The amending bylaw has been combined with the original bylaw for convenience only. This consolidation is not a legal document. 2 Page 2 of 29 TOWN OF QUALICUM BEACH BYLAW NO. 626 A Bylaw to implement a Municipal Ticketing System within the Town of Qualicum Beach WHEREAS Section 264 of the Community Charter authorizes Council to, by bylaw: 1. designate those bylaws which may be enforced by means of a form of ticket prescribed by regulation under Section 273; 2. designate bylaw enforcement officers for the purpose of enforcing bylaws by means of prescribed form of ticket; and 3. designate an offence against a bylaw by means of a word or expression on a ticket; NOW THEREFORE, Council, in open meeting assembled, enacts as follows: 1. Title This Bylaw may be cited as the Town of Qualicum Beach Municipal Ticket Information Utilization Bylaw No. 626, Application (1) The bylaws listed in Column 1 of Schedule 1 to this Bylaw may be enforced by means of a ticket in the form prescribed for the purpose as described in Section 264 of the Community Charter. (2) The persons appointed to the job positions or titles listed in Column 2 of Schedule 1 to this Bylaw are designated as bylaw enforcement officers pursuant to Section 264 of the Community Charter for the purposes of enforcing the bylaws listed in Column 1 of Schedule 1. In addition, employees or agents of any party with whom the Town contracts for animal control services are designated as bylaw enforcement officers pursuant to section 264 (1)(b) of the Community Charter for the purposes of enforcing the Animal Control Bylaw listed in Column 1 of Schedule 1. (626.01) (3) The words or expressions set forth in Column 1 of all Schedules after Schedule 1 to this Bylaw designate the offence committed under the bylaw section number appearing in Column 2 opposite the respective words or expressions. (4) The amounts appearing in Column 3 of all Schedules to this Bylaw are fines set pursuant to Section 265 (1) and (2) of the Community Charter for the corresponding offences designated in Column 1.
3 Page 3 of 29 (a) In the case of a continuing offence, the fines referred to in Section 2. (4) may be imposed for each day that the offence continues. 3. Severability If any section or subsection of this Bylaw is found to be invalid by a court of competent jurisdiction, the section or subsection may be severed from the Bylaw without affecting the validity of the remainder of the Bylaw. 4. Repeal Town of Qualicum Beach Municipal Ticket Information Utilization Bylaw No. 549, 1994 and all amendments are repealed, provided, however, that such repeals shall not affect the validity of any tickets issued prior to the adoption of this Bylaw. 5. Effective Date This bylaw shall take effect upon the date of its adoption.
