1 Code of Conduct Compliance Plan Attachment 6 Page 1 of 9 TEXAS CUSTOMER INFORMATION REQUEST & CONSENT PROCESS I. Regulated Utility Customer/Retail Electric Provider (REP) requests that the Utility provide the Customer s proprietary information to REP or a third party. REPs or Regulated Utility Customers requesting that their proprietary information be sent to a REP must use a Letter of Authorization (LOA) to request Customer s historical usage information. For all other requests for proprietary customer information to be sent to a 3 rd party (other than a REP), Regulated Utility Customer must use the Customer Information Request and Consent Form. II. Does the Utility have consent form/loa signed by the Customer? Yes No II.A. Utility supplies Regulated Utility Customer/REP with Customer Information Request and Consent Form/LOA. II.B. Regulated Utility Customer/REP completes and Customer signs Customer Information Request and Consent Form/LOA. II.C. Regulated Utility Customer/REP mails/ s completed original Customer Information Request and Consent Form/LOA to Entergy s Business Center (EBC), Entergy s Central Administration or Provider Business Center (PBC) as identified on the form. III. PBC forwards LOA to the EBC for completion. EBC or Central Administration transmits the completed Customer Information Request and Consent Form/LOA to the appropriate Utility Functional group. IV. Functional group supplies the requested information to EBC or Central Administration. V. EBC or Central Administration releases the information as requested, completes bottom portion of Customer Information Request and Consent Form (not necessary for the LOA) and forwards completed form to Affiliate Rules Compliance (ARC). VI. ARC stores necessary information for tracking and filings.

2 Code of Conduct Compliance Plan Attachment 6 Page 2 of 9 TEXAS CUSTOMER INFORMATION REQUEST & CONSENT PROCESS The Company intends to protect the proprietary information of all customers and will restrict access to this information to (1) the customer or (2) parties authorized by the customer to access proprietary information. As noted at the end of the process description below, certain exceptions listed in P.U.C. SUBST. R (g) provide different rules that allow access to proprietary information without prior Customer consent. In cases where a benevolent organization or person needs customer information in order to prevent service termination by paying amounts past due for electric service, the customer must request such information and provide it to the organization or person. Definition of Proprietary Customer Information Any information compiled by an electric utility on a customer in the normal course of providing electric service that makes possible the identification of any individual customer by matching such information with the customer's name, address, account number, type or classification of service, historical electricity usage, expected patterns of use, types of facilities used in providing service, individual contract terms and conditions, price, current charges, billing records, or any other information that the customer has expressly requested not be disclosed. Information that is redacted or organized in such a way as to make it impossible to identify the customer to whom the information relates does not constitute proprietary customer information. Process for Releasing Proprietary Customer Information: (See Notes Below) I. Regulated Utility Customer or Retail Electric Provider (REP) requests that Customer s proprietary customer information be provided to REP or other third party. REPs or Regulated Utility Customers requesting that their proprietary information be sent to a REP must use a Letter of Authorization (LOA) to request Customer s historical usage information. For all other requests for proprietary customer information to be sent to a 3 rd party (other than a REP), Regulated Utility Customer must use the Customer Information Request and Consent Form. II. If the Utility does not have an Information Request and Consent Form/LOA that is signed by the Regulated Utility Customer: A. As appropriate the Utility supplies (1) Regulated Utility Customer with Customer Information Request and Consent Form or (2) or Regulated Utility Customer/REP with LOA. B. As appropriate, either (1) Regulated Utility Customer completes and signs top portion of Customer Information Request and Consent Form or (2) Regulated Utility Customer/REP completes and Customer signs bottom portion of LOA.

As appropriate or as identified on the form, either (1) Regulated Utility Customer mails/ s completed Customer Information Request and Consent Form to the Entergy Business Center (EBC) or Entergy s Central Administration or (2) Regulated Utility Customer/REP mails/ s completed LOA to the Provider Business Center (PBC). These forms are posted on Entergy s Internet website. [See Notes for information on alternate means of transmitting documents] Customer signatures may include electronic signatures pursuant to the Electronic Signatures and Global and National Commerce Act signed into law on June 30, III. IV. The PBC forwards the LOA to the EBC for completion. The EBC or Central Administration forwards the signed Information Request and Consent Form or LOA, as appropriate, to the appropriate Utility functional group. The Utility functional group supplies the information to the EBC or Central Administration. V. The EBC or Central Administration releases the information as requested, completes the bottom portion of the Customer Information Request and Consent Form (this is not required for the LOA), and forwards the completed form to Affiliate Rules Compliance (ARC). VI. ARC stores necessary information from Customer Information Request and Consent Form/LOA into database for the purpose of tracking, filing, or providing to third parties. Information stored for minimum of 3 years. Notes: Pursuant to P.U.C. SUBST. R (g), different rules may apply for providing proprietary customer information to: federal, state or local governmental entities in conjunction with a court or administrative proceeding; the Texas PUC; a provider of last resort; an independent organization (as defined by PURA ); or pursuant to a law, regulation, or a legal process. For such requests, please contact ARC. The original signed Customer Information Request and Consent Form/LOA will be accepted when mailed by either the Regulated Utility Customer or the REP. A completed, signed form will be accepted if it is faxed from the Customer s facility to the EBC/PBC. After three years, records no longer must be retained.

