1 1. Introductory provisions 1.1. These Operating Rules of the Prague Vinohradská data centre 190 (DC THP) set out the conditions for the operating of publicly available electronic communications services provided by GTS Czech s.r.o. (hereinafter the Provider ) in the data centre located at the address Vinohradská 190, Prague 3, post code: , and also stipulate binding procedures in accordance with which the provider proceeds when providing the relevant publicly available electronic communications services through the GTS data centre, or other services provided there, and the subscriber proceeds when using them in the DC THP data centre The conditions set out by these Operating Rules for the DC THP data centre are binding for customer halls THP 2, THP10 THP 22 and THP 24 and are binding on the provider, the subscriber and persons authorised by the subscriber or provider to enter the DC THP data centre (or perform activities, rights and duties linked to the DC THP data centre) Everywhere this document mentions the subscriber, this shall also be understood to mean a person authorised by the subscriber to enter the DC THP data centre, or perform activities, rights and duties related to the DC THP data centre. It shall also be understood to be a person who acts and performs activities in the DC THP data centre together with a subscriber and/or a person authorised to enter a location (e.g. a party s supplier), with the exception of the provisions whose nature indicates that a right or duty applies solely to the subscriber Everywhere this document mentions the provider, this shall also be understood to mean a person authorised by the provider to enter the DC THP data centre or perform activities, rights and duties related to the DC THP data centre, with the exception of such provisions whose nature indicates that a right or duty applies solely to the provider The DC THP data centre is referred to in this document as the space, building or data centre, whereas NOC means the supervisory centre of GTS Czech s.r.o. (the provider) For these purposes, the contract shall be understood to mean the Contract on Provision of Publicly Availability Electronic Communications Services whose subject includes, in addition to other things, the provision of publicly available electronic communication services by the GTS data centre, or other services provided by the THP data centre, concluded by the subscriber and the provider. 2. Rights and duties of the subscriber 2.1. The subscriber is entitled to access its reserved space and to operate its own equipment there, including installing and removing it. Outside the rented space there is a ban on any installations, interference with technology of another, opening of double floors, etc. The subscriber shall comply with the access regime see Article 4 of these Operating Rules. The subscriber is not entitled to connect to the current 230 V plug bar in the rack other extension or splitter cables. The subscriber is entitled, in addition to its reserved space, to enter and use the space of the preparation room for customers (the THP 22 and THP 24 halls), in which the subscriber is entitled to perform preparatory work (configuration) on its hardware or software, and perform small assembly activities related to the subscriber s hardware and its placement in racks Items releasing dirt and dust, food or liquids may not be taken into the premises or consumed in the premises. Smoking is prohibited in the data centre, as are open flames, the drinking of alcoholic beverages, the use of other addictive substances or entering the data centre under the influence of alcohol or other addictive substances. The waste resulting from the activities being undertaken (including packaging) must be promptly cleaned up after completion of the work. It is strictly forbidden to store any packaging in the rack space (cage). The participant must keep the premises entrusted to him in proper working order The space of the location and movements by persons in the location are, for security reasons, constantly monitored by a camera and security system. These recordings are archived for the period set in the provider s relevant registration with the Office for Protection of Personal Data. The subscriber takes note of these facts and agrees to monitoring and archiving of such recordings A person who enters the premises of the site is required to use only clean shoes with white soles. Additionally, if entering data halls THP24, THP 22, THP 10 and THP2 a person is also required to put on shoe covers from the dispensing machine located in the lobby The participant acknowledges and agrees that the site may only be entered by persons who: Are on the list of authorised persons, which the participant must deliver to the provider (or the relevant personal details), or who are on the list of authorised persons, have been assigned a card allowing entry to the site and have been appropriately instructed within the meaning of Decree No. 50/1978 Coll., as amended (see the form attached as an appendix to these operating rules). The participant may make unilateral changes to these persons by way of a notification sent to the provider. The provider collects and processes these particulars in order to perform the relevant contract, namely in order to allow entry to the site solely to authorised persons, with the participant consenting to this and being obliged to familiarise authorised persons with these facts. The provider is authorised to collect and process the personal data of authorised persons in accordance with the registration with the Office for Personal Data Protection. The provider shall record the personal data of authorised persons in its internal lists, the so-called Access Lists - see point 4.1. 