1 ARLINGTON COUNTY, VIRGINIA County Board Agenda Item Meeting of June 18, 2016 DATE: June 7, 2016 SUBJECT: U USE PERMIT AMENDMENT to add an antenna and equipment to an existing telecommunications facility for Verizon Wireless; located at 6404 Williamsburg Blvd (Williamsburg Shopping Center) (RPC# ). RECOMMENDATION: Approve the use permit amendment to allow for additional telecommunications equipment for Verizon Wireless, subject to amended Conditions #1-3, new Condition #4, with a one (1) year administrative review (June 2017) and no further scheduled County Board review. ISSUES: This is a use permit amendment request for Verizon Wireless to amend an existing telecommunications facility (added antenna and equipment), and no issues have been identified. SUMMARY: The applicant, Verizon Wireless, requests to amend an existing telecommunications facility located at 6404 Williamsburg Blvd (Williamsburg Shopping Center). The applicant proposes to install one (1) new antenna which will be mounted inside a proposed, cylindrical concealment shroud and a ground level, equipment cabinet that will be located adjacent to the rear wall of the building. The antenna will be mounted on top of the existing CVS/Pharmacy parapet wall at a RAD center of from grade (28 to the top of the antenna). As part of this request, staff recommended that additional landscaping be provided to help mitigate against any visual impacts created by the ground mounted equipment cabinet. In addition to these amendments, staff recommends adding a new condition (Condition #4) specifying the requirements for submitting a final landscape plan for the site that are consistent with the conceptual landscape plan dated February 4, Staff proposes an administrative review in one (1) year (June 2017) to verify that all proposed landscaping has been installed. The facility will be unmanned and require only infrequent visits by maintenance personnel. Verizon Wireless is required to operate this facility in full compliance with Federal, State, and County ordinances. Furthermore, the Interim Guidelines for Telecommunications Facilities on County-Owned Property (Telecommunications Guidelines) was used to evaluate the application. Along with direction in the way of design, visual impact, and compliance with Federal Communications Commission (FCC) regulations; the Telecommunications Guidelines encourages the location of new antennas on existing structures, as opposed to constructing a new pole. The proposed antenna and equipment meet these criteria. The use will not: (1) adversely affect the health or safety of persons or working in the surrounding neighborhood, (2) be detrimental to the public welfare or (3) be injurious to property or improvements in the neighborhood. Therefore, staff recommends that the County Board approve the use permit amendment, subject to amended Conditions #1-3, new Condition #4, with a one (1) year administrative review (June 2017) and no further scheduled County Board review. BACKGROUND: The Williamsburg Shopping Center, has an existing stealth monopole disguised as a flagpole on the roof that was approved administratively several years ago for T- Mobile. There is also an existing pad for the associated equipment cabinets, also on the roof of the center, and also had been approved administratively. Since 2010, the County has been requiring use permits for additions or replacements to cell phone facilities that had been approved administratively in the past. In April 2011, the County Board approved a new use permit (U ) for AT&T Mobility which allowed the installation of new antennas inside an existing stealth monopole on the roof of the Williamsburg Shopping Center and the installation of additional equipment cabinets on an existing, rooftop equipment pad. The following provides additional information about the site and location: Site: The approximately 74,061 square foot site consists of a one-story, strip shopping center constructed in the 1950s. The site is bound on the east by single-family residences zoned R- 8 One-Family Dwelling District, on the north by Little Falls Road, on the west by Williamsburg Boulevard, and on the south by single-family residences zoned R-8. Zoning: The site is zoned C-1 Local Business Districts. Telecommunications facilities are a permitted use by special exception use permit by reference to Arlington County Zoning Ordinance (ACZO) Section H. Land Use: The site is designated on the General Land Use Plan (GLUP) as Service Commercial. 3 Neighborhood: The site is located within the Williamsburg Civic Association. The civic association was notified of the request and supports the proposed amendment. The antenna will be mounted on top of the existing CVS/Pharmacy parapet wall at a RAD center of from grade (28 to the top of the antenna). 5 appearance of the existing parapet wall. Furthermore, the applicant requests to install an associated, ground mounted, equipment cabinet attached to the rear wall of the building. 6 As part of this request, staff recommended that additional landscaping be provided to help mitigate against any visual impacts created by the ground mounted equipment cabinet. Staff proposes adding a new condition (Condition #4) specifying the requirements for submitting a final landscape plan for the site that are consistent with the conceptual landscape plan dated February 4, The conceptual landscape plan is attached to this staff report. This condition also requires that the applicant provide for and maintain landscaping surrounding the base of the associated, telecommunications equipment cabinet. Furthermore, any modifications to the proposed landscape plan shall be subject to review, and approval by the Zoning Administrator. Staff proposes an administrative review in one (1) year (June 2017) to verify that all proposed landscaping has been installed. The cumulative visual impacts of the added stealth antenna and equipment cabinet with the other existing telecommunications equipment at Williamsburg Shopping Center are minimal. New equipment will be placed in locations that will not be easily visible from adjacent sidewalks and streets. The