4 1 Scope This document sets out the terms and conditions which govern the relationship between MIX and telecommunications services operators who wish to install their equipment in MIX premises set up as data rooms for the primary purpose of supplying connection circuitry to MIX for ISPs operating on Italian territory and abroad. 2 Introduction MIX s.r.l. has set up in Milan the Milan Internet exchange (hereinafter MIX ), a neutral interconnection point between ISPs operating in Italy and abroad in order to optimise efficient data exchange among them. In line with its company aims, MIX intends to favour the presence in its data rooms of telecoms services operators so that its ISP clients may benefit in economic and redundancy terms as far as regards their geographical connection to MIX. The service hereunder is not to be understood as a stand-alone housing arrangement, which is not one of MIX's company aims. Access to MIX is offered to all operators whose aims are specifically sale of access circuitry to MIX clients. Acceptance of an operator is subject to the approval of the MIX Technical Committee and will be notified to the MIX Board of Directors who exclusively holds the power to intervene in decisions taken by the Technical Committee. The service hereunder is aimed at telecoms operators who can supply access circuitry to MIX via the laying of their own circuitry. 3 Who the service is aimed at The service hereunder is aimed at telecoms operators who can supply access circuitry to MIX via the laying of their own circuitry. Should the operator also wish to access the Milan Internet exchange peering layer 3 services or to provide Layer2 connection services, the relative service Agreement should be underwritten. 4 Available Services 4.1 Supply of geographical circuits for MIX clients The supply of geographical access circuits for allowing ISP to access MIX is the main service for which an operator is authorised to install its equipment within the MIX data room. 4.2 Interconnection between equipment of different operators This is an extension of the main service, on the condition that such activity shall at all times remain true to MIX company aims. This service is available where 4.1 is in effect. The service offers the possibility of physically connecting owned transmission equipment and/or optical boxes to those of other operators present in the MIX machine room to provide circuits to ISPs present at MIX premises, for uses not related to the connection of the ISPs backbone to the MIX peering LAN. It should be noted that the connection is purely at level 1(physical) and shall by no means be carried out at level 2 (switch) equipment or higher hour access to MIX data room For those operators present in the red wing (see prf.5.1), MIX s.r.l. offers a 24-hour, 365-day-a-year call-up service (H24) for any operation to be carried out on its equipment and/or circuitry located at MIX, subject to an annual fee (see Annex B). Operators subscribing to this service may access MIX premises within 2 hours after the call or contact MIX during emergency service hours in the forms and according to the criteria set forth under Section 6 of this annex. For those operators not present in the red wing but just in the green wing, MIX s.r.l. offers a 24-hour, 365-day-ayear call-up service (S24), subject to a cost per each operation. Page 4 of 8

5 5 Data room features 5.1 Technical features The MIX machine room has been functionally and logically separated into three distinct areas: one dedicated to the installation of transmission equipment of operators who provide accesses to MIX in their own racks and designated the Ala Rossa (Red Wing); one dedicated to the installation of optical boxes for operators not requiring the use of owned racks, designated the Ala Verde (Green Wing); one dedicated to housing the equipment of ISPs accessing MIX with its own features and not herein described, designated the Ala Blu (Blue Wing). Ala Rossa: this area is typically used by operators who terminate their geographical flows on equipment (e.g. ADM or SDH or others) installed in their own racks and with their own characteristics; MIX has set up in this area: a -48 Volt power bay for the supply of power to the transmission equipment; metal underfloor ducts for the laying of external fibres which connect external operator PoPs to own PoP in MIX premises and which come from the underground channel provided by the owners of the campus; underfloor metal ducts for the laying of fibre retransmission connection from own distribution frames (ODF) to the racks in the Blue Wing of the data room; overhead ducts for the laying of interconnection circuitry at a physical level between the different operators; air conditioning plant set to keep the temperature between 19C and 21C and humidity at 45%; a UPS, uninterrupted power system: the -48V power bay is supplied with its own battery system (UPS) which feeds from the general MIX generator set. Ala Verde: this area is typically used by operators who do not need to close geographical rings but who lay fibre pairs from their own point of presence (generally but not necessarily located within the Via Caldera campus) to the MIX data room; MIX has here set up: shared racks for the installation of optical boxes; fibre precabling from these racks to those present in the Blue Wing which house switches for the supply of the peering Layer 3 service; overhead duct arrangement for the laying of interconnection circuitry at physical level between the different operators. 5.2 Functional features To guarantee the correct use of common resources operators collocated at MIX are required to carry out the connection between the MIX- housed PoP and their own PoP outside MIX with certified fibre on their own termination apparatus. The laying of single copper geographical circuits (telephone loops) for the connection of ISPs, common clients, or for other uses, is not permitted. In the case of circuitry laying for ISPs who connect to the MIX peering LAN, these shall be understood to terminate on the active equipment of the ISP collocated at MIX in the area of the room set up for this purpose and the final connection is the responsibility of the operator who shall also be responsible for its functioning. 5.3 Security and Safety From the point of view of security, the equipment installed at MIX is protected from undesired or unrequested access both from the physical and the functional point of view. Functional sub-systems in place to guarantee the required security and safety standards are: a. fire and flood-prevention systems; b. anti-intruder system; c. uninterrupted power supply; d. physical access control management. 6 See the document Security System (Ref.MIX-303e) for more details on the existent plants. 