2 enter the site and perform activities at the site together with the participant and/or a person authorised to enter the site (e.g. the participant s supplier), the participant or the person authorised to enter the site must demonstrably notify this fact in advance to the provider to the contact of the data centre shift. The participant or the person authorised to enter the site is also obliged to familiarise this person with the duties associated with this person s entry to the data centre and performing a certain activity for the participant at this site. The participant is namely obliged to instruct this person to the same extent as the person authorised to enter the site, and also to demonstrably notify this person that he must perform the duties stipulated in these operating rules or such a person must expressly agree with the making of records or with the provision of personal data to the provider. The participant is responsible for the performance of duties by this person and is also responsible for any damage ensuing from a breach of the duties of such a person under these operating rules. To this end, the provider shall display these operating rules at the site, so as to enable the relevant person to become familiar with it. The participant or an authorised person is also obliged to be with the relevant person for the entire time of this person s presence in the relevant data hall. Completed the initial training, which is valid for one year, and signed the relevant record of instruction, a specimen of which forms an appendix to these operating rules. The participant is obliged to arrange for subsequent initial training for the relevant person for the coming year from the provider prior to the expiry of this period. If the subsequent initial training has not been undertaken, the issued access cards will be automatically de-activated upon the expiry of their validity. This duty only applies for access to data halls THP 10, THP 22 and THP 24. The participant is obliged to familiarise persons authorised to enter the site with the conditions prescribed by these operating rules (including its appendices) and acknowledges that he is responsible for any breach of the conditions of these operating rules and/or of the contract (or for the damage arising as a result) committed by the persons authorised to enter the site The subscriber shall ensure that the persons it proposes as persons authorised to enter the location or persons who are authorised to enter the location but have to be advised again after the expiry of a set period, shall receive advice under Decree No. 50/1978 Coll., as amended, and sign the form specified in the annex to chapter 7 of these operating rules concerning the confirmation of the fact that they were advised in the aforementioned sense. Without this advice no person will be authorised to enter the location, with the exception of entry to the space of service hall THP2 (the Green Hall) The subscriber shall report without delay to the NOC each loss of an access card or key to a rack, specifying the rack number. The subscriber is fully liable for damage arising related to such loss The subscriber is not entitled to interfere with any technology and equipment placed in the location, with the air conditioning in the location (in particular there is a strict ban on switching the air conditioning off), is not entitled to handle the equipment of the provider or third parties, and is not entitled to interfere with the setting of the location s operating temperature. In the event of the installation of entry doors to a cold corridor between stands in the data centre space, there is a ban on blocking the doors in any way. The subscriber shall also always close the doors to the cold corridor. The subscriber has the option of disconnecting its equipment from the power supply only in its rack The subscriber shall, when visiting the location, comply with security and fire regulations of the provider and/or the building owner located in the DC THP space and complies with any supplementary instructions of the provider, security, a NOC operator and/or the building owner. The subscriber is not entitled to enter rooms other than the reserved rooms in which equipment is located in an allocated rack/cage and the space of the preparatory room for customers The subscriber may not make any audio-visual recordings in the provider s space without the provider s prior consent. Audio-visual recordings that are made shall be made in the presence of a technician of the provider, unless agreed otherwise. The subject of recordings cannot include in any case sensors, various components of the fire fighting system, laser systems, cameras or the technology of other entities The maximum standard permitted power output to part or all of the rack that a subscriber can use is set in the valid GTS Data Centre Service Description (hereinafter the service description ), unless agreed otherwise with the subscriber in the contact (in particular the GTS Data Centre Service Specifications). The costs of services linked to the maximum standard permitted power output in accordance with the valid service description, or another maximum standard permitted power output agreed with the subscriber in the contract (in particular in the GTS Data Centre Service Specifications) are included in the regular monthly price of the GTS data centre service, unless agreed otherwise with the subscriber. For any higher power output other than the maximum standard permitted power output set in a valid service description or another output agreed with the subscriber in the contract (in particular in the GTS Data Centre Service Specifications), the subscriber shall pay the provider the price for services related to the higher power output, i.e. the price for the power output over the framework