applicant will also comply with all previously approved conditions for this use permit. All existing use permit conditions are proposed to be amended to include specific language pertaining to Verizon Wireless and their telecommunications facility request. This includes (but is not limited to) providing contact information for the facility s community liaison to the Williamsburg Civic Association and the Zoning Administrator prior to the issuance of a building permit for the telecommunications equipment (Condition #2). In addition, the applicant agrees to remove any non-functioning or inactive antennas within 90 days after the cessation of use (Condition #3). The facility will be unmanned and require only infrequent visits by maintenance personnel. Verizon Wireless is required to operate this facility in full compliance with Federal, State, and County ordinances. Furthermore, the Interim Guidelines for Telecommunications Facilities on County-Owned Property (Telecommunications Guidelines) was used to evaluate the application. Along with direction in the way of design, visual impact, and compliance with Federal Communications Commission (FCC) regulations; the Telecommunications Guidelines encourages the location of new antennas on existing structures, as opposed to constructing a new pole. The proposed antenna and equipment meet these criteria. The proposed location and appearance of the new antennas and related equipment are depicted on the attached plans designed by Telegent Engineering Inc. and dated March 7, CONCLUSION: The proposed use permit associated with a site plan is compliant with the County s Telecommunications Guidelines and with FCC requirements, as well as with the Arlington County Zoning Ordinance (ACZO). The added antenna (cylindrical enclosure) will be designed to match the appearance of the parapet wall. Furthermore, the associated ground equipment cabinet will be appropriately screened with landscaping which will be maintained by the applicant. A community liaison will be available to address any concerns related to the operation of the facility. The use will not: (1) adversely affect the health or safety of persons or working in the surrounding neighborhood, (2) be detrimental to the public welfare or (3) be injurious to property or improvements in the neighborhood. 7 Condition #4, with a one (1) year administrative review (June 2017) and no further scheduled County Board review. Proposed Amended Conditions and New Condition #4: 1. The applicant(s) agrees that all AT&T antennas will be installed inside the stealth monopole, and that all associated equipment cabinets will be installed on the existing equipment pad, as shown on the diagrams prepared by Bechtel Corporation labeled Site Name: Berkshire, Site ID No.: 1993 and dated 11/16/10. All Verizon Wireless antennas and associated equipment will be installed as shown on plans and diagrams labeled Verizon CVS 1372, Small Cell and dated March 7, The installation of additional antennas for all telecommunications carriers inside the existing stealth pole, and additional equipment cabinets (including associated GPS antennas) on the existing equipment platform, and additional antennas/equipment related to the June 18, 2016 use permit amendment may be reviewed and approved by the Zoning Administrator. 2. The applicant(s) shall identify a community liaison that shall be available to address any concerns regarding the facility s operation. The name, and telephone number, and electronic mail address (if applicable) of the liaison for all active telecommunications facility carriers shall be provided to the Williamsburg Civic Association and the Zoning Administrator prior to the issuance of a building permit for installation of equipment related to the telecommunications facility. 3. The applicant(s) agrees that any AT&T and Verizon Wireless antennas on the site shall be removed within ninety (90) days after any cessation of use. Unused antennas from other telecommunications carriers shall be their respective carriers responsibility, and shall be removed by their respective carriers within ninety (90) days after any cessation of use. 4. The applicant (Verizon Wireless) agrees to develop and implement landscaping treatments on the site consistent with the conceptual landscape plan dated February 4, 2016 as presented to and approved by the County Board on June 18, The applicant agrees to the following plan components and to submit and obtain approval of a Final Landscape Plan, as fulfilling this condition, from the County Manager or his/her designee prior to any issuance of any permits for work on the site. The applicant agrees to maintain all landscaping at the base of the associated equipment cabinet, and surrounding the site in good condition. Any modifications to the proposed landscape plan shall be subject to review, and approval, by the Zoning Administrator. A. The applicant agrees that the Final Landscape Plan shall, at a minimum, meet the following standards and requirements: 1) The plans shall be drawn to a horizontal scale of 1 inch = 25 feet on sheets 24 inches by 36 inches in size and a vertical size of 1 inch = 5 feet in size. 8 2) The plan shall be developed by, and display the professional seal of, a landscape architect certified to practice in the Commonwealth of Virginia. 3) Landscaping for the site, including a listing of plant materials; details of planting, irrigation and drainage. B. Unless otherwise specified, any tree required to be saved pursuant to this condition, which dies, as determined by the County s Urban Forester, prior to or within three (3) years of the issuance of the Final Building Permit, shall be removed and replaced by the applicant at his expense with the number of major deciduous and evergreen trees consistent with the Tree Replacement Guidelines. Renewed a use permit (U ) for a comprehensive sign plan for People s Drug (now CVS) with no further review. Approved the use permit (U ) for an existing telecommunications facility (for AT&T Mobility) with an existing stealth monopole and an existing cabinet platform, subject to the conditions of the staff report.