6 Logistic Information 6.1 Service hours Ordinary service hours are: from Monday to Friday, 8 am to 8 pm excluding national and religious holidays and those under the contract in force at MIX s.r.l.; Extraordinary service hours are: all those not set forth under the preceding point. MIX has available a 24-hour, 365-day-a-year call-up service for operators who subscribe to the service under 4.3 of this annex. All installation operations for new apparatus or in any case operations which do not require interruption to the operator service in place shall be carried out during ordinary service hours, if not differently agreed with MIX. 6.2 Access to MIX premises Access to the MIX data room is permitted only to such personnel as authorised by the operator itself who shall notify to MIX the names of the people who are to access the data room. Access requests to MIX premises shall be notified as follows: for ordinary maintenance, by completing the on-line form at: with at least 3 days' notice prior to the date of the operation, or by telephone to MIX on , or by to the MIX Network Operation Center (NOC) (noc@mix-it.net) to arrange the required operation; for extraordinary maintenance which cannot be pre-planned during office hours, by telephone to MIX on , or by to (noc@mix-it.net) to arrange the required operation; for urgent extraordinary maintenance outside office hours (only in the case of subscription to the service under 4.3), by telephone to the technician who can be contacted at the NOC numbers indicated by MIX; in all cases access to MIX premises on the part of the client company's authorised technicians shall be recorded on an access register;; in the case of installation, withdrawal or substitution of equipment collocated in MIX premises an inventory form shall be completed indicating all the material and installed equipment belonging to the client; in the case of laying of circuits, the identification tag of the circuit itself shall also be recorded. 7 Procedures 7.1 Access procedures for operators In order to access MIX each operator: a. shall provide to MIX a document showing the routing of its fibre within the campus, (terminal points of the bundles of fibre); b. shall advise the MIX Technical Office of the technical specifications of its configuration (number of racks or halfracks, electrical specifications, number of optical boxes and all else useful for the provision of service) regarding the base configuration and where possible, a two-year forecast for the final configuration necessary; c. undertakes to ensure optimal use of the space occupied in the MIX data room; d. shall identify each individual component housed by MIX via appropriate labelling to give clear indication of ownership; e. shall arrange fire, theft and third-party liability insurance cover for the equipment installed in the MIX data room; f. shall give notice to MIX of the names of those persons authorised to access the MIX data room for work on its equipment; MIX authorised personnel shall at all times accompany such persons as no unaccompanied Page 6 of 8

7 access is authorised to the MIX data room; g. shall provide 24-hour, 365-day-a-year telephone numbers and addresses for any communication from MIX. 7.2 Operational procedures for operators Once their equipment is installed, operators shall communicate to MIX the specifications of any operation on their installed equipment and/or circuits: a. for the laying of circuitry relating to ISP connection to MIX peering LAN, notify to MIX the name of the common client who has requested the circuit, the identification of the circuit, the departure point of the circuit. Notice is given that the connection of an ISP to the peering LAN is subject to acceptance by MIX of the ISP: work therefore on such circuits may be carried out in the case where the ISP has already received approval from MIX of the request of adhering MIX; b. for the laying of circuitry for interconnection to other operators, the requesting operator shall submit a formal request to MIX (via signed letter which may also be faxed) indicating the characteristics of the circuitry and attaching an authorisation to proceed signed by the operator to whom the interconnection is requested. As MIX does not authorise any company to carry out such operations on equipment not belonging to them, unless otherwise authorised, technicians from both companies shall be present during laying of the circuitry; c. for the laying of circuits to the ISPs equipment for the usages described under 4.4, the requesting operator shall send a formal communication to MIX (via signed letter which may also be faxed) indicating the ISP, customer of both the operator and MIX, and the characteristics of the circuits. The connection of the circuitry to the ISP equipment shall be previously authorised by the ISP itself. 7.3 Procedures for MIX For optimum provision of service, MIX: a. will agree with the operator the electrical and physical dimensions required for the initial installation of the equipment; b. will agree with the operator on installation dates for the equipment; c. after viewing the authorisation from the Assicurazioni Generali, will grant its own authorisation to the operator and to the company contracted for the laying of the fibre from the terminal point to the MIX data room according to the routing presented by the operator; d. will provide the necessary telephone numbers and addresses for any notices from the operator; e. will agree with the operator on access to the data room for ordinary and extraordinary maintenance operations. 8 Restrictions The restrictions below are set on the basis of the features of the MIX data room in Via Caldera, 21 Building D/3: a. with base configuration each operator has available: a. a maximum physical space equal to the size of one (1) standard rack (600x600), if the operator requests installation of its own racks (Ala Rossa of the data room); or: b. a maximum physical space equal to the installation of one (1) optical box if the operator does not require use of its own racks (Green Wing of the data room) and up to three (3) circuits to the peering LAN. b. each operator may have additional physical space; availability of additional space is in any case subject to the actual availability of space existing in the MIX room and to the assessment of the MIX Technical Committee; c. a maximum amperage of 63 Amps at final configuration; Note should be taken that such restrictions may be broadened or reduced on a case by case basis, following assessment and a final decision by the Board of Directors. 8 9 Charge Criteria Annual fees are set annually as provided by the Statute by the MIX Board of Directors. Criteria according to which annual fees are set are based on: which of the two possible areas of the MIX data room available to accepted operators is used; whether the operator offers the primary service under 4.1; whether the operator requires one of the additional services.
