Statement of Terms and Conditions of the services provided by electronic means by Plagiat-Sistem Antiplagiat prin Internet SRL Last revision: 6th of April 2017 General Terms and Definitions - I 1. 1. Sistemantiplagiat.ro is an Internet service owned by Plagiat Sistem Antiplagiat prin Internet SRL, Calea Crângaşi, no. 12, building 26, floor 4, flat 48, District 6, Bucharest, entered in the Trade Register with no. J40-4089-2012, tax code RO 30051510, and with a capital of 200 RON. 2. This Statement defines the Terms and Conditions for the services delivered via the Internet, by Plagiat Sistem Antiplagiat prin Internet SRL, and their complaints procedures. Definitons - II 2. 1. The System or the Internet Antiplagiarism System Sistemantiplagiat.ro created by Plagiat Sistem Antiplagiat prin Internet SRL conducts a text verification to evaluate the degree of plagiarism by a comparison of the text with Internet sources and the database, if the System provides the User with access. 2. A User is any entity who uses the System in any way; 3. The Operator is the company Plagiat Sistem Antiplagiat prin Internet SRL. 4. Service describes any service provided by the Operator via the Internet; 5. The Provider is a company cooperating with the Operator that caters for the financial side of System use. The Provider sends the User codes and caters for online payments; 6. Internet payments are the payments the User makes electronically in order to obtain a token; 7. A token is a unit of virtual payment allowing a User to order a service offered by the System; 8. The code is a sequence of letters and digits that is automatically generated by the Provider, and sent via an SMS text message upon request. The code is necessary in the process of purchasing a token via mobile phone; (this service is available only through Orange, Vodafone and Telekom mobile phone operators from Romania). 9. The handling fee is a fee charged by the Operator to handle the payments made by the User, this occurs without the intermediation of the Provider; 10. The Similarity Report contains document information, the Similarity Coefficients, a list of the URLs omitted, providing the User indicated that certain websites were to be ignored during the analysis of the document and a list of sources in which the System found fragments similar to parts of the analyzed document. Both the Summary Similarity Report and the Full Similarity Report contain the above elements, however, only the full Report shows the content of the analyzed document in which suspect fragments are highlighted in various colours according to the source; 11. The Similarity Coefficient 1 is a percentage value that expresses the degree of similarity found in the analyzed document and it is obtained by dividing the number of words in the fragments found to be similar to source documents by the total number of words in the document. The minimum length of a fragment found to be similar by the System is equal to 5 words occurring in the same form and order; 12. The Similarity Coefficient 2 is calculated using the same method as the Similarity Coefficient 1, however, in this case the System takes into account only fragments of a minimum length of 25 words occurring in the same form and order; 13. The verification of a document of maximum 1.000.000 characters in maximum 24 hours is a paid service. Terms and Conditions of Service - III 3. To ensure the smooth running of the System please comply with the following specifications: 1) Use the Internet Explorer browser (9.x or newer), Firefox (9.x or newer) or Google Chrome (9.x or newer) or Opera (10.x);
2) The browser must have the cookies mechanism enabled; 3) The browser must have JavaScript enabled; 4) The browser must have CSS enabled; 5) The User must register in the System using an active e-mail account. 4. The System can only process one session at a time for one computer. Therefore attempts to work in several windows or accounts simultaneously will fail. 5. The User of any paid service offered by the System must have the ability to perform payments. The payment can be made via bank transfer, credit card, or through an active mobile phone account. To pay via mobile phone the user must possess or have access to an account with a Romanian mobile telephone operator that allows the user to send and receive SMS text within that network. 6. 1. The Operator provides the following Services : comparing the content of a document, presented for analysis by the User with the database of free access content on the internet. The result of this analysis is a Similarity Report which indicates the Similarity Coefficient 1 and Similarity Coefficient 2. 2. The Operator reserves the right to alter the length of the phrases used to calculate the Similarity Coefficients 1 and 2. 7. The Services provided by the Operator through the System website may be either free of charge or chargeable. The following Services are free of charge: the registration of a personal account, the verification of short texts, (this service is available as a demo version, the User can verify up to 5 documents of 500 characters in length per day). The Operator reserves the right to define the type, form, time and the medium of providing the free services. The 1 mil/24h verification service is chargeable. The Operator reserves the right to change the available chargeable services. 8. In order to access the services offered by the System the user must complete the registration form on the www.sistemantiplagiat.ro webpage according to the following instructions: 1) Go to the Register tab and fill in the registration form; 2) All the fields in the form must be completed; 3) The user must provide an active e-mail account because the password to the System account will be sent to the address provided. 