence programmes focussed on assessing the competencies previously covered in the certifying common examination (reference 9194), as directed by the Registrar, before that person will be considered to meet the minimum standards for registration as a certifying plumber. (4) Any person who, at 4 July 2013, has passed the certifying common examination (reference 9194) that a person was required to pass from 1 April 2010 to 3 July 2013, but not the certifying plumber examination (reference 9195) set by the board, is required to pass the certifying plumber examination (reference 9195) set by the board before that person will be considered to meet the minimum standards for registration as a certifying plumber. 3. Terms and conditions of licence (1) To be eligible to be issued with a certifying plumber practising licence, an applicant must, during the licensing period concluding immediately before the licensing period for which the licence application is being made, have obtained a minimum number of continuing professional development ( CPD ) points ( CPD points ). (1A) Of the CPD points required by a certifying plumber for each licensing period, an applicant must have obtained at least 75% of the CPD points by successfully completing board-accredited CPD courses, and a maximum of 25% of the CPD points by completing self-directed learning, as set out in the following table: Practising licences Certifying plumber practising licence only Certifying plumber practising licence and one of the following certifying drainlayer practising licence licensed drainlayer practising licence certifying gasfitter practising licence licensed gasfitter practising licence Certifying plumber practising licence and two of the following certifying drainlayer practising licence licensed drainlayer practising licence CPD points required for each licensing period 12 CPD points, of which at least 9 points must be from boardaccredited CPD courses; and up to 3 points may be acquired through self-directed learning. 20 CPD points, of which at least 15 points must be from board-accredited CPD courses; and up to 5 points may be acquired through self-directed learning. 24 CPD points, of which at least 18 points must be from board-accredited CPD courses; and up to 6 points may be acquired through self-directed learning.
5 certifying gasfitter practising licence licensed gasfitter practising licence (1B) A board-accredited CPD course means any learning programme accredited by the board before a certifying plumber enrols in it. In exceptional circumstances, and at the discretion of the Registrar, the board may accept CPD points as being for board-accredited courses where the course was not accredited before the certifying plumber enrolled in it but where the Board subsequently accredited it. (1C) One hour of self-directed learning has the value of one (1) CPD point. The following are examples of activities which an applicant could claim as CPD points from self-directed learning: (a) attending seminars; (b) attending conferences; (c) reviewing published material; (d) presenting at conferences; (e) writing articles. (1D) All CPD points must be relevant to at least one (1) of the competencies prescribed for the trade or trades to which the application relates. Competencies means the competencies in the areas identified in: (a) paragraphs 2(2) and7(2) of this notice; (b) paragraphs 2(7) and 7(2) of the Plumbers, Gasfitters and Drainlayers Board (Drainlaying Registration and Licensing) Notice 2010; (c) paragraphs 2(2) and 7(2) of the Plumbers, Gasfitters and Drainlayers Board (Gasfitting Registration and Licensing) Notice (1E) Where an applicant is seeking to be licensed in more than one (1) trade, they must ensure that they have obtained some CPD points relevant to the competencies for each of those trades, and that those CPD points are from boardaccredited CPD programmes. (1F) CPD that does not relate to the competencies is not eligible to be counted as CPD points. (2) If, in any licensing period, a certifying plumber obtains more than the required number of CPD points from board-accredited courses, those additional points may be counted towards the CPD points for the next licensing period, but may not be counted towards the CPD points required for any subsequent licensing period. (2A) From time to time, the board may require certifying plumbers to undertake particular CPD courses. The CPD points obtained as a result of successfully completing board-required CPD will be regarded as being CPD points from boardaccredited CPD. (3) At all times when undertaking sanitary plumbing work, certifying plumbers must be able to produce, on demand, a current certifying plumber licence card issued by the board. (4) Where testing and verification is necessary to meet the requirements of the regulations under this Act, or the Building Act 2004, the certifying plumber is responsible for the testing and verification of the sanitary plumbing work carried out by licensed plumbers, provisional licensed plumbers, limited certificate trainee plumbers and persons exempt pursuant to section 19 of the Act, working under
