1 CHURCH BROUGHTON PARISH COUNCIL PARISH COUNCIL MEETING HELD ON TUESDAY 5 TH JUNE 2018 Those present: Councillor Henderson-Chairman Councillor Spalton-Vice Chair Councillor I Redfern Councillor D Redfern Councillor Tylee SDDC Councillor Plenderleith DCC Councillor Patton 1 Parishioner In attendance: Helena Steeples-Clerk 33.0 APOLOGIES Apologies received from Councillor Wallis and SDDC Billings PUBLIC PARTICIPATION Parishioner attended asked if the Parish Council had heard the outcome of the planning application for the erection of extension and alteration to the Old Garden, Church Road, Church Broughton. Parishioner was advised that the Parish Council is not advised of the outcome of any planning applications and the last time the Parish Council checked on the SDDC website, no decision had been made REPORTS FROM DISTRICT & COUNTY COUNCILLORS & POLICE SDDC Councillor Plenderleith reported that the shed at Brandon s is being reviewed by Gaynor Richards at SDDC Planning Department. DDC Councillor Patten is to meet with highways regarding the poor condition of the junction of Sutton Lane and Hilton straight. Parish Councillors stated they were extremely concerned that the road repairs had not yet been conducted and the grass verges had not yet been cut. Farmers were thanked for cutting the verges at junctions to allow for clear lines of sight. It was noted that rubbish had been dumped on Bent Lane and this would be reported by SDDC and DCC Councillors. There was no indication if the retrospective planning application for agricultural building and access on Ashbourne Road had been approved. Councillors discussed the planning application for reg no 9/2018/0383 the erection of an amenity unit incorporating a kitchen, meeting room, bathroom and dining room on plot 1A Broughton Caravan Park, Sutton Road, Church Broughton TO RECEIVE & APPROVE REQUESTS FOR DISPENSATIONS FROM MEMBERS ON MATTERS IN WHICH THEY HAVE A DISCLOSURABLE PECUNIARY INTEREST None declared SIGN DECLARATION OF ACCEPTANCE OF OFFICE FORM Councillor Tylee completed form COMPLETE REGISTER OF MEMBERS INTEREST FORM Councillor Tylee completed his members of interest form MINUTES OF THE LAST MEETING
2 The minutes of the meeting held on Thursday 3 rd May 2018 were read, approved and signed. Proposed by Councillor D Redfern and seconded by Councillor Spalton MATTERS ARISING 40.1 RISK MANAGEMENT No items to add to document DOG FOULING WASTE BINS These had been installed and are being used LAND NEXT TO HOLLY BUSH Councillor Henderson had been trying to contact Mr Brockley and it was noted that the property had now been sold. Councillor Henderson advised that when he had viewed the land registry documents the area of land in question was not included in the area of land for the property. Councillor Henderson will contact Mr Brockley to arrange where the fence can be cut down and then organise the volunteers to clear the land. ACTION: COUNCILLOR HENDERSON 40.4 NEW PLAYING FIELD LEASE Councillor Henderson advised that he has spoken with the owner s solicitor. There are legal issues to be addressed through the solicitor as two of the owners are prepared to gift their share of the land to the PC, but not the third. Evidently the two sisters would need the agreement of the third sister on the land registry agreement to transfer their shares to the Parish Council. The solicitor thinks she may not agree but will ask. Also, to include an uplift clause in the sale agreement would also need to be accepted and agreed by the third sister, as she would be a joint owner with the Parish Council. The solicitor will ask about this also. An uplifting clause may also add significantly to legal costs. No figure given at this time. The two sisters are happy for the village to continue to use the field. Clarification to be sort as to who has public liability insurance. Previously the sisters leased the field to SDDC and they covered the public liability insurance. Councillor Henderson to enquire WASTE BINS Councillors agreed that the waste bin by the Holly Bush car park should be replaced. Clerk to enquire the price of a bin to match those in the playing field. ACTION: CLERK 40.6 FOOTPATH BETWEEN PLAYING FIELD AND MEADOW RISE Councillor D Redfern confirmed that several years ago he had cut the hedge as a gesture of goodwill. Councillor Redfern has spoken with the owners of Royal Oak Cottage and they are to check their deeds to establish if the hedge is on their property. COUNCILLOR REDFERN TO CHASE GDPR Clerk had distributed many documents prior to the meeting. Councillors approved all. Clerk to place Data Protection Policy & Records & Retention Policy on the village website. ACTION: CLERK 41.0 CORRESPONDENCE