7 Page 7 of 9 ENTERGY CUSTOMER INFORMATION REQUEST & CONSENT FORM PROPRIETARY CUSTOMER INFORMATION AVAILABLE FOR RELEASE TO THIRD PARTIES All requests for proprietary customer information MUST specify the customer s account number or numbers. No information will be released for any account number that is not provided on the signed Request and Consent form. The account numbers listed on each Request and Consent form will be screened to verify that the name on the Form is consistent with the name on the Utility s records and no information will be provided in cases where the names do not match. The following is a list and description of the currently available proprietary customer information: Residential & Small Commercial Customers 1. Deposit Guarantor Qualification Information. When a customer requests that another customer (guarantor) guarantee their deposit for electric service, information related to the guarantor s account and the requesting account must be disclosed to the two parties. This information includes the qualification of the guarantor, the account numbers of the two accounts and the amount of deposit required or guaranteed. 2. Letter of Credit History. This letter is primarily used by residential customers to assist in setting up new service with another utility. For each account number, it shows the service address, the Service From and Service To dates, the current account status, and for the past 12 months, the number of times in arrears, the number of times delinquent, and the number of times collection action was taken. 3. Billing history for most recent 12 billing months. This monthly history includes the billed kw, the billed kwh, and total charges for electric service. Only data for the most recent 12 complete months will be provided, even if more months are requested. (Texas customers see Note below) 4. Payment history for most recent 12 months. This monthly history records the charges for electric service and all payments made for such service. 5. Confirmation of Service. This letter confirms that a customer has/had utility service at a particular service location (service dates included). Large Commercial & Industrial Customers 1. Payment history for most recent 12 months. This monthly history records the charges for electric service and all payments made for such service. 2. Billing history for most recent 12 billing months. This monthly history includes the billed kw, the billed kwh, and total charges for electric service. Only data for the most recent 12 complete months will be provided, even if more months are requested. (Texas customers see Note below) 3. Interval Data The interval data will be in an Excel file and the quantities supplied are kw, kvar, and kva. Metering must measure and record kw and kvar, kq, or kva to support this request. (Texas customers see Note below) 4. Information on Metering Facilities at the Customer s site. A. Existing Meter Functionality refers to a meter s type and capability. B. Information on Advanced Metering Options. NOTE: A Texas Regulated Utility Customer requesting that their historical billing information be provided to a Retail Electric Provider (REP) or aggregator must use the attached Letter of Authorization (LOA). All other requests for proprietary customer information to be sent to a 3 rd party (other than a REP or aggregator) must use the Customer Information and Consent Form. Form (g)(1) ARC

9 INSTRUCTIONS FOR STANDARD LOA February 12, 2004 Page 9 of 9 RMS has approved a standard LOA that will be used by all TDSPs. TDSPs will be posting on their website. New LOA is effective immediately. TDSPs will honor new requests on the old request form until April 1. After April 1, all new requests will then be required to use the new LOA. The exception will be for any previously signed LOA (prior to February 17, 2004) will be honored as long as it is within the last 12 months. You can now use one LOA for multiple TDSPs New format requires you to check the related TDSPs that are serving the customer Muni-Coop names can be added to the LOA when a request is made for an ESID in their territory Attachments will be a standard approach if multiple TDSPs are requested on the same LOA If an attachment is used, use a separate attachment per TDSP with the ESIDs that are specific to a TDSP. TDSP will reject if an attachment is submitted with ESIDs that are not associated with their territory. TDSPs are requesting the attachment in Excel format with the ESID in the first column. See example spreadsheet to be used for attachment Expiration date is now a field for completion. There are examples of customers allowing the use of the same LOA for longer than a year. In this case, the customer needs to state when they would request the LOA to expire. A customer also has the opportunity to put an expiration date of a shorter timeline (less than a year). Footer can be customized by each CR with information that they would like to see used. This does not have to be standard by each CR. Examples would be CR name, address, phone number, LOA identifier (if you use one) At the minimum, the Company name (customer) must be in file name when submitting to the TDSP. If you choose to put additional information in the file name, make sure the Company name is first. Examples: CompanyABC.xls, CompanyABC.pdf, CompanyABC-AEP.xls Once the form is complete it should then be ed to the Provider Business Center at PBC@entergy.com.
