3 1. Building codes enforcement EU practices The OECD report: Regulatory Enforcement and Inspections, OECD Best Practice Principles for Regulatory Policy, 2014 underlines that:.. ensuring effective compliance with rules and regulations is an important factor in creating a well functioning society and trust in the government, and is necessary to effectively achieve a government s goals. The major challenge is to apply enforcement strategies that deliver the best possible outcomes by achieving the highest levels of compliance, while keeping regulatory costs and administrative burdens as low as possible. 3
4 1.1 The approach An enforcement system is established through dedicated regulations for buildings energy performance mandatory requirements: EU Directives: Directive 2002/91/EC of the Energy performance of buildings Directive 2010/31/EC of the Energy performance of buildings (recast) National Laws on energy efficiency and on construction, Regulations, Ordinances, Guidances Accreditation system for Licensed experts 4
5 1.2 Instrument for enforcement: Building s energy passport (EP) specific annual energy needs 5
6 The energy passport of a new building contains an indication of compliance with minimum technical requirements from a building code (ECBC) In EU an energy passport or energy performance certificate must be presented when selling, leasing, renovating, extending or constructing a non-residential building. In the case of new non-residential buildings, the energy performance certificate provides information on the calculated energy needs of the building in question as well as its CO 2 emissions based on data relating to: primary energy needs (heating, cooling, ventilation, lighting); weighted final energy needs; CO 2 emissions. 6
7 In the case of existing non-residential buildings, the energy performance certificate provides information on the measured energy consumption (thermal and electrical) of the building in question. The energy performance certificate is issued by licenced experts for new non-residential buildings (architects or consulting engineers who are members of the Order of Architects and Consulting Engineers and accredited by a competent national body). Applicants are responsible for contacting and paying their chosen experts. 7
8 1.3 Responsibility for compliance 1. Holder of the building permit 2. During the design stage, when obtaining the building permit 2. When the construction phase is finished by issuing of energy passport as built proof of compliance 3. After a year of operation 8

10 1.6 Independent quality controls of energy performance calculations 1. Responsible authority > central or regional government, or a governmental agency > third parties - the accredited bodies responsible for experts certification 2. Means of controlling > validity check > prohibited impossible values > warning for improbable values > comparing with results in database 10
11 1.7 Sanctions for Noncompliance The imposition of sanctions is an essential part of the enforcement system. Usual sanction is that the building permit is not granted, but also: > the use of the building is prohibited > the obligation to take extra measures until the building complies, within a certain period; > administrative fines > court cases 11

Programs for EE improvement of existing buildings Existing buildings are still inefficient and responsible for majority of energy consumption in the building sector Therefore EU made mandatory requirement for each member state to refurbish annually 3% of public buildings stock. THE RENOVATE EUROPE CAMPAIGN Renovate Europe is a political communications campaign with the aim to reduce the energy demand of the EU building stock by 80% by 2050 compared to 2005 levels through legislation and ambitious renovation programmes. 12

Approach to ECBC implementation i) WEB based implementation platform (EMIS) Unique access point and support for all ECBC stakeholders: BEE, ULBs, Developers, Designers, Third party assessors, General public ii) Common calculation methodology National Software for calculation of the overall energy performance of buildings as defined by ECBC iii) Energy Pasport (EP) of a building > EPs result from National software calculation > EPs provide confirmation of ECBC compliance > EPs serve as transparent communication on energy performance of buildings - BEE star rating 16

18 4. Conclusion Through effective enforcement of minimum buildings energy performance standards, new buildings in EU today consume only half as much energy as typical new buildings from the 1980s. Existing buildings are still inefficient and responsible for majority of energy consumption in building sector, therefore EU made mandatory requirement for each member state to refurbish annually 3% of public buildings stock. This will bring the energy performance of the entire building stock in the EU to an NZEB performance level by The corresponding money savings due to improved EE, would amount between 2 6% of annual budget of EU member states. 18