3 41.1 ETWALL AREA FORUM This is to be held on 6 th June 2018 at 6.30pm at Hilton Village Hall DERBYSHIRE DALES BROWNFIELD LAND REGISTER The register is being reviewed annually and Parish Councils, landowner s residents etc are being asked to suggest further sites in Derbyshire Dales which may be included LIBRARY CONSULTATION SDDC is holding a consultation of libraries. South Derbyshire has four static libraries: Swadlincote, Etwall, Melbourne and Woodville. Etwall library is open 16 hours per week and there are no proposed reductions in opening hours. A copy of the strategy and to complete the survey on line please see ADDITIONAL BURIAL LAND Mr Charlton contacted the Parish Council on behalf of the Church enquiring if they could access the land through the gate at the end of Church Lane, so they could complete work on a lime tree by the church. Councillor I Redfern advised that Mr Coxon rents the field and he would speak to him and arrange for the spare key to be given to the church. ACTION: COUNCILLOR I REDFERN 41.5 PROPOSED DRAFT POLICY ADDC GAMBLING ACT 2005 STATEMENT OF LICENSING POLICY This had been ed to Councillors for viewing SDDC POT OF FUNDING Document ed to Councillors. Councillors discussed the planning application and agreed to send objections as below. The Parish Council are aware that buildings have been already approved for the site and there should therefore be no need for any further development. We are concerned about the construction of permanent buildings on this site which have been approved through appeal, to accommodate traveller families only. Already plots have been sold, split and re-purchased on this site. If the planning is approved, we would request that the Council limit the size of the community block; give assurance that the sewage tank is adequate for the plot; and consult the environmental agency on the risk of flooding to the land BLACKBERRY FARM. MOUNT PLEASANT Gaynor Richards from SDDC Planning Department had informed the Parish Council that a site visit had taken place. The calf shed that had been constructed should have been 2 separate units. Also, the occupation of the dwelling was time limited, which had expired. The site is currently in breach of conditions 2, 3 & 5 of 9/2014/0859. However, it is being occupied in accordance with the agricultural occupancy condition. The owners had been offered an opportunity to remedy the matter through the submission of a further planning application which it is hoped will be submitted with the next 4-6 weeks BRANDONS SITE SDDC Councillor Plenderleith reported that the shed at Brandon s is being reviewed by Gaynor Richards at SDDC Planning Department ASHBOURNE ROAD Councillor Patten and Councillor Plenderleith were not able to inform the Parish Council if a retrospective planning application for agricultural building and access on Ashbourne Road had been approved FINANCE 43.1 FINANCE REPORT A finance report as at 1 st May was circulated PENSIONS No items to discuss CLERKS SALARY LESS TAX = It was proposed by Councillor Spalton and seconded by Councillor I Redfern to pay the Clerk s salary. Cheque serial number issued NO ITEM OR ADOPTION OF ANNUAL GOVERNANCE Copies of the Annual Governance Statement 2017/2018 which are part of the Annual Audit were circulated and approved by all present or ADOPTION OF THE ANNUAL RETURN The Annual Return has been completed and signed off by the Internal Auditor Mr Brian Wood, for submission to the External Auditor. Councillors approved the Annual Return, and these were duly signed by Councillor Henderson and the Clerk REPORTS 44.1 ROADS See item FOOTPATHS/MINOR MAINTENANCE Councillor I Redfern explained that due to health problems he had not been able to conduct a road survey ITEMS FOR THE CALENDAR
6 As DCC and SDDC Councillors can attend Parish Council meetings on the first Tuesday in each month, this will now be the new meeting date. Clerk to place item in village calendar and on village website CHAIRMAN S NOTICES A parishioner had asked if DCC were going to consider improving the width and surface on the Woodyard Lane to the A50. Parish Councillors had already raised this with Planning and Highways several years ago and it was agreed to ask DCC and SDDC Councillors at the next meeting.