6 their supervision. Where work is undertaken by exempt persons pursuant to section 19 of the Act, the certifying plumber must test and verify the work. (5) A certifying plumber must ensure that plumbing undertaken by persons under the supervision of that certifying plumber (which may include licensed plumbers, provisional licensees, trainee plumbers and exempt persons): (a) is performed competently; (b) is the subject of appropriate safety measures; and (c) complies with the requirements of the relevant regulations, including those regulations made pursuant to the Building Act (6) A certifying plumber must ensure that all persons under supervision: (a) are competent to perform the tasks they undertake; (b) are adequately supervised or overseen (as applicable); (c) comply with the relevant regulations, including the regulations made pursuant to the Building Act 2004; and (d) with respect to an exempt person and a trainee plumber, can produce on demand a current identification card issued by the board. (7) A certifying plumber must ensure that, during the first year of holding a limited certificate, a trainee plumber is at all times working in the presence of the supervising certifying plumber or a licensed plumber who is supervised by the same certifying plumber. (8) A certifying plumber must ensure that, during the first two years of working under an exemption pursuant to section 19 of the Act, the exempt person is at all times working in the presence of the certifying plumber supervising them or a licensed plumber who is supervised by the same certifying plumber or a person authorised pursuant to section 18 of the Act. (9) A certifying plumber must notify the board of the name, address and telephone number of every exempt person under supervision prior to the exempt person first carrying out any plumbing work under the certifying plumber s supervision and on or before 1 April each year. (10) A certifying plumber must pay a fee, as prescribed by the board, in respect of notified exempt persons under supervision. (11) A certifying plumber who ceases to supervise a person previously supervised by that certifying plumber must notify the board of this fact in writing. Until such notification is received, the certifying plumber remains responsible for any plumbing work undertaken by that supervised person. Transitional provision (12) The first date by which certifying plumbers are required to have obtained the CPD points so that they can be issued a certifying plumber practising licence for the following licensing period is 31 March Licence period The licence period is from 1 April to 31 March of the following year, provided that: (a) a licence is issued for a maximum period of one licensing year; (b) a licence issued after 1 April and before 31 March will expire at the end of that licence period, being 31 March.
7 5. Application forms The board must provide the following forms: (a) Application for registration as a certifying plumber; (b) Application for licence as a certifying plumber. Part B Licensed Plumbers 6. Authorised work A licensed plumber, who holds a current licensed plumber practising licence issued by the board, may carry out sanitary plumbing work under the supervision of a certifying plumber. 7. Minimum standards for registration (1) To become a licensed plumber a person must have: (a) obtained the National Certificate in plumbing and passed the board s three-hour examination (reference 9192); or (b) held a limited certificate in plumbing for a continuous period of five years and have passed the board s three-hour examination (reference 9192); or (c) held a limited certificate in plumbing under the 1976 Act for a continuous period of not less than three years, immediately followed by a two year period as a person exempt pursuant to section 19 of the Act, and have passed the board s three-hour examination (reference 9192); or (d) being a gasfitter (certifying or licensed and holding a current practising certificate), passed the National Certificate third stage block course in plumbing, and the board s three-hour examination (reference 9192); or (e) where the person is applying on the basis of an overseas plumbing qualification: (i) submitted a completed registration application to the board that includes the following documentation: A. an international qualifications assessment from the New Zealand Qualifications Authority concluding that the applicant s plumbing qualification is equivalent to or greater than level 4 on the National Qualifications Framework; and B. unless the applicant has already been granted New Zealand residence, police certificates that are no older than 6 months from the applicant s country of citizenship (unless they can provide satisfactory evidence they have never lived there), and from any country the applicant has lived in for 12 months or more (whether in one visit or intermittently) in the last 10 years, that the board assesses as meeting its fit and proper person registration requirements; and C. evidence that the applicant has worked full-time in the plumbing trade for 4 years or more; and (ii) passed the board s licensed plumber examination (reference 9192), which they may sit in their home country by arrangement with the board.