4) The fields Name, Surname, Phone number and Company may, however, be completed in any way the user wishes, with the exception of the cases stated in 9. The user is not obliged to provide actual data. This data, if provided, will make it easier for the Service provider to contact you in the case of an error or a complaint. If the user does not wish to provide data he or she should enter the word ERSATZ in the empty fields. 5) Once the registration process is complete the user will obtain access to the System through an individual account. To begin work the user must log in to the account by entering the login (the email provided during registration) and the password (received in an automatic System email), in the section Connect (in the top right corner of the www.sistemantiplagiat.ro home-page). 9. It is forbidden for the User to intentionally impersonate a third party, by providing their data during the registration process. It is forbidden to provide data that does not comply with the labeling standards on the Internet, containing vulgar language or insulting third parties. 10. The user has the right to change or correct his or her data provided during registration. In order to change the user information, log into your account and select the Data Account tab, after that select Edit. Once you've finished editing data, click "Save".
11. If the user loses or forgets their password a new one can be requested. This is done by following the I have forgotten my password link under the login field on the www.sistemantiplagiat.ro homepage and completing the e-mail address used as the System login and press the Send button to send a password request. The System will generate an automatic mail with a link that should be used to confirm the request, this confirmation is required before the new password can be generated and sent to your e-mail account. Personal Data and Privacy Policy - IV 12. 1. At the moment of registration the user agrees to the placement and processing of their personal data by the Administrator, according to the conditions laid down in the Privacy Protection Policy (annex 1). 2. The Administrator of personal data is Plagiat - Sistem Antiplagiat prin Internet SRL, according to the Romanian law, which process personal data of users in accordance with Law 677/2001 and according to the Personal Data Protection Act of 29 August 1997 in Poland. 3. The personal data and information provided in the registration form will be used by the Administrator to draw-up, change or cancel the agreement with the user and ensure the highest quality of the provided services. 4. The user has the right to monitor the processed data at any time, as well as the right to change it or demand its removal from the service. 5. The user is obliged to update the personal data provided during registration immediately if the data changes. 6. In the case of any doubt as to the validity of the data provided by the user, the Administrator has the right to do the following steps: 1) Alerting the user to immediately remove the false data or to update the information, 2) The immediate block of the user account until the situation is clarified. 7. The Administrator is authorized to disclose personal data only to those entities that are entitled to that right according to the proper regulation, the Privacy Protection Policy, these Terms and conditions and the existing law regulations. 13. The Administrator reserves the right to use personal data for commercial activities, statistics, advertising among users, and third parties, in particular the right to direct advertising, informative or commercial content concerning products or Services provided by both the System and third parties to users. Consequently, users agree to receive commercial content attached to correspondence sent through the internal mail system. User also consent to the use and publication by the Operator of statistical information on the results of Similarity Reports. Statistical information will not be identifiable with individual users or Similarity Reports. Service Costs - V 14. To check a document in the 1mil/24h Verification service, the User must be logged in to the System via the www.sistemantiplagiat.ro webpage. For the System to begin an analysis of a document the User must purchase tokens. 15. 1. Tokens can only be used once. One token allows the user to check one document of up to 36.000 characters or a part of a larger document. If the document is bigger than 36,000 characters, then the analysis will not begin until the correct amount of tokens, depending on the size of the document, has been purchased. The number of tokens required to verify a document is displayed during the process of submitting the document for analysis under the content upload field. If the account does not have a sufficient number of active tokens the verification process will not begin. In the case of submitting a number of documents for analysis before purchasing the correct amount of
