APPLICATION OF STATEMENT OF RATES This statement of rates, originally submitted March 10, 2003 pursuant to OPUC Order No , entered February 5, 2003, is being revised in compliance with OPUC Order No This statement of rates may contain rates for (and/or reference) services, facilities, arrangements and the like that Frontier does not have an obligation to provide under 47 U.S.C. 251(c)(3). Notwithstanding any such rates (and/or references) and, for the avoidance of any doubt, nothing in this statement of rates shall be deemed to require Frontier to provide a service, facility, arrangement or the like that Frontier is not required to provide under 47 U.S.C. 251(c)(3), or to provide a service, facility, arrangement or the like upon rates, terms or conditions other than those that are required pursuant to 47 U.S.C. 251(c)(3). By way of example and without limitation of the foregoing, Frontier is not required to provide unbundled access to certain high-capacity loop and transport facilities out of wire centers that meet the applicable non-impairment criteria set forth in the regulations promulgated by the FCC pursuant to its Order on Remand, Unbundled Access to Network Elements; Review of the Section 251 Unbundling Obligations of Incumbent Local Exchange Carriers, WC Docket No , CC Docket No (FCC rel.
