Description: Sigma Corporation of America ( Sigma ) provides this Sigma University Discount Program (the Program ) to eligible students, faculty, and institutions participating in photography related programs. The Program is provided by Sigma at its sole convenience, and the entire Program, portions of the Program, benefits available under the Program, and any Dealer participation in the Program, is subject to Sigma s sole discretion. By participating, you agree to be bound by these terms and the decisions of Sigma on all matters related to the Program. You will receive benefits on the conditions described in these terms. 2. Eligibility: Benefits under the Program are open to (a) higher education faculty members teaching a photography class; (b) full-time, higher education students enrolled in a photography class; and (c) accredited educational institutions providing photo courses. Eligibility is subject to Sigma s sole discretion. 3. Benefits: Sigma will make available select Sigma products at prices and on terms to be provided by Sigma and its dealers. Benefits are only provided through authorized participating Sigma dealers. Benefits and discounts may not be combined with any other discounts, including but not limited to any retail discounts, rebates, or other discounts or program. Limit of five (5) lenses purchased per year (any 365 day period), measured from the date of first purchase. Sigma may impose further limits on the number of products available for purchase, at any time, even after orders are submitted. Purchases of duplicate lenses are net permitted. Sigma further reserves the right to cancel any order even after confirming the order. In such instances, Sigma will provide a refund of the entire purchase price. Any price reduction benefit after purchase expires 14 days from date of purchase. 4. Eligibility Documentation: For all sales, in order to qualify you must provide the following documentation to a participating Sigma dealer: (a) for students, a copy of your student ID, and if your student ID does not show you to be currently enrolled in a photography course, a copy of your schedule demonstrating such enrollment; (b) for educators, a copy of your ID showing current employment and course schedule or syllabus; and (c) for institutions, a school purchase order. 5. Changes; Modifications; Corrections: Sigma reserves the right to terminate, modify, revise, or change the Program and these terms, in whole or part, at any time with or without notice. Sigma reserves the right to correct pricing errors that may inadvertently occur, and will not be held to any incorrect or inaccurate posted prices. 6. Jurisdiction: This Program is available only within the U.S., and these terms shall be governed by, construed, and interpreted under the laws of the State of New York. Sigma will not ship products to an address outside of the U.S. The Federal and State courts of the State of New York shall be the exclusive court of jurisdiction in the first instance for any disputes regarding these terms. You agree that all disputes which cannot be resolved between the parties shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys fees, other than member s actual out-of-pocket expenses, and member further waives all rights to have damages multiplied or increased.
