Promotion Campaign: Pre-paid e-home 100Mbps and 200Mbps Broadband Package (Fiber Network) 2. Promotion Period: June 1, 2015 to December 31, 2015 3. Product for Promotion: Pre-paid e-home Broadband Service (unlimited usage) 4. Promotion Target: All household customers of newly installed pre-paid broadband service across Shanghai Municipality (limited to FTTH ) 5. Details of Campaign: 5.1. Details of Package: Package Includes Bandwidth Package Fees Basic Monthly Fee for Broadband One-off Fee Service Waiver 100M (100 Mbps CNY 1900/ Line 12 months downstream, 4Mbps CNY 3600/ Line 24 months upstream ) All one-off fees 200M are waived. (200 Mbps downstream, CNY 3200/ Line 12 months 20Mbps upstream) Note: One-off fees include installation and testing fees of CNY 300/line and handling fees of CNY 10/line. 5.2. Package Description
5.2.1. This package is limited to one pre-paid broadband connection. 5.2.2. At the time of application, the Customer is required to choose one of two payment methods: a one-time payment of all service fees in accordance with the connection speed selected at our sales outlets, or account top-up after the broadband connection is set up. 5.2.3. After the broadband connection is set up, customers participating in this promotion offer will be assigned a user name and password for network access. Customers who choose to make a one-time payment of all service fees can connect to the internet with their user name and password immediately, whereas customers who choose to top-up their account after the broadband connection is set up are required to make the top-up immediately to pay all package fees in full before they can enjoy the broadband service. 5.2.4. No fee is charged for the month of service commencement. The service period of the broadband package begins on the first day of the month after the broadband connection is set up. 5.2.5. After the service period of the broadband package expires: If the Customer does not wish to continue with this package, they are obliged to visit our sales outlets one month in advance to apply for package termination. The Customer is then liable to pay a monthly service fee based on the standard rates of the selected product offering, or they can choose to participate in other promotion offers of China Telecom Shanghai available at the time of package termination. If the Customer no longer wishes to use a pre-paid broadband service, they are obliged to visit our sales outlets one month in advance to apply for service termination. After the end of the service period, if the Customer does not change their service subscription or terminate their account, China Telecom Shanghai shall not terminate the communications services provided to the Customer if it remains capable of providing the Customer with the package specified in these Terms and Conditions and if there is no outstanding balance in the said Customer s account. As the broadband service is provided on a pre-paid basis, the Customer is obliged to top-up their accounts one month before the end of the service period (one-off top-up of either 12-month or 24-month broadband service fees according to the package selected). 5.2.6. Top-up Method: The Customer can purchase top-up cards issued by China Telecom
Shanghai and dial 11888 to top-up their prepaid broadband account, or they can log in to the Online Shop of China Telecom Shanghai (www.189.cn) to make a top-up via online banking among other methods. After making a top-up, the Customer can check their account balance by logging in to the Online Shop of China Telecom Shanghai (www.189.cn). 5.2.7. For all other unspecified charges, the current effective standard rates apply. 5.2.8. Family broadband service supports internet access for up to 4 computers at any one time sharing the bandwidth offered in the basic package. China Telecom Shanghai shall not guarantee the quality of connection if the number of computers connecting to the internet exceeds the agreed number, and reserves the right to terminate the Customer s broadband connection. 6. Notes to Customers: 6.1. If the balance of the Customer s pre-paid broadband account is insufficient to cover the basic service fees for the entire duration of the package, China Telecom Shanghai shall suspend the Customer s broadband service. The Customer can top up their account by purchasing a China Telecom Top-up Card and dial 11888, or by logging in to the Online Shop of China Telecom Shanghai (www.189.cn) within the first 90 days of service suspension. Once the account balance is sufficient, broadband service will resume automatically. (The service period remains unchanged; the suspension period shall not be excluded from the duration of the package.) If the account balance remains insufficient after 90 days, China Telecom Shanghai shall terminate the broadband service provided to the Customer. 6.2. During the validity of the package, China Telecom Shanghai shall not entertain requests for service suspension with number retention as well as account transfer. 6.3. During service period of the broadband package, the Customer cannot switch among the three packages of this promotion campaign. 6.4. During the first service period of the selected broadband package, in the case of service termination or change of package subscription, the Customer will be considered to have withdrawn from this promotion campaign. The Customer is required to pay all outstanding charges and a pre-mature contract termination penalty equivalent to two times the basic monthly fee for one-year package subscription (12-month package fees/12*2) and four times the
basic monthly fee for two-year package subscription (24-month package fees/24*4). Customers who have enjoyed waivers of one-off charges are obliged to reimburse China Telecom Shanghai in full for the said waivers. 6.5. If necessary, customers participating in this promotion offer are entitled to use a set of broadband connection equipment free of charge. However, the equipment shall remain the property of China Telecom Shanghai. The Customer should use and take care of the equipment offered free of charge by China Telecom Shanghai properly. In the case of damage of equipment due to the Customer s responsibility, they are obliged to pay compensation to China Telecom Shanghai that is equivalent to the value of the equipment. The Customer shall not lend, rent, sell or gift the equipment to a third party, or use it for service(s) not offered by China Telecom Shanghai without the consent of China Telecom Shanghai. China Telecom Shanghai reserves the right to terminate the broadband service provided to the Customer in the case of such violation(s). If the Customer withdraws from the package on their own accord, or if they choose not to continue using the broadband service of China Telecom Shanghai upon contract expiry, they are obliged to return the equipment to China Telecom Shanghai in good and working condition. Alternatively, they can reimburse China Telecom Shanghai for the cost of the equipment offered to them (Household gateway: CNY 215/ device; ONU (for FTTH connection customers): CNY 360/device). 6.6. If a customer participating in this promotion offer applies for new broadband installation, they may choose one of the following two options for registration: deposit (preferred) or native Shanghai citizen as guarantor. Customers who choose deposit is required to pay a one-off deposit of CNY 200/line. The deposit will be fully refunded to the Customer if they switch to guarantor or when they return the broadband connection equipment upon service termination. In order to be eligible for the refund, the Customer is required to present the original deposit receipt. 6.7. If China Telecom Shanghai is unable to provide the accorded package, notification of package termination shall be given to the Customer one month in advance. 7. During the validity of these Terms and Conditions, China Telecom Shanghai shall provide communications services in compliance with The Telecom Regulations of the Peoples Republic
of China and related ordinances and regulations. In the case of violation, Chine Telecom Shanghai shall take responsibility for contract violation. 8. These Terms and Conditions serve as a supplementary agreement to the Service Agreement of China Telecom Corporation Limited Shanghai Branch and the Broadband Service Subscription Agreement of China Telecom Corporation Limited Shanghai Branch (The valid version at the time of subscription shall prevail). Should the aforementioned agreements interfere with the contents of these Terms and Conditions, these Terms and Conditions shall prevail. The Customer Registration Form of China Telecom Corporation Limited Shanghai Branch is a component of these Terms and Conditions. These Terms and Conditions shall become effective after the Customer signs the Customer Registration Form. The Customer s signature on the Customer Registration Form serves as proof of their confirmation and signing of these Terms and Conditions and the aforementioned agreements.