of the monthly price set in the valid GTS Data Centre Price List (or set in the GTS Data Centre Service Specifications). In the event that the power output to the subscriber s space (rack) is higher than the set maximum standard permitted power output in accordance with the valid GTS Data Centre Service Description or otherwise agreed with the subscriber in the contract (in particular the GTS Data Centre Service Description), the provider is entitled to send the subscriber a notification the limit his been exceeded and invite the subscriber to reduce the power output to its space (rack) to the maximum standard permitted power output in accordance with the valid service description or the maximum agreed in the contract (in particular the GTS Data Centre Service Specification) with the subscriber, by a reasonable deadline, which may not be less than 48 hours. Unless the subscriber arranges a reduction in the power output to its rack by the set deadline, the provider is entitled to GTS Czech s.r.o., Přemyslovská 43, Praha 3, Česká republika // tel // info@gts.cz 2/29
3 proceed in accordance with section 3.5 of these operating rules. If the subscriber, within no more than 5 business days of the suspension of the service, does not demonstrably prove to the provider that the power output to its rack is lower, then the provider is entitled to terminate the relevant GTS data centre service specifications (the provision of the GTS data centre service) by written notification with immediate effect as of the day of delivery of such notice to the subscriber In the rented space, which is equipped with blanking covers, the participant is obliged to ensure that the free space in the rack is always closed off. This namely applies to the premises of so-called cold aisles in THP24 and THP10. The contracting parties acknowledge that cooling and airflow in the rack is a critical parameter that can be influenced by changes to the infrastructure and the distribution of the participant s equipment and/or cables in the rack. For this reason, the participant is obliged to optimise the placement of a customer s equipment and/or cables in the rack in relation to the airflow and its cooling, the placement of perforated tiles and airflow around the rack The subscriber undertakes to comply with all conditions stipulated by these operating rules (including their annexes) and/or the contract. 3. Duties and rights of the provider 3.1. The provider shall arrange the equipping of a rack/cage (establish a GTS data centre service) in accordance with a contractual agreement concluded between the provider and the subscriber, resulting in particular from the contract, the GTS Data Centre Service Specifications and the GTS Data Centre Service Description and, depending on the location of the hardware, shall arrange the following in the relevant data hall: 2 keys for the rack, 2 access cards serving to enter the rented data centre space that it hands over to the subscriber (only for the data halls THP 22 and THP 24), or Records of persons authorised to enter the location in internal lists of authorised persons with the relevant degree of authorisation The provider shall enable the subscriber to enter the space with the subscriber s technology 24 hours a day The provider does not bear material liability for the subscriber s installed hardware, unless it causes damage to the hardware due to a breach of its duties The following temperature is maintained in the data centre: Air temperature, measured in a closed cold aisle at a height of 1100 mm above the ground (double floor), is maintained at 22 C +/- 4 C. The air temperature, measured as cooling without (closed) cold aisle at the outflow vent of the airconditioning units is maintained at 20 C +/- 4 C. The provider is not liable for a failure to comply with the above-mentioned temperature parameters in the event of: - a force majeure; - this failure to comply with the guaranteed level being caused by the participant (even if only in part); - the maximum electricity consumption limit being exceeded by the participant; - no guarantee by the provider shall be applied to cooling parameters inside racks; - the level of cooling in the closed cold aisle shall only apply to racks/cages where blanking panels are applied to all unused U spaces of the rack; - the participant failing to sufficiently optimise the placement of the customer s equipment and/or cables in the rack in relation to the airflow and its cooling, the placement of perforated tiles and airflow around the rack, and this fact results, even partially, in non-compliance with the above-mentioned temperature parameters If it is found that technology installed by the subscriber is installed in conflict with the conditions of these operating rules and/or the conditions of the contract and/or the subscriber breaches any other conditions set by these operating rules (their annexes) and/or the conditions of the contract, then a technician of the provider is entitled to arrange its disconnection or shutdown, or suspend the provision of GTS data centre services, or other services provided in the DC THP data centre, after the vain expiry of a reasonable period (at least 48 hours) for correction provided to the subscriber by the provider in a written notification of the breach of conditions of these operating rules and/or the contract. If there is an immediate risk of damage, this is possible without the prior warning and informing of the subscriber, including in the event the subscriber is not breaching these operating rules (their annexes) and/or the contract (e.g. fire or other natural disaster, etc.). In the event that the provider is forced to disconnect or shutdown the subscriber s technology, or suspend the provision of GTS data centre services for the reasons specified herein, it bears material liability for any damage caused to the subscriber or third parties, in particular it bears material liability for damage caused to installed hardware and software of the subscriber or lost data If the subscriber (or persons authorised to enter the location or other persons for which the subscriber is responsible e.g. a supplier of the subscriber) repeatedly breaches the conditions stipulated by these operating rules (including annexes) and/or the contract, the provider is entitled to terminate the relevant GTS Czech s.r.o., Přemyslovská 43, Praha 3, Česká republika // tel // info@gts.cz 3/29
