RECOMMENDATION: Approve the use permit subject to the proposed conditions of the staff report and with no further scheduled County Board review. ISSUES: This is a new use permit request for a Verizon Wireless small cell telecommunications facility located at 2700 Clarendon Blvd. No issues have been identified. SUMMARY: This is a new use permit request for a Verizon Wireless small cell telecommunications facility located at 2700 Clarendon Blvd. A use permit (SP-339-U-14-2) was previously approved for this site in December 2014, however the facility was never constructed and the use permit expired. The applicant is re-applying to install one (1) small cell antenna and one (1) faux-antenna with associated equipment on the cupola above the Barnes & Noble bookstore at Clarendon Market Commons. The antennae are intended to provide expanded cellular capacity at the pedestrian level, and there will be no adverse visual impact to the surrounding area. Verizon Wireless is licensed by the FCC and is required to operate in full compliance with FCC rules and regulations. Federal law prohibits localities from basing a decision on the environmental effects of radio frequency emissions if the facility complies with FCC regulations. Additionally, the use will not: (1) adversely affect the health or safety of persons residing or working in the surrounding neighborhood, (2) be detrimental to the public welfare or (3) be injurious to property or improvements in the neighborhood. Staff recommends including standard use permit conditions for telecommunications facilities and the applicant has agreed to the conditions. The proposed use is in compliance with the Arlington County Zoning Ordinance (ACZO) and the General Land Use Plan (GLUP). BACKGROUND: The Clarendon Market Commons site plan (SP #339) was approved by the County Board on November 13, 1999, and included a GLUP Amendment, Rezoning, and Site Plan for the construction of 215,000 square feet of retail gross floor area, 300 apartment units, and 88 townhouse units with associated parking. The following provides additional information about the site and location: Site: The applicant proposed to mount the small cell antennae on the cupola above the Barnes & Noble bookstore at Clarendon Market Commons. Land Use: The site is designated in the General Land Use Plan (GLUP) as Low Office- Apartment-Hotel, and is subject to GLUP Note 3, Special Coordinated Mixed-Use District, East Clarendon, the Clarendon Sector Plan (2006). Zoning: The site is zoned C-O-1.5 Mixed Use District in the Arlington County Zoning Ordinance (ACZO). Neighborhood: The site is located within the Clarendon-Courthouse Civic Association (CCCA). The CCCA has replied to staff s inquiry about the use permit and has no comments on the application. SP-339-U-17-2 - 2 -

Figure 1: Aerial Image of Site Verizon Wireless (Clarendon I) 2700 Clarendon Blvd. N Source: Bing Maps 2017 DISCUSSION: The antennae are approximately 39 inches in height and 12 inches wide; the height measurement includes a 12-inch sleeve that has been added to the bottom half of the antennae to conceal equipment and provide a uniform shape. The sleeve will be the same width as the antennae. They will be flush mounted on the façade of the cupola, and the placement of the antennae ensures there will be minimal visual impact to the surrounding street. The applicant will also paint the antennae to match the façade. One (1) associated support equipment cabinet will be mounted on the rear side of the parapet wall of the cupola, and will not be visible from the public right of way. This facility will be unmanned and require only infrequent visits by maintenance personnel. Verizon Wireless is required to operate this facility in full compliance with Federal, State, and County ordinances. Along with direction in the way of design, visual impact, and compliance with FCC regulations; the new facility mitigates any undue adverse impact by utilizing an existing structure for the antennae, as opposed to constructing a new pole. The proposed location and appearance of the new antenna and related equipment are depicted in the attached plans designed by Morris & Ritchie Associates, Inc., and dated April 14, 2017. Figure 2: Rendering of Antennae Fixtures CONCLUSION: The use is not anticipated to cause any undue impacts or adversely affect the surrounding neighborhood. Therefore, staff recommends approval of the use permit for one (1) small cell antenna and one (1) pho-antenna at 2700 Clarendon Blvd., subject to the conditions of the staff report and with no further scheduled County Board review. Proposed Conditions 2700 Clarendon Boulevard (Barnes & Noble): 1. The applicant agrees that one (1) Verizon Wireless telecommunications antenna and one (1) faux-antenna and related equipment on the cupola at 2700 Clarendon Boulevard will be installed as shown on the engineering plans dated April 14, 2017, and that the Verizon Wireless telecommunications facility, will be constructed as shown on the application package dated March 13, 2017, and approved by the County Board on May 20, 2017. The applicant agrees that any additional installation of antennas or related equipment on the site shall be subject to review, and approval, by the Zoning Administrator through the administrative change process. The Zoning Administrator will approve such administrative changes if he/she finds that the additional antennas or equipment are contained within the limits of height and space allowed in the Arlington County Zoning Ordinance (ACZO) and SP #339 and match the colors and exterior materials of the existing building. 2. The applicant agrees to identify a community liaison who shall be available to address any concerns regarding the facility operation. The name, telephone number, and electronic mail address of the liaison shall be provided to the Clarendon-Courthouse Civic Association and the Zoning Administrator prior to issuance of a building permit for installation of equipment related to the telecommunications facility. 3. The applicant agrees that any non-functioning antennas on the roof of the building shall be removed at the time of installation of any proposed new antennas. The applicant further agrees that, in the future, any Verizon Wireless antennas on the site shall be removed within ninety (90) days after cessation of use. The applicant agrees to submit to the Zoning Administrator a letter (within the aforementioned ninety (90) day period) listing the number and type of antennas and other related equipment that shall be removed including photo documentation demonstrating removal of non-functioning equipment.