8 (2) The board s examination, referred to in paragraph 7(1), is set by the board so that, to pass the examination an applicant demonstrates knowledge, and the experience and practical ability to install, test, commission, fault-find, and maintain sanitary plumbing systems through possessing competencies in the areas of: (a) Trade calculations and trade sciences. Descriptors include, but are not limited to (i) estimation, measurement, and calculation using measurement systems; (ii) application of formulae; (iii) physics laws as they relate to sanitary plumbing; (iv) hydraulic principles; (v) expansion and contraction; (vi) corrosion protection; (vii) water quality; (viii) density; (ix) energy transfer. (b) Limitations in and the application of material used in sanitary plumbing, including material protection and jointing methods. Descriptors include, but are not limited to (i) copper; (ii) PVC; (iii) polybutylene (PB); (iv) polyethylene (PE); (v) mild steel; (vi) stainless steel; (vii) acrylonitrile butadiene styrene (ABS); (viii) polypropoylene; (ix) cross linked polyethylene; (x) brass/bronze (xi) cast iron; (xii) sheet metal; (xiii) lead; (xiv) glass; (xv) the use of tools and equipment. (c) Drawings and specifications for sanitary plumbing. Descriptors include, but are not limited to (i) interpreting plans and specifications; (ii) drawing as-built; (iii) development of patterns. (d) The installation, testing, commissioning, fault-finding and maintenance of water services for sanitary plumbing. Descriptors include, but are not limited to (i) pipe sizing principles; (ii) hot and cold water reticulation systems;
9 (e) (iii) (iv) (v) (vi) (vii) (viii) (ix) (x) water storage systems; domestic fire sprinkler systems; rainwater harvesting; pumps; sanitary appliances and fixtures; backflow prevention; heating systems that relate to sanitary plumbing, including hot water systems, and solar water heating; alternative water supplies. The installation, testing, commissioning, fault-finding and maintenance of foul water systems for sanitary plumbing systems. Descriptors include, but are not limited to (i) (ii) (iii) (iv) (v) principles of sizing and venting for foul water plumbing systems; pumps; sanitary appliances and fixtures; backflow prevention; irrigation systems. (h) Responsibilities relating to health and safety. Descriptors include, but are not limited to (i) personal and public safety; (ii) site safety; (iii) electrical safety; (iv) environmental considerations. (i) Limitations on persons who do, or assist in doing, sanitary plumbing work. Transitional provision (3) Any applicant who, at 4 July 2013, is already engaged in the registration process set out in the former paragraph 7(1)(e) that was in force up until 3 July 2013 must complete that process with the following exceptions: (a) Where the New Zealand Qualifications Authority has concluded that the applicant s overseas plumbing qualification is equivalent to or greater than level 4 on the National Qualifications Framework, the applicant is not
10 (b) required to attend an interview with the board to verify documentation and validate experiential and technical proficiency. The applicant is not required to sit or pass the board s Practical Test of Workmanship. 8. Terms and conditions of licence (1) To be eligible to be issued with a licensed plumber practising licence, an applicant must, during the licensing period concluding immediately before the licensing period for which the licence is made, have obtained a minimum number of continuing professional development ( CPD ) points ( CPD points ). (5) A licensed plumber must work at all times under the supervision of a certifying plumber, without having to be in the presence of that person. (6) A licensed plumber does not have the authority to test and verify that the sanitary plumbing work complies with the requirements of regulations under this Act or under the Building Act (7) A licensed plumber is authorised to oversee limited certificate trainee plumbers and exempt persons, but such persons must be supervised by the same certifying plumber. (8) A licensed plumber must ensure that when overseeing a trainee plumber in the first year of a trainee plumber holding a limited certificate, the trainee plumber works in the presence of that licensed plumber who is supervised by the same certifying plumber. However, at all times the certifying plumber is the person responsible for supervision. (9) A licensed plumber must ensure that when overseeing an exempt person in the first two years of working under an exemption issued pursuant to section 19 of the Act, the exempt person works at all times in the presence of that licensed
12 plumber who is supervised by the same certifying plumber or a person authorised pursuant to section 18 of the Act. Transitional provision (10) The first date by which certifying plumbers are required to have obtained the CPD points so that they can be issued a licensed plumber practising licence for the following licensing period is 31 March Licence period The licence period is from 1 April to 31 March of the following year, provided that: (a) a licence is issued for a maximum of one year; (b) a licence issued after 1 April and before 31 March will expire at the end of that licence period year (being 31 March). 10. Application forms The board must provide the following forms: (a) Application for registration as a licensed plumber. (b) Application for a licence as a licensed plumber. 11. Glossary of terms (1) Where the term supervision is used it refers to supervision as defined in section 4 of the Act. (2) Where the terms test or testing are used they refer to tests required to comply with the regulations under the Building Act 2004 and the Gas Act (3) Where the terms oversight or oversee are used they refer to the definition specified by the board. 12. Transitional provision Courses completed before 1 April 2010 may be allocated CPD points at the discretion of the Registrar of the board.