4 GTS Data Centre Service Specifications (the provision of the GTS data centre service) by giving written notice with immediate effect as of the day of delivery of such notice to the subscriber The provider reserves the right to unilaterally amend this document at any time depending on changes to products or other conditions concerning the location. The provider shall inform the subscriber in advance of such amendment. 4. Access regime to the location 4.1. Access to the site of the DC THP data centre is possible 24 hours a day. In order to access the site, the participant s person must be included on the List of Authorised Persons. If the participant s person is given a permanent access card, then this access card must allow access to the relevant reserved area and also the key from the rack, depending on the specific location of the rack. Control of the participant s authorised persons to enter the DC THP data centre or the premises housing the racks, including control of their authority to perform the relevant activities is conducted in several ways: a. By submitting a valid ID card or passport (depending on the document listed in the Access List) at the reception desk when entering the data centre; if the participant s person is given a permanent access card, an identity control at the reception desk is not performed. b. In the event of a reset request, by sending the request from the stipulated in the Access List as the authorisation . The DC shift staff are entitled to conduct additional controls of the request s justification, i.e. to call the contact number, control the ID card number, or to contact the participant s Admin officer. The DC shift staff shall always conduct this control should it not be possible to send the request from the authorisation . c. In the event of a discrepancy during the control of authorised persons, the data centre security staff shall prevent the person concerned from accessing the rack/leased space and the DC shift staff shall refrain from performing the activity requested by this person. In the event of a suspicion that the participant, the participant s authorised person, or another person entering the data centre with the participant s person or an authorised person, is under the influence of alcohol or another addictive substance, the provider or the provider s relevant persons, but in particular the data centre security staff, shall be authorised to prevent this person from entering the data centre and may expel such a person from the data centre at any time in the event of a suspicion that this person is under the influence of alcohol or another addictive substance. This right to prevent such a person from entering the data centre or to expel this person from the data centre shall also apply if the participant, the participant s authorised person, or another person entering the data centre with the participant or an authorised person does not abide by the instructions given by the provider s relevant persons and/or the conditions of these operating rules. Access Lists are internal lists of the names authorised by the participant to enter, paired with the participant s relevant leased space and the recorded hardware in the data halls. These Access Lists also stipulate the level of authorisation given to individual authorised persons. The data contained in these Access Lists is sourced (processed) by the provider from the data contained in the relevant Service Specification of the GTS Data Centre, or from data provided by the participant in a written notice in the event of a change in authorised persons and/or level of their authorisation. These Access Lists are stored in the provider s internal system. If not included in these lists, the participant s person shall not be permitted access to the leased space of the THP data halls and/or allowed to handle the hardware located in the THP data halls or such a person shall not be issued with a card allowing him independent access. The particulars contained in the Access Lists are processed by the provider in accordance with the relevant regulations, namely Act No. 101/2000 Coll., on Personal Data Protection, as amended, or in accordance with the provider s relevant registration with the Office for Personal Data Protection. Halls in which the participant s HW are not recorded (data hall THP10, THP 22, and THP 24) halls to which access by the participant s persons is defined by the authorisation on the permanent access card. The participant does not have a permanent access card to this hall or a key from the rack. A card shall be lent to him for the duration of his visit at the reception desk of the data centre and the rack shall be unlocked/locked for him by the data centre shift staff. This hall also has a record of the participant s hardware and the participant is entitled to enter or to handle the hardware only in accordance with the authorisations stipulated in the table below, unless the relevant authorisations are agreed otherwise by the contracting parties in the relevant Service Specification of the GTS Data Centre in this case, the authorisations agreed in the relevant Service Specification of