1 TERMS OF USE FOR E-CLUB - DOCUMENTS TO BE RETAINED BY USER - ARTICLE 1. Facilities offered by e-club PRELIMINARIES The Company provides the User with an electronic facility known as e-club, accessible on its website The present Terms of Use define the limits and procedures for the use of e-club by the User. The term Terms describes the present Terms of Use for «e-club», of which the attached User Information Sheet is an integral part. The term Company means Cardif Lux Vie, as the provider of e-club. The term Policy means an insurance or capitalisation product issued by the Company. The term e-club means the secure extranet facility created by the Company, the content of which is specified in Article 1 of the present Terms. The access to this facility is reserved only for Users. The term Representative means the person nominated by the User who will be authorised to access information relating to the contract(s) via e-club. The term User means a person who has accepted the present Terms and whose identity and status are specified at the end of these Terms e-club gives the User access to general information on individual policies and related documents, such as, for information, performance records, forms, descriptions of cover, movement records and fund lists. In as far as applicable, it is mentioned that e-club does not allow transactions such as switches, surrenders and premium payments on policies. The forms are accessible on e-club and should be duly completed and returned to the Company Access rights are user-specific and may vary depending on: - the User s status, as indicated at the end of the present Terms, and - the nature of the Policy submitted to consultation. The Company reserves the right to provide the requested access or not The content of e-club has a purely informative character. The Company does not guarantee that the data, information or documents provided by the Company or third parties, accessible on e-club, is up-to-date, exhaustive, accurate, reliable or appropriate. 2 ARTICLE 2. Use of e-club ARTICLE 4. Obligations and Liability of the User 2.1. E-Club can be accessed securely from any computer with an Internet connection, subject to the entry of an access code (username, password and card-code). The User Information Sheet attached to the present terms gives precise instructions on how to access e-club and to use the services offered. For further information, the User should contact the Company s helpdesk on: (+352) during office hours (from Monday to Friday, from 8am to 12am and from1pm to 5pm CET) Access to e-club is subject to the overall availability of the Company s IT infrastructure, which is subject to shutdowns on a punctual or regular basis notably for maintenance, upgrade, repair or other purposes The User acknowledges and accepts that the use of e-club is subject to acceptance of the present Terms and attached User Information Sheet, together with any amendments or updates, communicated by an appropriate means, including an announcement on the Company s website The User assumes full responsibility for the direct or indirect use of e-club, as well as the identification and security information defined in the attached user notice, which is strictly personal, confidential and non-transferable. For security reasons, the User agrees not to store his/her username, password and cardcode together. In case of loss or dispossession of identification and security details, the User undertakes to inform the Company accordingly without delay. The Company also reserves the right to suspend access to e-club permanently or temporarily without justification The website is certified by the trusted provider of authentication services «VeriSign», which guarantees that Users will be logged on to the Company s website. However, the Company provides no guarantee against damage or inconvenience directly or indirectly caused by a virus not detected by the Company s security system or, in general, technical malfunction due to the User, the Internet, other computer systems or third parties The right to use e-club and data, information or forms extracted from it is strictly personal and non-transferable and the User will be liable for any transfer, amendment or reproduction thereof. The User commits himself to immediately notify the Company of the loss, misappropriation, theft or fraudulent use of data, information or forms taken from e-club. ARTICLE 3. Charge for e-club Access to e-club is free of charge. However the Company reserves the right to adjust the charges applied for e-club at any time, subject to a notification to the User by any appropriate means, including an announcement on its website. Under these circumstances, the User will be entitled to terminate the present Terms, as laid down under Article below, within 15 days from the date of the charge adjustment. When this time limit has expired, the revised charge will be deemed to have been accepted by the User. The User will be solely liable for direct or indirect loss or damage resulting from illegal, fraudulent, incorrect or improper access to or use of e-club, as well as such attempts, in particular resulting from failure to comply with elementary security instructions, instructions defined in the present Terms or the actions of third parties The Company can not in any way be held liable for negligence or failure to comply with legal, regulatory or administrative obligations imposed to the User in relation to the use of e-club. ARTICLE 5. Data Protection Under the Luxembourg Data Protection Act of 2 August 2002, as amended, in affixing his/her signature, the User explicitly authorises the Company to use his/her address (mentioned on the application form for e-club access) for the purposes indicated on the form in question Personal Data obtained by the Company from the User under these Terms or thereafter will be processed by the Company; the processing manager will be the Company. The User will have a right of access, correction and deletion of his data, to be exercised by submitting a written request to be sent to the postal address of the processing manager: Cardif Lux Vie Société Anonyme Sales Support B.P. 691 L-2016 Luxembourg 2 Any expenses associated with the use of e-club, i.e., charges for Internet provision, telecommunication charges, etc, will be payable by the User Personal data may be held for the duration of the Policy and for as long as necessary to enable the Company to comply with its legal obligations based on applicable limitation periods. 3 ARTICLE 6. Amendments and Updates In the event of amendments or updates to the present Terms or the facilities offered on e-club, the User will be entitled to terminate the present Terms in accordance with Article below within 15 days from the date of the amendment or update. When this time limit has expired, the amendment or updates in question will be deemed to have been accepted by the User. ARTICLE. Term and Termination The present Terms have been drawn up for an indefinite period and may be terminated without reason at any time by the User or the Company subject to one month s written notice to this effect. However, the Company may terminate the present Terms with immediate effect under the following circumstances: - failure on the part of the User to comply with the present Terms, including the attached User Information Sheet; - events which call into question the reputation or solvency of the User; - termination of the contractual relationship between the User and the Company for any reason whatsoever. Should the present Terms be terminated for any reason whatsoever, the User agrees to return his/her card-code and all document or information issued by e-club immediately. ARTICLE 8. Should you wish to log in to e-club, please provide your: - username, composed of 6-8 digits - personal and confidential password - card code consisting of 4 sets of 4 digits each. In the interests of confidentiality, this information will be sent to you by post in two separate letters to the address you have specified. HOW YOUR FIRST LOGIN WORKS 1 - Visit the website uxvie.lu 2 - Click on the e-club logo which appears on the homepage 3 - Enter your username, password and the 4 missing digits in your card code series. Select your preferred user language. Then click on «go» to log in. 4 Warning: Should you enter an incorrect password 3 times, your access will be blocked. Should this happens, please contact our Helpdesk to reactivate your access.