tokens the System will analyze the documents according to the order in which they were submitted. A token is valid for 6 months after the date of purchase. 2. The cost of a token is 11 RON through credit card payment and 2.46 Euro through PayPal. For the payment via SMS the first token of every transaction costs 4 Euro and 2 Euro for each additional token. 3. A token can be purchased through the Provider by sending a request for a code, or via online payments. 4. The maximum size of a document submitted for verification in the service 1mil/24h Verification is 1.000.000 characters. 5. To analyze a document longer than 1.000.000 characters the document should be divided into smaller documents not exceeding 1.000.000 characters. 6. The price list for tokens and codes is available on the www.sistemantiplagiat.ro webpage and in the user account in the Payments Section. The price list is determined by the Operator and can be susceptible to change. 7. The payment for tokens via SMS is credited by the mobile operator (through the Provider) and charged to the account of the mobile phone user. The method of billing of the mobile phone user does not fall within the scope of these regulations, but is dependent on the contract with the mobile operator that defines the provision of telecommunications services. 16. The Operator does not issue individual invoices for payments made by the user, unless it is requests within 5 calendar days from the transaction. Disclaimer - VI 17. 1. When interpreting the Similarity Report please note that: 1. The System is a program that mechanically traces similarities between documents, without understanding the meaning of the text. For that reason the Similarity Report should always be analyzed by a competent person. In particular, one should not only rely on the Similarity Coefficients the Similarity Report should be carefully analyzed for each document paying special attention to the highlighted fragments to see if they are not in fact properly cited quotes. 2. The System does not indicate which document was created first the document submitted or the document that was found to be a source. For that reason, it is impossible to determine on the base of the Similarity Report alone, which is the copy and which is the original. This can only be determined through an analysis of both documents. 3. Due to the search methods adopted the System may sometimes highlight commonly used phrases such as we can therefore come to the conclusion. 2. The System searches for fragments in the submitted document that are identical to fragments in the available databases, however, there is no 100% guarantee that the similarity between these documents will be traced. This is due to the dynamic structure of the Internet as well as the type of search mechanisms used. The effectiveness of the Internet search is about 95%. 3. Results using the paid verification service are usually available within 24 hours of submitting the document. In some periods, especially during the winter and summer examination sessions, the verification time may be extended to 10 days. In the case of a delay that exceeds 10 days the user may claim a reimbursement for the purchase of the tokens. From the paid sum for which the reimbursement is made, the value of the bank transfer commissions will be retained, as well as a handling fee of 1,55 lei. 4. The conditions set in point 3 do not apply in the case of the free service. Complaint Procedure - VII 18. 1. Complaints concerning the use of the System should be submitted electronically to the address contact@sistemantiplagiat.ro, with the exception of complaints concerning a delay as described in 17 point 3 that should be submitted in letter form.
2. A complaint must contain all user data, in particular: name, surname, home address, e-mail, account login, number of active tokens and information on the document concerned (title and author). 19. A complaint will be considered within 2 working days of submission, unless the complaint is in letter form. Complaints submitted in letter form will be considered within 7 working days of delivery. 20. The reply to the submitted complaint will be first sent to the user s email address. 21. The Operator reserves the right to disregard complaints concerning the verification of the same document with different Similarity Coefficient results. These differences result from the dynamic structure of the Internet, which, although is treated as a database, changes very quickly. These differences do not substantially reduce the quality of the Similarity Report. 22. Reimbursement for the purchase of tokens if the period stated in 17 point 3 was exceeded will occur after the complaint has been considered. The appropriate sum will be reimbursed by a bank transfer to the account indicated by the user within 14 days of a positive consideration of the complaint. 23. The Operator stipulates that word processors may not include all the characters counted by the System in their statistics. This applies in particular to spaces, the transition to a new line and other non-printable characters. The System automatically calculates the number of characters and displays it during the submission process above the field defining the number of tokens necessary to verify the document. Complaints arising from discrepancies in the number of characters shown by the System and other computer programs will not be considered. 24. The Operator is not responsible for any temporary service interruptions, resulting in a failure to access Sistemantiplagiat.ro, which are due to reasons outside the control of the Operator. 25. The Operator reserves the right to introduce short technical service interruptions in the functioning of the System, so as to allow planned operation and maintenance work on the server and System programming. 26. 1. The Operator reserves the right to discontinue service and to block a user s account with immediate effect, in the event of improper use of the System. This applies, in particular, to acts that can be detrimental to the Operator, such as using the System to write papers on demand or for purposes incompatible with the Romanian law. The blocking of your account entails the forfeit of any unused tokens. 2. If a User that has been previously removed from the System due to the violation of the Terms and Conditions set down in this document, the Operator reserves the right to block the new user account. General Provisions - VIII 27. The Operator reserves the right to all decisions concerning the System and any modifications or changes it may suffer, without warning users in advance about the planed modifications.