the GTS Data Centre shall apply preferentially. Authorisation to perform the activity: Level of authorisation Define persons on the Access List Bring /take out HW to / from the data centre Access to the participant s HW Request for RH 1 Yes Yes Yes Yes 2 No Yes Yes Yes 3 No No Yes Yes 4 No No No Yes Specific data pertaining to the relevant authorisation (namely a particular person) are in the relevant Service Specification of the GTS Data Centre, given that in order to make a change in the authorised persons, including the level of authorisation after the conclusion of the relevant Service Specification, it shall suffice for the participant to demonstrably serve a written notice of the change in authorised persons and/or of a change in their level of authorisation to the provider. The provider shall change the authorised persons and/or the level of authorisation of particular authorised persons in its internal list (Access List) not later than 5 business days from the date of the demonstrable serving of the participant s notice of the change in authorised persons and/or the level of authorisation of particular authorised persons. The participant s written notice of the change in authorised persons and/or the level of authorisation of particular authorised persons is also considered for these purpose to be a notice on the change served by from the address of the person authorised for this purpose to the address of the provider (remote.thp@gts.cz). Upon entering the data centre, the participant s authorised persons are obliged to prove their identity at the reception desk of the data centre and, if need be, to have hardware that they are taking in or out of the data centre controlled. A delivery and acceptance protocol shall be issued to the participant s person in the event of hardware being taken in or out of the space subject to HW recording. Support of participants Remote Hands service (RH service) The Remote Hands service is provided as standard only in the THP2 data hall. The basic condition for the activation of this service in other data halls is the marking of the relevant HW this means that the Remote Hands service may only be performed on clearly marked HW. It is standard for a participant s HW to be marked in the THP2 data hall by the DC shift staff as part of the process of recording the HW. As part of the RH service, the provider s technician provides basic support for the participant s equipment, such as for example basic configuration of the equipment (e.g. via a console), turning equipment on and off, setting switches, pressing buttons and reading equipment displays. The RH service is provided for equipment of any manufacturer and type. Activities expressly requested by the participant are provided as part of the RH service. The scope of these activities is also prescribed by the participant s specific instructions. The RH service does not include the installation of the participant s equipment. 6 In the event of extensive or complicated requests by the participant pertaining to the provision of the RH service, the provider shall firstly present the participant with an estimated budget, and a scope of the activities provided as part of the RH service, including a time schedule. In the event of a written agreement being concluded in the matter of the estimated budget, the scope of the activities provided as part of the RH service and the time schedule, then the provider shall perform the requested activity without undue delay. In the event of these extensive or complicated requests by the participants, these activities may also include the installation and configuration of equipment, including the solution of any associated problems. In the event of simple requests (e.g. installation of one server), it shall be sufficient to submit a request at least 24 hours in advance. The provider shall charge the agreed hourly rate for performing these simple activities. These simple activities shall be performed by the provider only during business hours as part of the provision of the RH service, unless expressly agreed otherwise by the contracting parties. The provider shall make every reasonable effort to meet the participant s request for the provision of the RH service, on the proviso that the provider does in no event bear any responsibility for the results of the activities performed as part of the RH service, which were performed on the basis of the participant s express instruction, including instructions given prior to the provision of the RH service as well as instructions given to the provider by the participant during the course of providing the RH service this shall also apply in cases when the provider knew or ought to have known of the inappropriateness of such instructions given by the participant. The provider shall not in any case be obliged to warn the participant of the inappropriateness of its instructions. The provider is entitled to refuse to provide the RH service at any time, should it have any doubts as to the scope, time or nature of the activities provided within the framework of the RH service, or should it have doubts as to the correctness or appropriateness of any instructions or requirements given by the participant pertaining to the provision of the RH service. Authentication / authorisation of requests for the Remote Hands service Every request for the provision of the Remote Hands service must be authorised and authenticated. In practice, this means verifying the identity of the person requesting the action and whether this person is authorised to make a request for the Remote Hands service. Authentication: Upon entry: Control of identity at the reception desk of the THP data centre by submitting a valid ID card or passport Control of biometric data (fingerprint) upon entering