The Act allows the Director to provide an exemption for the number of committees for a workplace, in order to meet the special circumstances of that workplace. A written request from both the employer and workers must be sent to the Director. **The Director of Workplace Safety and Health may consider issuing a written order of exemption if an applicant's proposed alternative to a regulatory requirement ensures health and safety of workers and meets at least one of the following two criteria: (1) Provides protection for workers equal to or greater than the protection established by the provision to be varied, or (2) Has substantially the same purpose and effect as the provision to be varied. A variance may be proposed in regards to a specified workplace or a specified work process.

The Director will review the appeal and either uphold or repeal the order, issue a new order, or a combination thereof. If the decision is still unsatisfactory, an appeal with the Manitoba Labour Board may be filed within 14 days of the Director s decision.