28. The users agrees that they will use the System only in accordance with the applicable laws especially the copyright law, the Terms and Conditions specified in this document, moral and social principles. 29. The Operator states that : 1) the use of the System is exclusively at the expense and risk of the user, 2) no guarantee can be given that the verification process will not be subject to flaws, errors, or interruptions, 3) no guarantee can be given that the outcome of the verification process will meet the user s expectations to the accuracy or usefulness of the information provided, unless such a guarantee has been explicitly formulated in a document signed by a representative of Plagiat Sistem Antiplagiat prin Internet SRL, 4) no responsibility will be borne for any actions a user may take as a consequence of obtaining information through the System. 30. By purchasing the service the user acknowledges that they have read the description of the System and the Terms and Conditions defined in this document, and that they accept all these provisions unconditionally. 31. In matters not stipulated by this document regulations defined in the Civil Code and other laws shall apply. 32. The Terms and Conditions defined in this document apply from the date on which it is published on the www.sistemantiplagiat.ro webpage. 33. The Operator reserves the right to derogate from these Terms and Conditions only to the benefit of the user.
Annex 1 Privacy Protection Policy Art. 1 Personal Data S.C. Plagiat Sistem Antiplagiat prin Internet SRL, registered office at Calea Crângaşi, no. 12, bl. 26, et. 4, ap. 48, district 6, Bucharest, referred to as Plagiat Romania, as the Administrator of the personal data in the System, cares for the security of the data made accessible, in particular against access by unauthorized persons. Plagiat Romania ensures all registered users the right to monitor their own data, the right of demanding an update or the removal of data as well as the right to file a complaint according to the regulations and the realization of the rights guaranteed by the Law 677/3001 and by the Law 506/2004 for the protection of individuals regarding the process of personal data and the free movement of such data and also according to the Personal Data Protection Act of 29 August 1997 in Poland. particular specified in the said Act. The S.C. Plagiat SistemAntiplagiat prin Internet S.R.L. company is registered with the no. 32761 in the ANSPDCP (Autoritatea Naţională de Supraveghere a Prelucrării Datelor cu Caracter Personal). Art.2 Technical Issues Information contained in system logs can contain different data, such as the users IP address. Plagiat Romania uses this data only for technical purposes or to gather general statistical information. The above data can be disclosed to authorized entities according to the regulations in force. The System uses cookies, a text string stored by a user s web browser that identifies the user and allows certain operations. Cookie files are used mainly to store login information. The function will work on the condition that the cookies are activated in your web browser and the files are not canceled from the disk. Art. 3 Trade Information The Administrator reserves the right of sending the user messages. These will include messages containing information relating directly to the functioning of the System (e.g. changes in the functions), or non-commercial messages (e.g. wishes, information regarding new messages, system communications). Every user has the right to stipulate that they do not want to receive System messages. All content concerned with the commercial activity of the Administrator and their partners will only be sent to the user once they have given consent. Art. 4 Canceling the user account Withdrawing the agreement by the user is voluntary and can occur at any time. The user should send an email with the appropriate demand to the address: contact@sistemantiplagiat.ro. Withdrawing the agreement on providing services by electronic means will result in the cancelation of the user s account.