THP24, THP10, and the demarcated customer area A request for the provision of the Remote Hands service must be submitted by one of the following ways: From a pre-defined By calling from a pre-defined telephone number Sending via a pre-defined workflow system individually agreed with the participant (COW, TT system or other customer system) The DC shift staff are entitled to carry out additional authentication of the request, i.e. by calling the pre-defined number, etc. The request for the provision of the Remote Hands service shall not be met by the provider in the event of any discrepancy. Authorisation: Every authenticated request is subject to further control to see if it is in accordance with the Authorisation for the activity this control is performed using the Access List. Parking and transport of material Spaces are reserved for permanent parking during data centre visits on car park no. 1 see the diagram in the appendix If unloading or storing HW it is possible to park in the following areas: - In front of the doors see the diagram in the appendix (halls THP2 and THP10) - Car park no. 2 see the diagram in the appendix (Hall THP10) access to this car park is only available upon prior request and with the assistance of the DC shift staff - Cargo platform see the diagram in the appendix (Halls THP22 and THP24) - access is only available upon prior request and with the assistance of the DC shift staff Operation and manner of using the cargo platform (elevator) The platform is operated solely by the DC shift staff, i.e. the participant and persons authorised to enter or other persons, are not authorised to use this platform without the participation of the DC shift staff. The participant s person must not operate the controls of the cargo platform in any way. Hardware shall be placed on the cargo platform solely the participant s persons, with the DC shift staff not handling the participant s hardware in any way. The provider is not responsible for the hardware transported on the cargo platform (unless it caused damage to this GTS Czech s.r.o., Přemyslovská 43, Praha 3, Česká republika // tel // info@gts.cz 6/29
7 hardware by breaching its duties). Customers preparation area The participant s persons authorised to enter THP 22 and THP 24 have access to the customers preparation area 24 hours a day, seven days a week. The customers preparation area is designed for preparatory work (configuration) on their hardware or software, and for minor assembly work. After completion of the work, the participant s person is obliged to immediately clear away all residual material (including packaging), so that the workplace is in order and clean and available to other persons. It is prohibited to smoke, drink alcoholic beverages, use other addictive substances, or work with an open flame not in the customers preparation area. It is prohibited to use the customers preparation area to store any material, hardware, equipment or any other things. It is prohibited to leave any of the participant s things in the customers preparation area, i.e. the participant is obliged to take all of his things when he leaves. The provider is not liable for any of the hardware, material, equipment or other things of the participant placed (left) in the customers preparation area. It is prohibited to use the customers preparation area to store any material.. 5. Contact details 5.1. In the event of any problems in the location, the subscriber shall/may contact the data centre shift Data centre shift contact 24 hours a day. Data centre shift: Data centre shift: Fax: remote.thp@gts.cz 6. Safety and automatic fire extinguisher system 6.1. A subscriber who enters the operating space of the GTS Czech s.r.o. DC THP data centre shall comply with the safety rules valid in the Czech Republic for work in such space. The gas FM-200, HFC 227ea is used as an extinguishant, it is a halogen alkane 1, 1, 1, 2, 3, 3, 3 heptafluoropropane (CF3CHFCF3) In its normal state it is a colourless, odourless gas that does not conduct electricity. As an extinguishant it is stored in liquid state under a pressure of 25 bars. When it is released, it changes to a gas in the jet. In the correct concentration, FM-200 extinguishes a fire by interfering with the combustion reaction. FM-200 rapidly suppresses flames, prevents re-combustion, does not leave remainder materials and does not request cleaning after release it is ventilated. The system is designed for very rapid intervention 10 seconds and less to minimise damage to equipment and reduce the danger to life. The necessary quantity of FM-200 was calculated to comply with the strict requirements of the Factory Mutual Research Corporation (FMRC) and the National Fire Protection Association (NFPA). A safe concentration of extinguishant of min. 7.5% and max. 9% in accordance with ISO was proposed for the space where people are present If the system indicates a fire, an audio signal gives the alarm. The degree of activation is indicated by the relevant beacon. They are located by all the entrance doors, including the emergency exit. Level 1 pre-alarm is indicated by an orange beacon and the intermittent sound of the siren. Level 2 the alarm is indicated by a red beacon and a change to the oscillating tone of the siren. Thirty seconds after the activation of level 2, the extinguishant (gas) is released In the event the warning signal sounds, the subscriber shall immediately cease all its activities and promptly leave the space. After leaving, the subscriber shall close the doors behind it There is a strict ban on entering the space after the system is activated, including again opening the doors. In the event the system is activated (acoustic signal siren) notify the data centre reception of the extinguisher system s activation.
