1 Application for an order of the Tenancy Tribunal to recover body corporate levies UT002 (04/15) WHAT THIS FORM IS FOR Use this form to ask the Tenancy Tribunal to order a unit title owner to pay overdue body corporate levies. You need to make a separate application for each unit you wish to recover levies from. HOW TO APPLY To make this application, you need to have made a demand for the levies, and you need to attach it to this application. To make this application online, you must have an address, which we will use to contact you. You need to fill in ALL sections of the form: Section 1 The body corporate involved in this dispute Section 2 The person making this application Section 3 About the other party Section 4 The money you are claiming Section 5 Help available Section 6 Declaration and attachments You will need to attach electronic copies of documents to support your application. You will need to attach: evidence showing the body corporate has authorised you to make this application the demand sent to the other party for payment of the levies the computer register (certificate of title) to confirm the other party s ownership the resolution that confirms the figure for the levy, for the relevant financial period evidence of collection costs, if you want to claim these. HOW TO PAY The fee for this application is $850. When we receive this form we will let you know how to pay. The Tenancy Tribunal can order the other party to pay you the application fee, if your claim is successful. 2 WHAT HAPPENS NEXT The Ministry of Business, Innovation & Employment will contact you and arrange for you and the other party to attend mediation or a hearing in the Tenancy Tribunal. If the Tenancy Tribunal upholds your application, it will issue an order requiring the other party to pay. This can be enforced by the Ministry of Justice Collections Unit. ABOUT THE INFORMATION YOU SEND US We will share the information in this application with the other party. If you do not fill in this form completely or send us all the information we ve asked for, we may not be able to process your application. Demand This is a letter or notice to the other party telling them to pay the levy. Evidence This is a document that confirms information you give us, such as a resolution that confirms the body corporate authorises you to make this application. Levy This is the amount charged by the body corporate on each of the unit owners, which is used to pay for running the development. Other party A party is a person or people forming one side of this dispute. The other party is the person or people on the other side the person or people you are making this application against.
