GENERAL TERMS & CONDITIONS FOR APPOINTMENT OF CONSOLIDATOR FOR ATT BANGALORE 1. Should own minimum of 5 Coaches ( High Tech 35 Seater registration not earlier than 2003). 2. Should have minimum of three years of relevant experience. 3. Should be willing to furnish a Bank Guarantee equivalent to 30 days turn over. 4. EMD of Rupees One Lakhs by way of Draft drawn in favour of ATT Bangalore to be enclosed with Technical Bid. 5. Separate Covers to be submitted for Technical and Financial Bid duly sealed and superscribed. a. Technical Bid for Consolidator ATT Bangalore b. Financial Bid for Consolidator ATT Bangalore 6. The Completed Tender Forms should be submitted to Sr. Manager (ATT) Bangalore before 3pm on the last day of the submission and Tenders would be opened at 4pm on the same day at ATT Office 33, Race Course Road, Swiss Complex, Bangalore 01. 7. The Consolidator for Bangalore Conducted Tours should have an office centrally located with experienced and trained staff. 8. The Consolidator should give a minimum guarantee of business. 9. The Tours would start and terminate from a point specified by ATT under the supervision of ATT. 10. The Consolidator can only issue reservation slips to the customers and ticket will be issued at the point of final departure in exchange of reservation slips to the passengers before commencement of the tours by ATT. 11. The Consolidator should only use the services of the Hotels and Tour Escorts approved by the ATT. 12. The Consolidator should deposit commission due to ATT as per the agreement every Monday before the departure of the tour. 13. All expenses are to be paid by Consolidator. 14. The design for display boards will be given by ITDC and the same to be used by Consolidator and Sub Agent. a. The Consolidator can appoint Sub-Agents with approval from ATT for only for ITDC Tours. b. Any violation of the above would entail immediate cancellation of he arrangement with ATT. 15. The required Brouchers for Tour programmes will be printed by the Consolidator. Any other kind of publicity material with ITDC/Ashok Travels & Tours logo should not be printed and used by the Consolidators under any circumstances. 16. Any complaints from the customers are to be addressed both by the ATT and Consolidator. And any claims from the customers are to be made good by the Consolidator. For any Consumer Court complaints and proceedings the Consolidator will be primarily responsible. 17. The Consolidator should not collect any other charges from the Customers apart from the tour price. 18. Any other services apart from the specified services provided by the Consolidators will not make ITDC/ATT liable. 19. Utmost care should be taken by the Consolidators to up hold and preserve the image and reputation of ITDC/ATT. Contd 2 ---2---
20. ITDC can terminate the arrangement with Three-month notice.. 21. All claims against ATT of ITDC arising out of deficiency of services, dissatisfaction, inconvenience to passenger s, any deviations in the tour, mental agony, hardship, misrepresentation of acts either intentionally or unintentionally or otherwise, pecuniary loss suffered by passenger s owning to the above and other acts of omission and commissions of the consolidators or their sub agents or representatives or staff, employees of consolidator or other sub agents shall be passed on to the consolidator. Such claims of damages shall be made good in full by the consolidator immediately upon being notified to the Consolidator by the Management of ATT shall reserve the right to settle such claims and make necessary adjustments against the dues to the Consolidator or take other steps as may be necessary to effect the recovery of such dues from the Consolidator. The decision of the management of ATT on the pecuniary compensation for the extent of damages suffered by the passenger s against claims received shall be binding and final. In the event of passenger s dissatisfaction the claims settled resulting the passenger s proceeding against the ATT in any other forum such as Consumer Courts, Courts of Law etc., the consolidator shall be deemed to be the respondent and shall abide by the decision of such forum to effect settlement of such claims. 22. In accordance with the Arbitration Act in force, the Chairman and Managing Director shall be the sole Authority to nominate a person to be the arbitrator. The decision of the Chairman and Managing Director of ITDC shall be binding and final upon both the parties. 23. All dispute arising out of the arrangement entered in between the ATT and Consolidators are subject to the jurisdiction of the Bangalore High Court. 24. In case above terms and conditions are acceptable, one copy of the same may be signed and sealed as agreed and may please be submitted along with the quotation.
